Agenda 07/13/2021 Item #11A (Mosquito Control Boundary Expansion)07/13/2021 EXECUTIVE SUMMARY Recommendation to adopt a resolution approving the expansion of the boundaries of the Collier Mosquito Control District, pursuant to Section 388.211, Florida Statutes. OBJECTIVE: To adopt a resolution approving the expansion of the boundaries of the Collier Mosquito Control District, pursuant to Section 388.211, Florida Statutes. CONSIDERATIONS: At the June 22, 2021, meeting of the Board of County Commissioners, a presentation was made by Patrick Linn, Executive Director of the Collier Mosquito Control District (District) on the need to expand the District’s mosquito control boundaries. The District’s Board of Commissioners have determined that a substantial number of indicators warrant expansion of the District’s boundaries, including a rapidly increasing permanent population and an increasing mosquito- borne disease threat. Section 388.211, Florida Statutes, states, “The board of commissioners of any district formed prior to July 1, 1980, may, for and on behalf of the district or the qualified electors within or without the district, request that the board of county commissioners in each county having land within the district approve a change in the boundaries of the district.” The Collier Mosquito Control District was created in 1950. The District’s Board of Commissioners will meet Monday, July 12, 2021, to adopt a resolution requesting that the Board of County Commissioners use its statutory authority pursuant to Section 388.211, Florida Statutes, to approve expanded boundaries of the District delineated therein. If approved, the District will prepare a local bill for the 2022 Regular Session of the State Legislature to edit the District’s charter and make it effective October 1, 2022. The annual Collier County Legislative Delegation Meeting is slated for 9 a.m.,Wednesday, September 15, 2021, at the North Collier Regional Park Exhibit Hall. The local bill will be heard and its Regular Session filing voted upon by the Collier legislative delegation at this public hearing. FISCAL IMPACT: The District millage/rollback rate as applied to the current boundary would apply to applicable expansion areas. GROWTH MANAGEMENT IMPACT: This action will result in no growth management impact. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality and requires majority vote for approval. -JAK RECOMMENDATION: That the Board adopt a resolution approving the expansion of the boundaries of the Collier Mosquito Control District, pursuant to Section 388.211, Florida Statutes. WHEREAS, A Mosquito Control District was created in Collier County in 1950 encompassing six square miles with expansions occurring in 1963, 1971, 1972, 1982, 1989, 2000, and 2003, currently encompassing 401 square miles with current boundaries set and attached hereto as Exhibit “A”; and WHEREAS, after research and consideration, it is the recommendation of the Board of Commissioners of the Collier Mosquito Control District to expand the District’s boundaries by approximately 329 square miles as depicted and attached hereto as Exhibit “B”; and WHEREAS, the Board of Commissioners of the Collier Mosquito Control District has resolved in regular session on July 12, 2021, to request the Board of County Commissioners of Collier County, Florida, to approve the expansion of the boundaries of the District, a copy of the resolution (Resolution #10 – 2020-2021) is attached hereto as Exhibit “C”; and WHEREAS, Section 388.211, Florida Statutes, provides that the Board of Commissioners of any Mosquito Control District formed prior to July 1, 1980, may, for and on behalf of the District or the qualified electors within or without the District, request that the Board of County Commissioners in each county having land within the District approve a change in the boundaries of the District; and WHEREAS, based upon the presentation of the Collier Mosquito Control District before the Board of County Commissioners on June 22, 2021, demonstrated that, due to the growth in the county’s resident population, the proposed expansion of the Collier Mosquito Control District is in the best interest of the citizens of Collier County and will serve a public health need in reducing the mosquito-borne disease threat. NOW, THEREFORE, BE IT RESOLVED BY BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board of County Commissioners hereby approves the expansion of the Mosquito Control District boundaries as contained in their expansion resolution adopted by the Collier Mosquito Control District Board on July 12, 2021. Bearing west to the current District boundaries, encompassing Rookery Bay National Estuarine Research Reserve and a portion of Ten Thousand Islands National Wildlife Refuge. * GIS maps comprising the Expansion Area: • ProposedNewArea6-20-21.shp • ProposedNewAreaonly6-30-21.shp 11.A.1 Packet Pg. 164 Attachment: Combined Mosquito Control Docs (17462 : Recommendation to adopt a resolution approving expansion of the Collier Mosquito 600 North Road | Naples, FL 34104-3464 | P 239.436.1000 | F 239.436.1005 Page 1 of 2 RESOLUTION #10 - 2020-2021 WHEREAS, the Collier Mosquito Control District (the “District”) was created in 1950 and codified by an act of the Florida Legislature, Chapter 2001-298, Laws of Florida, as amended by Chapter 2004-425, Laws of Florida (collectively the “Codified Act”); WHEREAS, the District is governed by a Board of Commissioners (the “District Board”) elected by the electors in the District; WHEREAS, the existing geographical boundaries of the District encompass a four hundred one (401) square-mile area of Collier County, Florida, as more particularly described in Exhibit A attached hereto and made a part hereof (collectively the “Existing District Boundaries”); WHEREAS, in order to better protect the health and comfort of a rapidly growing population, the District Board believes it is prudent to expand the Existing District Boundaries to include an additional approximately three hundred twenty-nine (329) square-mile area of Collier County, Florida, as more particularly described in Exhibit B attached hereto and made a part hereof (collectively the “Expansion Area”); WHEREAS, pursuant to Section 388.211(1), Florida Statutes, the District Board may, for and on behalf of the District or the qualified electors within or without the District, request that the Board of County Commissioners of Collier County, Florida (the “County Board”), approve a change in the Existing District Boundaries to include the Expansion Area; NOW, THEREFORE, BE IT RESOLVED BY THE DISTRICT BOARD THAT: Section 1. In accordance with Section 388.211(1), Florida Statutes, the District Board hereby requests that the County Board approve a change in the Existing District Boundaries to include the Expansion Area effective as of October 1, 2022; Section 2.
