EXECUTIVE SUMMARY
Recommendation to approve final acceptance and accept the conveyance of the potable water and
sewer utility facilities for Willoughby Preserve, PL20180000670 and authorize the County
Manager, or his designee, to release the Final Obligation Bond in the total amount of $4,000 to the
Project Engineer or the Developer’s designated agent.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the
Collier County Water-Sewer District, approve final acceptance and accept the conveyance of these
potable water and sewer facilities and to release the Final Obligation Bond in the total amount of $4,000,
in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31.
CONSIDERATIONS:
1) The Developer of Willoughby Preserve, has constructed the potable water and sewer facilities within
dedicated easements to serve this development. (See attached location map). The potable water and
sewer facilities were offered for conveyance to the County, as described in OR Book 5573, Page
2412, and are located within County utility easements dedicated by the plat of Willoughby Preserve
recorded in Plat Book 63, Pages 9 through 10 of the Public Records of Collier County, Florida.
2) Preliminary acceptance of these utility facilities was approved by the Development Review staff on
November 19, 2018. At that time, the value of these potable water and sewer utility facilities
(assets) was $23,077.44 and $24,278.78, respectively.
3) Staff recorded all preliminary acceptance documents associated with the facilities being conveyed to
the County in the public records of Collier County, which were reviewed and approved by the
County Attorney’s office as to form and legality. The County acquired its intere st in the potable
water and sewer facilities by Utilities Facilities Warranty Deed and Bill of Sale recorded in Official
Records Book 5573, at page 2412 (“the Utilities Facilities Deed”) of the Public Records of Collier
County, Florida.
4) The potable water and sewer utility facilities have been operated and maintained during the required
one (1) year warranty period, following preliminary acceptance.
5) A final inspection to discover defects in materials and workmanship has been conducted by the
Development Review staff on April 27, 2021, in coordination with Public Utilities and these
facilities have been found to be satisfactory and acceptable.
6) Staff recommends final acceptance of the subject utility facilities and to release the Utility Final
Obligation Bond in the total amount of $4,000. Staff also recommends acceptance of the Utilities
Facilities Deed and the facilities described therein.
7) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended.
8) Staff is unaware of any issues that would serve to negate the recommendation to release the
applicable security.
FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water -Sewer
District receiving title to the utility facilities, which at the time of preliminary acceptance, had a total

gross value of $47,356.22 (no depreciation applied) and an asset will be recorded in the financial records
of the county.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. -DDP
RECOMMENDATION: To approve final acceptance and accept the conveyance of the potable water
and sewer utility facilities for Willoughby Preserve, PL20180000670, accept the conveyance of the
Utilities Facilities Deed and the facilities described therein, and to authorize the County Manager, or his
designee, to release the Final Obligation Bond in the total amount of $4,000 to the Project Engineer or the
Developer’s designated agent.

THIS INDENTURE made this (gLday of fu-,2018 , between Blaczko, LLC, a Florida
limited liability company (hereinafter referred to as "Grantor"), and the BOARD OF COLTNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY AND AS THE EX-OFFICIO GOVERNING BOARD OF THE COLLIER
COUNTY WATER-SEWER DISTRICT, its successors and assigns, (hereinafter referred to as
"Grantee").
WITNESSETH:
That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other good and

lying and being in Collier County, Florida, to wit:
See Exhibit "A" attached hereto and incorporated by reference herein;
Exhibit "B" attached hereto is a sketch or other graphic representation that depicts the
physical location of the utility systems being conveyed;
and said Grantor does hereby fully warrant the title to said utility facilities and/or system(s) or portion(s)
thereof, be they realty, personalty, or mixed, and Grantor will defend such title against all claims of all
persons whomsoever. For the purposes of this conveyance, the utility facilities, system(s) and/or
portion(s) thereof conveyed herein shall not be deemed to convey any of the lands described in either
exhibit. Grantor and Grantee are used for singular or plural, as context allows. A sketch or other graphic
representation showing the location of the utility facilities, etc., being conveyed is attached as Exhibit B.
TO HAVE AND TO HOLD the same unto the Grantee and its assigns, together with the right to enter
upon said land, excavate, relocate and/or take or introduce materials for the purpose of constructing,
relocating, operating, repairing and/or otherwise maintaining utility systems thereon. Grantor and
Grantee are used for singular or plural, as the context requires.
