EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien, with an accrued value of
$67,513.21 for payment of $11,857.71, in the code enforcement actions entitled Board of County
Commissioners v. Albert Houston, Sr., Code Enforcement Board Case No. 2006070939 CEB No.
2007-64, relating to property Folio #25631120101, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement
lien with an accrued value of $67,513.21 for payment of $11,857.71 in relation to Code Enforcement
Board Case No. 2006070939 CEB No. 2007-64.
CONSIDERATIONS: As a result of various code violations, the Code Enforcement Board ordered the
imposition of a lien against Albert Houston, Sr., for property Folio #25631120101, Collier County,
Florida.
The lien in Case No. 2006070939 CEB No. 2007-64, for a code violation due to a deteriorated,
unpermitted mobile home structure on a vacant residential zoned lot, was recorded in the Official Records
on March 7, 2008, at O.R. Book 4336, Page 2729.
The lien amount of $67,513.21 is based on 731 days of accrued fines ($50 per day from August 28, 2007
through August 27, 2009) totaling $36,550 for the violation of Order Item #4, and an additional 609 days
of accrued fines ($50 per day from December 28, 2007 through August 27, 2009) totaling $30,450 for the
violation of Order Item #5, plus $513.21 in operational costs. The violations were abated on August 27,
2009 when Mr. Albert Houston, the previous owner, obtained a demolition permit and Certificate of
Occupancy.
Pursuant to Resolution No. 2012-46, a request for a reduction of fines may be considered, in part, when a
lien encumbers property under new ownership, the new owner has diligently pursued abatement and
achieved compliance, and/or when payment of the lien would impose a severe financial hardship on the
owner. The property was a acquired at auction by Victor A. Aguayo, via Tax Deed recorded on
December 1, 2020. At the time of purchase, Mr. Aguayo was unaware of the substantial fines accruing
due to the previous owners’ violation and numerous abatement liens. The property is actively maintained,
and the owner has paid $11,344.50 in nuisance abatement costs and $513.21 in operational costs. The
owner is requesting a waiver of $67,000 in accrued fines. There are no known code violations remaining
on the property.
FISCAL IMPACT: Payment of $11,857.71 has been made, representing $11,344.50 in nuisance
abatement costs and $513.21 in operational costs. If approved by the Board, accrued fines in the amount
of $67,000 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. -CAK
RECOMMENDATION: To waive the fines in the amount of $67,000, accept the payment amount of
$11,857.71, release the liens, and authorize the Chairman to sign the attached releases and satisfaction of
liens for recording in the Official Public Records.

said permit through to final inspection and a Certificate of Occupancy by Dec. 27,2007, or a fine of
