Agenda 07/13/2021 Item #16F 1 (RPS #21-7868 w/Tindale Oliver & Assoc.)07/13/2021 EXECUTIVE SUMMARY Recommendation to award Request for Professional Services (“RPS”) No. 21-7868, “Impact Fee Studies & Fiscal Analysis,” to Tindale Oliver & Associates Inc., and authorize the Chair to sign the attached agreement. OBJECTIVE: To obtain professional impact fee and fiscal analysis consulting services and award a contract to Tindale Oliver & Associates Inc., for RPS No. 21-7868, “Impact Fee Studies & Fiscal Analysis.” CONSIDERATIONS: Due to the ongoing requirements of effectively managing the impact fee program, which often requires the expertise of outside consultants, Collier County solicited for a firm to provide professional consulting services concerning impact fees. Examples of the types of services to be provided under this contract include impact fee update studies, impact fee indexing calculation updates, reviews of independent and alternative fee calculations, legislative review and analysis, and attendance and presentations at meetings related to impact fees and associated subject matters. On May 25, 2021 (Agenda Item 16.F.2), the Board approved the selection committee ranking for RPS No. 21-7868, “Impact Fee Studies & Fiscal Analysis,” and authorized staff to negotiate the proposed agreement with Tindale Oliver & Associates, Inc. Tindale Oliver & Associates, Inc. was founded in 1989 and is based in Tampa, Florida. Since its establishment, Tindale Oliver has provided industry-leading public finance, community planning, multimodal transportation, and transit solutions to public sector clients throughout the United States. Furthermore, Tindale Oliver has successfully completed more than 400 impact fee studies throughout Florida and the United States, and has worked directly with Collier County for nearly 30 years. Staff recommends that the Board approve the attached proposed agreement. The agreement is for an initial five-year term, with an optional one-year renewal. The hourly rates are valid for the five-year term, and any additional project specific rates required will be negotiated prior to the acceptance of a proposal and memorialized in writing as agreed upon by the parties in a Work Order detailing the scope of service of each tasked project. FISCAL IMPACT: The cost of impact fee update studies and indexing are currently funded by the applicable Impact Fee Trust Funds. General impact fee consulting costs are budgeted through the Impact Fee Administration, Fund 107 and update studies are funded through the individual impact fee trust funds. The cost of studies, indexing and other impact fee consulting services vary based on the complexity of the task. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT GROWTH MANAGEMENT IMPACT: Impact fees provide financial resources for the construction and/or expansion of the County’s capital infrastructure, as necessary to accommodate growth. Development is required to contribute its fair share of the cost of providing public facilities necessitated by growth, however impact fees may not be collected in excess of the amount reasonably anticipated to fund such improvements.
