Resolution 2021-125 RESOLUTION NO. 2 0 21 1 2 5 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, REQUESTING THAT THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION CONVEY CERTAIN PROPERTY LOCATED ON THE EAST SIDE OF THE I-75/GOLDEN GATE PARKWAY INTERCHANGE TO COLLIER COUNTY. WHEREAS, in accordance with provisions of Section 337.25, Florida Statutes, the State of Florida Department of Transportation (hereinafter referred to as "FDOT") has the authority to convey surplus property to local governmental entities; and WHEREAS, FDOT currently has title to property required by Collier County for the maintenance of portions of the realigned I-75 Canal located on the east side of the I-75/Golden Gate Parkway Interchange; and WHEREAS, FDOT desires to convey said property to Collier County subject to the reservation of a limited access right-of-way line and easement rights for ingress, egress, maintenance, light, air and view over portions thereof; and WHEREAS, the Board of County Commissioners has determined that it is in the best interest of the citizens of Collier County for the County to accept title to said property subject to the abovementioned reservations. NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners does hereby request the State of Florida Department of Transportation to convey to Collier County all right,title and interest in and to that certain property described in Exhibit"A"(attached hereto and incorporated herein by reference) subject to the reservation of a limited access right-of-way line and easement rights for ingress, egress, maintenance, light, air and view over portions thereof, and does hereby authorize its Chairman to execute any agreement or other instrument pertaining to said transfer. AND IT IS FURTHER RESOLVED that the property described in Exhibit "A" shall be put to public purposes. THIS RESOLUTION ADOPTED on this day of , 2021 after motion, second and majority vote.
