EXECUTIVE SUMMARY
Recommendation to approve a resolution approving Final Acceptance of potable water,
wastewater, and non-potable irrigation water facilities, and related conveyances, for all
Outstanding Utilities Projects that qualify for Final Acceptance, authorize the release of related
Utilities Performance Securities, and authorize the transfer of the associated Final Acceptance
Obligations Cash Bond(s) to the Collier County Public Utilities Department. (This is a companion
item to 17B. Both items must be either approved or denied together on today’s agenda.)
OBJECTIVE: To have the Board of County Commissioners of Collier County, Florida, as the
Governing Body of Collier County, Florida, and as the Ex-Officio Governing Board of the Collier County
Water-Sewer District (“Board”), approve a resolution granting Final Acceptance of the potable water,
wastewater, and non-potable irrigation water facilities and related conveyances for qualifying Outstanding
Utilities Projects, authorize the release of related Utilities Performance Securities, and authorize the
transfer of the associated Final Acceptance Obligations Cash Bond(s) to Collier County Public Utilities
Department (CCPUD).
CONSIDERATIONS:
1) On May 11, 2004, the Board adopted Collier County Ordinance No. 2004-31, known as Collier
County Utilities Standards and Procedure Ordinance to establish the minimum standards for potable
water, wastewater, and non-potable irrigation water systems within the Collier County Water -Sewer
District. Two amendments followed on September 11, 2007 with Ordinance No. 2007-60, and on
July 10, 2018 with Ordinance No. 2018-36.
2) Subsequently, Public Utilities staff (in cooperation with the Development Review Department, the
County Attorney’s Office, and the DSAC subcommittee) updated the Final Acceptance requirements
and utilities conveyance process with an amendment to Ordinance 2004-31, which is being presented
to the Board for approval as a companion item. Final Acceptance consisted of a two-step process:
Preliminary Acceptance and, after a one-year warranty period and final inspection, during which the
applicant owns and operates the utility facilities, Final Acceptance by the Board. The updated
process merges Preliminary Acceptance and Final Acceptance to create a one-step acceptance
process that requires Utilities Performance Securities for qualifying utility systems and removes the
Final Acceptance Obligations Cash Bond that is no longer applicable. The industry standard of a
one-year warranty will remain as a requirement of these recommendations.
3) Due to the default of the provider(s) of the Final Acceptance Obligations Cash Bond(s) not
completing the Final Acceptance requirements within the four (4) year delivery of the cash bond, the
Final Acceptance Obligations Cash Bond(s) shall be forfeited to the CCPUD. Any remaining
projects within the four (4) year delivery of the Final Acceptance Obligations Cash Bond(s) shall be
reviewed on an annual basis for Final Acceptance completion.
4) In light of these changes, staff is now recommending the Board to approve Final Acceptance of the
qualifying Outstanding Utilities Projects (reference attached Exhibit “A” for a list of these projects)
and authorize the Clerk to release the related Utilities Performance Securities, and transfer the Final
Acceptance Obligations Bond(s) from the Growth Management Department (GMD) Refundable
Deposits Account (670) to the CCPUD Miscellaneous Income Operating Fund (408).
FISCAL IMPACT: Approval of this resolution will result in the Collier County Water-Sewer District
receiving title to potable water, wastewater, and non-potable irrigation water systems, which at the time of

preliminary acceptance, had an estimated total gross value of $19,633,434.88 (no depreciation applied),
and those assets will be recorded in the financial records of the County.
Approval of this resolution will also result in the transfer of the defaulted Final Acceptance Obligations
Cash Bond(s) in the amount $300,000 from the GMD Refundable Deposits Account (670) to the CCPUD
Miscellaneous Income Operating Fund (408).
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. -DDP
