PETITION.
PETITION No. VA-PL20200002152 - Request for a variance from Land Development Code
Section 5.03.06.E.6 to reduce the minimum side yard riparian setbacks from 7.5 feet to zero,
to accommodate a boat dock facility with two slips, for the benefit of Lot 13, Block G, Replat
of Unit No. 3 Little Hickory Shores subdivision, also known as 267 3rd Street West Lot 13,
in Section 5, Township 48 South, Range 25 East, Collier County, Florida. This petition is a
companion item to a petition for variance, BDE-PL20200002151.
GENERAL PURPOSE FOR THE PETITION.
This is a "companion item" with PETITION No. BDE-PL20200002151 boat dock extension on a
legally nonconforming 0.01-acre parcel commonly referred to as a "boat dock lot." The parcel is
too small to accommodate the minimum square -foot requirement for a building (single-family
dwelling) and the setback requirements of the zoning district. The petitioner desires to construct
a new dock facility comprising a single dock with two boat slips which requires zero side yard
riparian setbacks where 7.5 feet is required.
STAFF RECOMMENDATION.
Approval with conditions.
FINDINGS.
The Hearing Examiner has jurisdiction over this Petitioner pursuant to Sec. 2-87 of the Collier
County of Ordinances, Sec. 8.10.00 of the Land Development Code, and Chapter 9 of the
County Administrative Code.
2. The public hearing for this Petition was properly noticed and conducted in accordance with all
County and state requirements.
3. The public hearing was conducted electronically and in -person in accordance with
Emergency/Executive Order 2020-04.
4. The Petitioner and/or Petitioner's representative executed the Hybrid Virtual Quasi -Judicial
Public Hearing Waiver related to conducting the public hearing electronically and in -person.

5. The County introduced the petition and gave recommendations, followed by Petitioner and/or
Petitioner's representative, and public comment. There were no objections at the public
hearing.
6. The subject upland property is on a segment of 3rd Street West that has numerous "boat dock
lots" and the subject waterfront is approximately 30 feet total.
7. The County's Land Development Code Section 9.04.03 lists the criteria for variances. The
Hearing Examiner having the same authority as the Board of Zoning Appeals may grant, deny
or modify any request for a variance from the regulations or restrictions of the Collier County
Land Development Code. 1
Criteria and findings:
1. Are there special conditions and circumstances existing, which are peculiar to the location,
size and characteristics of the land, structure or building involved?
Yes. The expert testimony and evidence shows that the subject property is legal
nonconforming with respect to required lot area and width and is not capable ofsupporting
any listed permitted use within the RSF-4 zoning area in which it is located. Given these
circumstances, the subject property is one of 23 for which a Provisional Use (now known
as a Conditional Use) was granted in 1987 to allow such properties to be used for "non-
commercial boat launching facilities. " Additionally, there is a limited amount of shoreline
which results in a narrow riparian area further constricted by neighboring dock facilities
that limit the direction and orientation of any dock facility at this location. Most, if not all,
of the docking facilities along the subject shoreline have or will require a BDE and
Variance in order to be Code compliant.
2. Are there special conditions and circumstances, which do not result from the action of the
applicant such as pre-existing conditions relative to the property, which are the subject of
the Variance request?
Yes. The expert testimony and evidence show the property's natural shoreline and length
of shoreline requires additional protrusion due to the narrow riparian lines which results
in docks along this shoreline to require a variance from riparian setbacks to comply with
current regulations. The proposed dock facility will be consistent with other boat dock lots
in the area which were previously granted a variance (Resolution 00-51).
3. Will a literal interpretation of the provisions of this zoning code work unnecessary and
undue hardship on the applicant or create practical difficulties for the applicant?
Yes. The expert testimony and evidence demonstrates that the denial of this request would
prevent any use of the applicant's shoreline for the purpose of mooring and storing two

vessels which is allowed by right within the RSF-4 zoning district. The subject property is
a "boat dock lot" and that use is practically impossible without the requested variance.
4. Will the Variance, if granted, be the minimum Variance that will make possible the
reasonable use of the land, building or structure and which promote standards of health,
safety and welfare?
Yes. The expert testimony and evidence demonstrate sufficiently that the proposed docking
facility has been reduced to the minimum size allowable while still providing safe access.
Said dock has been designed to have a 1 foot riparian setback however the request is for
zero to allow for minimal flexibility at the time of construction.
5. Will granting the Variance confer on the applicant any special privilege that is denied by
these zoning regulations to other lands, buildings, or structures in the same zoning district?
No. The expert testimony and evidence illustrates that all the "boat dock lots " in this area
are similarly situated and approval of this variance will make this lot more consistent with
the other boat dock lots in the area.
6. Will granting the Variance be in harmony with the general intent and purpose of the Land
Development Code, and not be injurious to the neighborhood, or otherwise detrimental to
the public welfare?
Yes. The expert testimony and evidence demonstrate that the proposed dock will not affect
the functionality of surrounding docks and will allow the use of this property to be
consistent with others along the same shoreline.
7. Are there natural conditions or physically induced conditions that ameliorate the goals and
objectives of the regulation such as natural preserves, lakes, golf courses, etc.?
Yes. The expert testimony and evidence in the record demonstrate that the variance will
allow the construction of a private docking facility that will increase the recreational value
of the property and allow for the continued existence of the natural mangrove shoreline.
8. Will granting the Variance be consistent with the Growth Management Plan?
Yes. The expert testimony and evidence in the record demonstrate that approval of this
Variance will not affect or change the requirements of the Growth Management Plan.

Based on a review of the record including the Petition, application, exhibits, the County's staff
report, and hearing comments and testimony from the Petitioner and/or the Petitioner's
representative(s), County staff and any given by the public, the Hearing Examiner finds that there

is enough competent, substantial evidence as applied to the criteria set forth in Section 9.04.03 of
the Land Development Code to approve Petition.
DECISION.
The Hearing Examiner hereby APPROVES Petition Number VA-PL20200002152, filed by Jeff
Rogers of Turrell, Hall & Associates, Inc. representing Edward and Nancy Brennan as Trustees of
the Brennan Family Living Trust, with respect to the property described as Lot 13, Block G, Replat
of Unit No. 3 Little Hickory Shores subdivision, in Section 5, Township 48 South, Range 25 East,
Collier County, Florida and is located at 267 3rd Street West Lot 13 in Bonita Springs, Florida, for
the following:
• An application for variance from Land Development Code to reduce the minimum side
yard riparian setbacks from 7.5 feet to zero, to accommodate a new boat dock facility with
two slips, each with a boat lift, subject to the approval of a companion Boat Dock Extension
petition (BDEPL20200002151), for the benefit of the subject property.
Said changes are fully described in the Proposed Dock Plans and Site Survey attached as Exhibit
"A" and are subject to the condition(s) set forth below.
