Agenda 07/13/2021 Item #16A14 (Developer Agreement - Greyhawk)07/13/2021 EXECUTIVE SUMMARY Recommendation to approve a Developer Agreement providing for the acquisition of land and easements for roadway and related improvements at the entrances to Greyhawk, required for the Vanderbilt Beach Road Extension (Project No. 60168). OBJECTIVE: To acquire the right-of-way needed for the construction of the Vanderbilt Beach Road Extension Project (the Project), which includes roadway and related improvements at the entrances to Greyhawk. CONSIDERATIONS: Collier County is seeking to acquire fee simple interest Parcels 126FEE1, 126FEE2, 131FEE, 175FEE, 176FEE and temporary easement Parcels 177TDRE, 178TDRE, 179TDRE1 and 179TDRE2 (collective, “the Parcels”), needed for construction of the Project. The parent tracts of the Parcels are owned by Pulte Home Company, LLC and GC of the Everglades, LLC and are part of a residential golfing community known as “Greyhawk”, which is located on the north side of Old Vanderbilt Beach Road. The Project improvements include connecting the main Greyhawk entrance to the new roadway and reconstructing its entrance at Douglas Street to tie into the roadway improvements. The attached Developer Agreement provides for the conveyance of the Parcels to the county for no monetary consideration. The agreement also provides that the segment of Old Vanderbilt Beach Road east of Douglas Street will become a publicly maintained road. This will allow vehicles exiting the new roadway at the main entrance to Greyhawk to travel west along Old Vanderbilt Beach Road, which will become a frontage road once the new roadway is constructed. Staff accordingly recommends that the Board of County Commissioners (the Board) approve the Developer Agreement, which is the culmination of amicable negotiations between staff and representatives of Greyhawk. FISCAL IMPACT: Funds estimated at $200 will be required, being estimated closing and recording fees. The primary funding source for the acquisition of right -of-way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. No maintenance costs are anticipated until such time as the Project is constructed. GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB RECOMMENDATION: . Approve the attached Developer Agreement and authorize the Chairperson to execute same on behalf of the Board; . Accept the conveyance of Parcels 126FEE1, 126FEE2, 131FEE, 175FEE, 176FEE, 177TDRE, 178TDRE, 179TDRE1 and 179TDRE2 and authorize the County Manager, or his designee, to record the conveyance instrument in the public records of Collier County, Florida; . Authorize the payment of all costs and expenses that Collier County is required to pay under the terms of the purchase agreement to close the transaction; . Authorize the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions of the purchase agreement; and 16.A.14 Packet Pg. 603 07/13/2021 .
