RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY
DETERMINING THAT REVISIONS TO THE PARKLANDS DEVELOPMENT ORDER DOES/OR
DOES NOT CONSTITUTE A SUBSTANTIAL DEVIATION REQUIRING FURTHER

OBJECTIVE:
The objective ot this executive summary is to solicit trom the Collier
County Board ot Commissioners a ruling that the proposed amendment to
the Park lands Development of Regional Impact (DRI) Development 85-4
does not consti tute a substantial deviation requiring further
D~v~l~pment of R~gic~al Tmpact review.
CONSIDERJlTIONS:
Chapter 380, section (19) (b) (1) thru (16) define threshold revisions
that constitute a substantial deviation to a Development of Regional
Impact (DRI) that would require furthAr review. Generally these
thresholds refer to increases in density Ol' intensity of land use or
decreases in open space. The proposed modification to The parklands
Development Order is for the purpose of reducing the area covered by
the Development Order and to make other minor changes. The result of
this action does not abridge any of the thresholds for determining the
signiticance of the change. A notification from the Regional Planning
Commission or the DCA that they do not plan to attend the public
hearing generally ~uggests that they consider the amendment
insubstantial. Both the Regional Planning Council and DCA have been
advised of your local public hearing. Neither have officially
communicated with this offic~.
Determination of substantialness pursuant to Florida Statute Chapter
380.19 are not reviewed by the Collier County Planning Commission.

The application to collier County to modify the
Parklands DRI Development Order and the PUD zoning will
be filed simultaneously with an application to
incorporate the subject half sectle,.;: ,~,r> the existing
Quail West PUD. The Quail West PUD has been approved
by Collier County and is currently under development.
Quail West, like the Parklands, lies partially in
Collier county, and partially in Lee County. Quail
West is a low density residential/golf course community
with no commercial uses permitted. The previously
approved Collier county PUD for Quail West Phase I
authorizp.s a maxi~um of 325 single-family dwellings and
an lS-hole golf course. The previously approved
portion of Quail West, which lies in Lee County (Phase
II) authorizes a maximum of 225 single-family dwellings
and 9 golf holes. The half section of land which Quail
West is acquiring from the Parklands will constitute
the third and final Quail West dGvelopment phnsp. a~d
"the rezone petition for Phase III which will be
, simultaneously filed with the Parklands modification
'applications and will request approval for a maximum of
"191 single-family dwellings and 9 golf holes. Thus,

essential difference is that the parklands Master Plan

Adjustments to the proposed Collier county parklands
D.O. which would be necessary to accommodate the
reduction in the project area includes; reducing the
number of dwellings authorized, and making appropriate
&cre?-~ _!-r~c~ions. The only oth.~ ~ee and Coll;cr
Coullty Parklands DRI Development Order changes which
are proposed is to remove the requirement for
development of the "northwest road", and an extension
of time for commencement of development of less than
five years.
The "northwest road" whici. is :.:eferenced in both the
Lee and Collier parklands Development Orders, was
originally deemed necessary for general traffic
circulation and to provide access to the east half of
section 8 so that residents in that half section would
not have to travel first to the east thence north to
access Carrell Road (Bonita Beach Road extended).

The incorporation of the east half of Section 8 in
Quail West will allow for the construction of a road
which provide!' the same function as the "northwest
road" by virtue of the fact that the street system in
the east half of Section 8 will be interlocked with the
remainder of the Quail We~t Development - the Quail
West Development is accessed by a resp.ntly d~velope~ '
constructed north/south road, Bonita Grande Road, which
extends from the principal Quail West entry north to

RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
DETERMINING THAT REVISIONS TO THE
PARKLANDS DEVELOPMENT ORDER 85-4 DO NOT
CONSTITUTE A SUBSTANTIAL DEVIATION
REQUIRING FURTHER DEVELOPMENT OF REGIONAL
IMPACT REVIEW.
WHEREAS, the Board of County Commissioners of Collier
County, Florida approved Development Order 85-4, as amended,
(the Developmant Order) on September 10, 1985 which approved
a Development of Regional Impact (DRI) known as The
Parklands; and
WHEREAS, Section 380.06(19)(f)2, Florida statutes.
requires that proposed changes to a previously approved
Development of Regional Impact (DRI) be submitted by the
developer to the local government, the regional planning
council and the state land planning agency; and
WHEREAS, submittal or the proposed change:J was made to
the hppropriate public authorities; and
WHEREAS, Section 330.06(19) (f)5, Florida Statutes,
requires that the local government shall determine whether or
not the proposed change to the previously approved DRI
development order constitutes a substantial deviation
requiring further Development-of-Regional-Impact review; and
WHEREAIi, the Board of County commissioners of Collier
County has, reviewed and considered the report and
recommendations of the Southwest Florida Region~l Planning
Council (SWFRPC) and held on June 8, 1993 a public hearing on
the petition; and
WHEREAS, by separate action the Board of County
commissioners will cause The Parklands PUD Development Order
to be amended to reflect the proposed revisions which do not
constitute a substantial deviation requiring further
Development-'of-Regional-Impact review;
