EXECUTIVE SUMMARY
Recommendation to adopt a resolution amending Resolution 2021-083 for Stewardship Sending
Area 17 (“CLH & CDC SSA 17”) within the Rural Lands Stewardship Area Overlay District
(RLSA) by amending and restating the Escrow Agreement for CLH & CDC SSA 17; and
approving an amended and restated Escrow Agreement for CLH & CDC SSA 17. The subject
property is located in Sections 10, 11, 12, 14, 15, 22, 23, 26, 27, 34 and 35, Township 47 South,
Range 28 East and Sections 1, 2, and 3, Township 49 South, Range 28 East, Collier County. (This is
a Companion Item to 9A, 11A, 11B, 11C, and 11E)
OBJECTIVE: To approve the first amendment to the Escrow Agreement for the seventeenth
Stewardship Sending Area (CLH & CDC SSA 17) in the Rural Lands Stewardship Area Zoning Overlay
District (RLSA).
CONSIDERATIONS: The Rural Lands Stewardship Area (RLSA) Overlay District was adopted by
Collier County as a program designed to preserve natural resources, protect agricultural lands, and direct
growth to suitable locations. The mechanism to achieve this is through the designation of Stewardship
Sending Areas (SSAs) in exchange for Stewardship Credits (Credits) that can be used to entitle
development.
On April 13, 2021, the Board of County Commissioners (Board) approved the seventeenth Stewardship
Sending Area (SSA) known as CLH & CDC SSA 17; designated 3,148.3 acres as CLH & CDC SSA 17;
entered into a Stewardship Credit Agreement, Easement Agreement and Escrow Agreement with Collier
Landing Holdings, Ltd. and CDC Land Investments, LLC; and awarded 4,527.6 Stewardship Credits.
This application to amend the previously approved Escrow Agreement for CLH & CDC SSA 17 to
remove references to “Longwater Village SRA” and to replace those references with “Town of Big
Cypress SRA.” Following the Collier County Planning Commission hearing for the Longwater Village
SRA, the applicant requested to utilize Credits from SSA 15 (CLH & CDC SSA 15) instead of using
credits from CLH & CDC SSA 17 to entitle Longwater Village SRA. CLH & CD C SSA 15 has enough
credits available to entitle the Longwater Village SRA.
FISCAL IMPACT: There are no fiscal impacts associated with this application.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority
vote for Board approval. (HFAC)
GROWTH MANAGEMENT IMPACT: The Rural Lands Stewardship Area Overlay in the Future
Land Use Element (FLUE) established the process and requirements for establishing SSAs, which lands
qualify for SSA designation and the use limitations for lands once designated as SSAs. The Rural Lands
Stewardship Area Overlay is implemented through the Rural Lands Stewardship Area Zoning Overlay
District. The zoning overlay contains the same requirements and limitations as the FLUE Overlay.
Therefore, staff’s analysis indicates this resolution to amend the Escrow Agreement is compliant with the
RLSA Zoning Overlay and is also consistent with the FLUE.
RECOMMENDATION: That the Board adopt a resolution amending the previously approved Escrow
Agreement for Stewardship Sending Area 17 (CLH & CDC SSA 17) by way of the first Amendment to
remove references to “Longwater Village SRA” within the agreement and to replace those references with
“Town of Big Cypress SRA.”
