Agenda 07/13/2021 Item #16C18 (Utility Easement for Project #700143)07/13/2021 EXECUTIVE SUMMARY Recommendation to approve a Utility Easement within County Right-of-Way (ROW) for existing and proposed wastewater facilities at an estimated cost not to exceed $50, Project #70014.3. OBJECTIVE: To approve and authorize the Chair to sign the attached Utility Easement. CONSIDERATIONS: Pump Station 103.01 has been located within the platted right-of-way since 1976. Wastewater staff has been maintaining the area since the pump station was constructed. Normally, a Utility Easement is not necessary when utilities are within the ROW, however, the existing pump station was put in an area that when platted, an extension of the road could have been built. There are no plans by Transportation to utilize the platted ROW where the pump station is located. FISCAL IMPACT: The total cost will not exceed $50 to record the Utility Easement. Funding is available in the FY20-21 Capital Budget approved by the Board on September 17, 2020. The source of funding is the Wastewater User Fee Capital Fund (414). GROWTH MANAGEMENT IMPACT: Projects funded with User Fees (414) have no impact on the Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires majority vote for approval. - JAB RECOMMENDATION: That the Board of County Commissioners approve the Utility Easement and authorize the Chair to execute on behalf of the Board; and authorize staff to record the Utility Easement in the Public Records of Collier County, Florida.
