EXECUTIVE SUMMARY
Recommendation to approve final acceptance of the potable water and sewer facilities for Davis
Crossings, PL20120001771 and PL20210000904, accept the conveyance of a portion of the potable
water and sewer facilities, and authorize the County Manager, or his designee, to release the
Utilities Performance Security (UPS) in the amount of $59,162.94 to the Project Engineer or the
Developer’s designated agent.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the
Collier County Water-Sewer District, approve final acceptance of the potable water and sewer facilities,
accept the conveyance of a portion of the potable water and sewer facilities, and to release the Utilities
Performance Security (UPS) in the amount of $59,162.94, in accordance with the Collier County Utility
Standards and Procedures, Ordinance No. 2004-31.
CONSIDERATIONS:
1) The Developer of Davis Crossings, has constructed the potable water and sewer facilities within
dedicated easements to serve this private development (see attached location map). A portion of the
potable water and sewer facilities was offered for conveyance to the County under PL20120001771,
as described in Official Records (O.R.) Book 4546, Page (PG) 919, together with appurtenant Deed
of Utility Easement recorded in O.R. Book 4546, PG 928, of the Public Records of Collier County,
Florida. The remaining potable water and sewer facilities will be private.
2) Preliminary acceptance of these utility facilities was approved by the Development Review staff on
October 22, 2009 under PL20120001771. At that time, the value of these potable water and sewer
facilities (assets) was $21,370.55 and $6,867.78, respectively. (See attached asset sheet). Due to the
economic downturn, the developer of Davis Crossings never obtained final acceptance for the
project. The current developer has since made some modifications to the private portion of the
existing water system, and was granted a utility deviation for this portion of the conveyance
(PL20210000904), which permitted the project to deviate from the standard utilities acceptance
process, allowing the project to skip the one-year warranty period (and associated performance
security) and go straight into final utility acceptance. Public Utilities staff justified the deviation
because the portion of the water system being modified is going to be privately owned and
maintained.
3) Staff recorded all preliminary acceptance documents for PL20120001771 associated with the potable
water and sewer facilities conveyed to the County in the public records of Collier County, which
were reviewed and approved by the County Attorney’s office as to form and legality. The County
acquired its interest in a portion of the potable water and sewer facilities by Utilities Facilities
Warranty Deed and Bill of Sale recorded in O.R. Book 4546, at PG 919 (“the Utilities Facilities
Deed”), together with appurtenant Deed of Utility Easement recorded in O.R. Book 4546, at PG 928,
of the Public Records of Collier County, Florida.
4) The potable water and sewer utility facilities being conveyed to the County, have been operated and
maintained during the required one (1) year warranty period, following preliminary acceptance.
5) A final inspection for the entire project, to discover defects in materials and workmanship, has been
conducted by staff on May 19, 2021, in coordination with Public Utilities, and these facilities have
been found to be satisfactory and acceptable.

6) The on-site potable water and sewer utilities, less the potable water and sewer utilities described in
O.R. Book 4546, PG 919, are owned and maintained by the developer.
7) Staff recommends final acceptance of the subject utility facilities and to release the Utility
Performance Security (UPS) in the amount of $59,162.94. (See attached Exhibit A). Staff also
recommends acceptance of the Utilities Facilities Deed and the facilities described therein.
8) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended.
9) Staff is unaware of any issues that would serve to negate the recommendation to release the
applicable security.
FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water-Sewer
District receiving title to a portion of the potable water and sewer utility facilities, which at the time of
preliminary acceptance for PL20120001771, had a total gross value of $28,238.33 (no depreciation
applied) and an asset will be recorded in the financial records of the county.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. -DDP
RECOMMENDATION: To approve final acceptance of the potable water and sewer facilities for Davis
Crossings, PL20120001771 and PL20210000904, accept the conveyance of the Utilities Facilities Deed
and the facilities described therein, and to authorize the County Manager, or his designee, to release the

AND AS THE EX-OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY
WATER-SEWER DISTRICT, its successors and assigns, (hereinafter referred to as
"Grantee").
WIT NE S S ETH:
That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other good
and valuable consideration to said Grantor in hand paid by said Grantee, the receipt whereof is
hereby acknowledged, has granted, bargained and sold to the said Grantee, and Grantee's heirs,
successors and assigns forever, all potable water utility facilities and/or system(s) or portion(s)
thereof lying in, on, over and under the following described land, for operation, relocation,
installation, repair and/or maintenance of said facilities, system(s) or portion(s) thereof, all
situate and lying and being in Collier County, Florida, to wit:
(See Exhibit "A" attached hereto and incorporated by reference herein.)
(Exhibit "B" attached hereto is a sketch or other graphic representation
that depicts the physical location of the utility systems being conveyed.)
and said Grantor does hereby fully warrant the title to said utility facilities and/or system(s) or
portion(s) thereof, be they realty, personalty, or mixed, and Grantor will defend such title

against all claims of all persons whomsoever. For the purposes of this conveyance, the utility

plural, as context allows. A sketch or other graphic representation showing the location of the
utility facilities, etc., being conveyed is attached as Exhibit B.
TO HA VE AND TO HOLD the same unto the Grantee and its assigns, together with the right
to enter upon said land, excavate, relocate and/or take or introduce materials for the purpose of
constructing, relocating, operating, repairing and/or otherwise maintaining utility systems
thereon. Grantor and Grantee are used for singular or plural, as the context requires.
