Agenda 06/22/2021 Item #16A 2 (Resolution - I-75/Golden Gate Parkway Interchange)06/22/2021 EXECUTIVE SUMMARY Recommendation to adopt a resolution requesting that the State of Florida Department of Transportation quitclaim to Collier County certain property located on the east side of the I-75/Golden Gate Parkway Interchange, needed for maintenance of realigned portions of the I-75 Canal, and declaring that the property is to be used for public purpose only. (This item is a Companion to Agenda Item 16A3.) OBJECTIVE: To acquire the property needed for maintenance of realigned portions of the I-75 Canal on the east side of the I-75/Golden Gate Parkway Interchange. CONSIDERATIONS: During construction of the Interstate I-75 Interchange at Golden Gate Parkway by the State of Florida Department of Transportation (FDOT) several years ago, a segment of the I-75 Canal was realigned outside of the then-existing platted drainage easements. As depicted in the attached aerial map, this has left the County with no right to maintain the realigned segment of the canal. Following staff’s request, FDOT is willing to convey the land needed for maintenance of parts of the realigned canal to the County, subject to the reservation of a limited access right -of-way line and easement rights for ingress, egress, maintenance, light, air and view over portions thereof. Before FDOT can do so, a request must be made by formal resolution of the Board of County Commissioners (the Board). The resolution must also declare that the property is to be used for public purpose only. Remaining portions of the realigned canal will be maintained by the County under the provisions of a maintenance agreement with FDOT as FDOT needs these lands for right-of-way. The I-75 Canal will continue to be operated, controlled and maintained by the South Florida Water Management District under the Cooperative Agreement between the District (on behalf of the Big Cypress Basin) and Collier County, dated October 13, 2000, as amended. FISCAL IMPACT: FDOT will not be seeking compensation from the County for conveyance of this property. Therefore, the only fiscal impact will be the recording costs of a quitclaim deed from FDOT, which should not exceed $35.50. Funding is available within Stormwater Operating Fund (103) Cost Center (172929). GROWTH MANAGEMENT IMPACT: The proposed project is in accordance with the goals, objectives, and policies of all applicable sections of the Stormwater Management and the Conservation and Coastal Management elements of the Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority for Board approval. - JAB RECOMMENDATIONS: 1. Adopt the attached Resolution and authorize the Board’s Chairman to execute same on behalf of the Board; 2. Accept the conveyance of the property from the Florida Department of Transportation via quitclaim deed with the reservation of a limited access right -of-way line and easement rights for ingress, egress, maintenance, light, air and view over portions thereof, and authorize the County Manager or his designee to record same in the public records of Collier County, Florida; 3. Authorize the payment of all costs and expenses necessary to close foresaid transaction; and 4. Approve any and all budget amendments that may be required.
