\VItERE,-\S. the l.cgislaturc ~f thc State of Florida in Chapter 125, Florida Statulcs,
has conferred on all counties in Florida thc power to establish, coordinate and enforce zoning
and such business regulations as are necessary lbr the protection of the public; and
WHEREAS. the County pursuant thereto bas adopted a Land Development Code
(Ordinance No. 91-102) which establishes regt, lations for the zoning of particular geographic
divisions of thc ('ounty. among which is thc granting of variances; and
WHEREAS. the Board of Zoning Appeals. being tile duly elected constituted Board of
the area hereby affected, has held a public hearing after notice as iii said regulations made and
provided, and has considered the advisability of a !5-foot variance from the required rear
yard setback of 15 feet to -fl- feet as shown on the attached plot plan, Exhibit "B", in a C-!
Zone for thc property hereinafter described, and has found as a matter of fact thai satisfactory
provision and arrangement have been made concerning all applicable matters required by said
regulations and in accordance with Sec,.ion 2.7.5 of thc Zoning Rcgt, lations of said l.and
Development Code for the unincorporated area of Collier County; and
WHEREAS. all interested panics have been given opportunity to be heard by this
Board in public meeting assembled, and the Board having considered all matters presented;
