Agenda 07/13/2021 Item #16D17 (Agreement w/Tidal Basin Government Consulting)07/13/2021 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairperson to sign an agreement between Tidal Basin Government Consulting, LLC, acting as a repository of grant recipient information, and Collier County for the purpose of data sharing between the State of Florida Department of Children and Families “OUR Florida” program and the U.S. Treasury Emergency Rental Assistance program administered by Collier County to assure no duplication of benefits. OBJECTIVE: To provide grant funding to Collier County residents unable to pay rent and utilities due to the impacts of the COVID-19 pandemic and prevent duplication of such benefits. CONSIDERATIONS: On January 26, 2021, Agenda Item #16D7, and June 8, 2021, Agenda Item #16D1 the Board of County Commissioners (Board) accepted the U.S. Department of Treasury Emergency Rental Assistance Grant Award. This program provides rental and utility assistance for residents of Collier County whose income qualifies and continue to experience a financial hardship due to COVID-19. The Florida Department of Children and Families (DCF) has contracted with Tidal Basin Government Consulting LLC (Tidal Basin) to administer the funds received by the State of Florida under the U.S. Treasury Emergency Rental Assistance Program (ERAP) established by Section 501(a) of Division N of the Consolidated Appropriations, Act, 2021 Pub. L. No. 116-260. Tidal Basin is administering ERAP under the title of “OUR Florida”. The program was established to assist eligible clients that are una ble to pay rent or/utility bills due to the COVID-19 public health emergency. The DCF program is offered to residents of all sixty-seven (67) counties in Florida. It is important that local jurisdictions that also received direct ERAP allocations and where applicable, other federal funds for emergency rental assistance to run programs, locally coordinate closely with the State “OUR Florida” program to identify and prevent duplicative payments, known as duplication of benefits. To avoid this a data-sharing agreement is necessary to ensure full compliance. This is a non-monetary agreement. Tidal Basin is seeking to enter into a Data Sharing Agreement (DSA) with Collier County. As DCF has contracted with Tidal Basin for the administration of the “OUR Florida” program, DCF will not be entering into DSA’s for this purpose but is requiring its vendor do to so on behalf of the State. The proposed agreement is to establish the terms and conditions by which the Tidal Basin and Collier County agree to exchange data regarding the individual(s) who have received ERAP benefits. This data sharing is a process for taking categorical data elements structured under a source database and mapping them to a target database so that the target data is an accurate representation of the source data. The Information Technology (IT) Division of Collier County approved the ERA Data Sharing Agreement on June 28, 2021, as presented by Tidal Basin. FISCAL IMPACT: The proposed action has no Fiscal impact. LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires a majority vote for Board approval. -JAB GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item. L. No. 116-260. Tidal Basin is administering the Emergency Rental Assistance Program under the title of “OUR Florida.” Tidal Basin is tasked to comply with all federal regulations relating to the Emergency Rental Assistance Program, which includes ensuring applicants do not received duplication of assistance. Tidal Basin’s project plan to comply with the non-duplication of assistance is to enter into Data Sharing Agreements (DSA) with all entities who received direct allocation of Emergency Rental Assistance from the United States Department of the Treasury. As DCF has contracted with Tidal Basin for administration of this program, DCF will not be entering into DSA’s for this purpose but is requiring its vendor do to so on behalf of the state. Additionally, Tidal Basin is the repository of recipients’ information of the Our Florida program which your programs may require. Please work with Tidal Basin to enter into a DSA to ensure federal requirements are met on behalf of the local and state ERA programs.
