EXECUTIVE SUMMARY
Recommendation to adopt a resolution amending Resolution 2008-331 for Stewardship Sending
Area 14 (“CLH SSA 14”) within the Rural Lands Stewardship Area Overlay District (RLSA) by
way of a first amendment to the amended and restated Escrow Agreement for CLH SSA 14; and
approving the first amendment to the amended and restated Escrow Agreement for CLH SSA 14.
The subject property is located in Sections 13, 14, 23 and 24, Township 47 South, Range 28 East,
Collier County. (This is a Companion Item to 9A, 11A, 11C, 11D, and 11E)
OBJECTIVE: To approve the first amendment to the amended and restated Escrow Agreement for the
fourteenth Stewardship Sending Area (CLH SSA 14) in the Rural Lands Stewardship Area Zoning
Overlay District (RLSA).
CONSIDERATIONS: The Rural Lands Stewardship Area (RLSA) Overlay District was adopted by
Collier County as a program designed to preserve natural resources, protect agricultural lands, and direct
growth to suitable locations. The mechanism to achieve this is through the designation of Stewardship
Sending Areas (SSAs) in exchange for Stewardship Credits (Credits) that can be used to entitle
development.
On November 18, 2008, the Board of County Commissioners (Board) approved the fourteenth
Stewardship Sending Area (SSA) known as CLH SSA 14 and awarded 2,515.7 Stewardship Credits.
On April 13, 2021, the Board approved a resolution (Resolution 2021-082) to amend CLH SSA 14, which
redesignated 1,712.9 acres as CLH SSA 14; amended and restated the Stewardship Sending Credit
Agreement, Stewardship Easement Agreement, and Escrow Agreement; and established the number of
credits (12,893.3) generated from said SSA.
This application to amend the previously amended and restated Escrow Agreement for CLH SSA 14 to
remove references to “Longwater Village SRA” and to replace those references with “Town of Big
Cypress SRA.” Following the Collier County Planning Commission hearing for the Longwater Village
SRA, the applicant requested to utilize Credits from SSA 15 (CLH & CDC SSA 15) instead of using
credits from SSA 14 to entitle Longwater Village SRA. CLH & CDC SSA 15 has enough credits
available to entitle the Longwater Village SRA.
FISCAL IMPACT: There are no fiscal impacts associated with this application.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority
vote for Board approval. (HFAC)
GROWTH MANAGEMENT IMPACT: The Rural Lands Stewardship Area Overlay in the Future
Land Use Element (FLUE) established the process and requirements f or establishing SSAs, which lands
qualify for SSA designation and the use limitations for lands once designated as SSAs. The Rural Lands
Stewardship Area Overlay is implemented through the Rural Lands Stewardship Area Zoning Overlay
District. The zoning overlay contains the same requirements and limitations as the FLUE Overlay.
Therefore, staff’s analysis indicates this resolution to amend the amended and restated Escrow Agreement
is compliant with the RLSA Zoning Overlay and is also consistent with the FLUE.
RECOMMENDATION: That the Board adopt a resolution amending the previously amended and
restated Escrow Agreement for Stewardship Sending Area 14 (CLH SSA 14) by way of the first
Amendment to remove references to “Longwater Village SRA” within the agreement and to replace those
references with “Town of Big Cypress SRA.”
