EXECUTIVE SUMMARY
Recommendation to approve the release of two (2) code enforcement liens, with an accrued value of
$651,356.68 for payment of $756.68, in the code enforcement action titled Board of County
Commissioners v. Bradley Goodson and Leigha Wilson, Code Enforcement Board Case Nos.
CELU20140025432 and CEAU20150003345, relating to property located at 2448 Florida Ave.,
Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement
lien with an accrued value of $651,356.68 for payment of $756.68 in relation to Code Enforcement Board
Case Nos. CELU20140025432 and CEAU20150003345.
CONSIDERATIONS: As a result of various code violations, the Code Enforcement Board ordered the
imposition of two (2) liens against Bradley Goodson and Leigha Wilson for property located at 2448
Florida Ave., Collier County, Florida.
The lien in Case No. CELU20140025432, is for code violations that consist of outside storage of
numerous household items including washers, dryers, tires, litter, and weeds. The lien was recorded in
the Official Records on May 6, 2016, at O.R. Book 5270, Page 2701. The lien amount of $371,928.34 is
based on 1,859 days of accrued fines ($200 per day from December 22, 2015 through Jan uary 22, 2021)
totaling $371,800 plus $128.34 in operational costs. The property was acquired by Harold Hannah and
Elbert H. Hannah, via Warranty Deed recorded on November 21, 2020. The property was brought into
compliance on January 22, 2021.
The lien in Case No. CEAU20150003345, is for a code violation consisting of a chain link and privacy
fence surrounding the property without permits. The lien was recorded in the Official Records on May 6,
2016, at O.R. Book 5270, Page 2695. The lien amount of $279,428.34 is based on 1,862 days of accrued
fines ($150 per day from December 22, 2015 through January 25, 2021) totaling $279,300 plus $128.34
in operational costs. The property was acquired by Harold Hannah and Elbert H. Hannah, via Warranty
Deed recorded on November 21, 2020. The property was brought into compliance on January 25, 2021.
Pursuant to Resolution No. 2012-46, a request for a reduction of fines may be considered, in part, when a
lien encumbers property under new ownership, the new owner has diligently pursued abatement and
achieved compliance, and/or when payment of the lien would impose a severe financial hardship on the
owner. The new owners spent a substantial amount of time and money for the removal of the outside
storage, cleanup and disposable of debris, permits, and inspections, to come into compliance. The
property is being actively maintained and $756.68 has been paid in settlement of fines. The new owner is
requesting a waiver of $651,356.68 in accrued fines. There are currently no known violations.
FISCAL IMPACT: Payment of $756.68 has been made, representing $500 in fines, and $256.68 in
operational costs. If approved by the Board, accrued fines in the amount of $650,600 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, conforms to the
Board’s policy contained in Resolution 2012-46, is approved as to form and legality, and requires
majority vote for approval. - CAK

3. Operational costs of $65.01 incuned by the County in the prosecution of this case were ordered to be paid.
Respondents, having been duly noticed for the public hearing regarding the County's Motion, did not
appear at the public hearing, and no legal defense to the Motion was presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 200744, as amended, has been timely filed.
6. The violation has not been abated as ofthe date ofthe hearing.

Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter I 62, Florida
statutes, and collier county ordinance No. 2007-44, as amended, it is hereby ORDERED:
