Roll Call Chairman Poteet called the meeting to order at 9:00 A.M. Roll call was taken and a quorum was established. Mr. Iandimarino moved to allow Mr. Bromley, Mr. Corban and Mr. Seef to participate via Zoom due to an extraordinary circumstance. Second by Ms. Lenhard. Carried unanimously 5 — 0. (Mr. Bromley joined the meeting at 10:15 a.m) II. Approval of Agenda Ms. Lenhard moved to approve the Agenda. Second by Mr. Seef. Carried unanimously 7— 0. III. Approval of March 8, 2021 minutes Ms. Lenhard moved to approve the minutes of the March 8, 2021 meeting as presented. Second by Mr. Kuehner. Carried unanimously 7— 0. IV. New Business A. Annual (Biennial) 2019-2020 Conservation Collier Report Ms. Araque presented the "Conservation Collier Annual Report — Draft Biennial 2019-2020 " for consideration and provided an overview of the changes to the plan, which is slated to be reviewed by the Board of County Commissioners on May 25, 2021. Mr. landimarino moved to recommend the Board of County Commissioners approve the Conservation Collier Annual Report — Draft Biennial 2019-2020 as presented by Staff. Second by Mr. Kuehner. Carried unanimously 7 — 0. B. Target Protection Areas Ms. Araque presented the "Target Mailing List Maps Cycle 10 (2021) " for consideration and "Resolution No. 2021, A Resolution of the Board of County Commissioners of the County of Collier, Florida, Approving a Target Protection Area Mailing Strategy for the Conservation Collier Land Acquisition Program 's Tenth Property Selection Cycle; Providing for an Effective Date " for informational purposes. She noted the Outreach Subcommittee reviewed and recommended approval of the map that is to be considered today. The Committee reviewed the maps for the following Target Protection Areas: Railhead Scrub Preserve, Cocohatchee Bay, Gordon River Greenway, Rattlesnake Hammock Preserve Corridor, Bayshore parcels, Shell Island Preserve, Panther Walk Preserve, Dr. Robert H. Gore, III, Nancy Payton Preserve, Caracara Preserve, Pepper Ranch, McIlvane Marsh and US41/SR29 Marsh. The following comments and/or recommendations for the maps were as follows: Panther Walk Preserve Discussion occurred noting: • The targeted properties comprise an area located in a wildlife corridor, contiguous to the proposed Immokalee Road Rural Village Planned Unit Development preserve lands. • Given the characteristics of the Target Area identified, it would lend itself to being deemed a multi -parcel project. 2 April 12, 2021 • There is concern those parcels contiguous to the existing parcels held within the program are not included in the targeted area and it would be beneficial to include these in the map. Mr. Bromley joined the meeting Mr. Kuehner moved to approve sending letters of inquiry to property owners of the lots as depicted on the map, subject to adding the lots located on 601 Ave NE, contiguous to the existing lands held within the Program. Second by Mr. Iandimarino. Carried unanimously 8-0. It was noted the contiguous parcels must be located within the limits of the Horsepen Strand boundary line depicted on the map. Caracara Prairie Preserve Staff to determine if the CREW Land and Water Trust is considering purchase of any of the properties and to eliminate those from consideration as necessary. US41/SR29 Marsh Discussion occurred noting: • The area is not at risk for development and not in the urban area. • It may be beneficial to contact representatives of Everglades City to determine if there is any interest in lands within this jurisdiction being acquired by the Program. One example would be the parcel adjacent to the airport. Mr. Kuehner moved to not send letters of inquiry to the property owners of the lots as depicted on the map. Second by Ms. Patterson -Weber. Motion carried 7 "yes" —1 "no. " Ms. Lenhard voted "no." Bayshore parcels Discussion occurred noting: • There are two significant vacant parcels in the area not included in the contact list as shown on the map. • One is owned privately and the other by the Collier County School District. • It may be beneficial to contact these owners to determine any interest they may have in selling the properties. Mr. Corban moved to approve sending letters of inquiry to the property owners of the lots as depicted on the map, subject to adding the School District parcel adjacent to East Naples Community Park and the Gulfview Development parcel located on Bayshore Drive just south of Barrett Ave., to the map. Second by Mr. Seef. Carried unanimously 8 — 0. McIlvane Marsh Mr. Kuehner moved to add the parcel at the end of Auto Ranch Road to the Target Protection Area. Second by Ms. Lenhard. He noted it has the potential for allowing access to the Preserve. April 12, 2021 Ms. Araque noted the parcel is already in conservation and part of the Fiddler's Creek preserve areas. Mr. Kuehner withdrew the motion. Others Chairman Poteet noted consideration should be given to contacting the owners of the lands on the southwest and southeast corners of the intersection of Logan Blvd. and Pine Ridge Road, to determine any interest they have in selling the properties. They are across the road from Logan Woods Preserve and at least one is currently for sale. Committee discussion occurred noting another consideration could be the vacant parcel on the northeast side of the intersection which could provide parking for the existing preserve, however the parcels would be expensive to acquire and the program has a limited amount of funds available for use. The Committee took no action on the suggestion at this point in time. Mr. Kuehner moved to recommend the Board of County Commissioner send letters of inquiry to the property owners of lots as depicted on the Target Protection Area maps as amended by the Committee during today's meeting. Second by Mr. Iandimarino. The Committee reviewed a letter submitted by Meredith Budd of the Florida Wildlife Federation and Brad Cornell of the Audubon Western Everglades, dated 4/11/21, which included a recommendation several lots on Marco Island identified as high priority Gopher Tortoise habitat be considered as targeted parcels. Discussion occurred noting the parcels are small in size (1/2 acre +/-), would be expensive to acquire given their locations, and difficult to manage. Additionally, a party could nominate the parcels for acquisition if they so desire at which time they would be considered by the Committee. The Committee determined to not add these parcels to the Target Protection Areas. Motion carried unanimously 8 — 0. C. Cycle 10 updates 1. Notified all owners on Cycle 9 A & B List (see map for A -list properties) Ms. Araque presented the report "Conservation Collier Cycle 10 Applications Received Between February 24, 2021 — April 2, 2021 " for informational purposes. The owners of the parcels identified on the Cycle 9 acquisition list which were not acquired, have been notified to determine if they are still interested in selling the properties to the County. 2. Applications received — will do Initial Screening Criteria (ICS) checklist and bring back for CCLAAC review Ms. Araque reported the following applications have been received and Staff will be preparing the necessary documentation for consideration by the Committee. a. Rivers Road (Popp) April 12, 2021 b. HHH Ranch Section 33 (various owners) c. Big Hammock areas I & II (Barron Collier) d. Bethune Rd & Sanitation Rd properties (Barron Collier) Meredith Budd, Florida Wildlife Federation, addressed the Committee regarding lands in the RLSA Sending Areas which may be considered for acquisition. She recommended the Committee ensure the cost of any parcels acquired account for the potential restoration credits available to the owner under the RLSA program. For those properties where the restoration credits have been issued to the owner, the price should be lowered accordingly to provide for the value of the use granted to the seller. If the restoration credits have not been issued, the seller not have the ability to utilize the credits after the fact as they would be experiencing a double economic benefit from the property. In cases where the seller wishes to retain rights to the restoration credits, they should be required to provide the program with some form of monetary endowment to offset the value gained for the credits. Conservation Collier Land Acquisition Advisory Committee Bill Poteet, Chairman These minutes approved by the Board/Committee on as presented or as amended 2 MEMORANDUM OF UNDERSTANDING BETWEEN COLLIER COUNTY AND CYPRESS COVE LANDKEEPERS, INC. This Memorandum of Understanding ("MOU") is entered into this day of , 2020 between COLLIER COUNTY, a political subdivision of the State of Florida ("COUNTY") and CYPRESS COVE LANDKEEPERS, INC. ("CYPRESS COVE"). Recitals WHEREAS, on July 10, 2018 COUNTY acquired the properties identified on Exhibit "A" from The Robert H. Gore III Inter Vivos Trust, dated July 25, 1986, for public use in COUNTY's Conservation Collier Program (COUNTY's PROPERTY or DR. ROBERT H. GORE III PRESERVE); and WHEREAS, on January 28, 2020the County approved the Interim Management Plan for the DR. ROBERT H. GORE I I I PRESERVE; and WHEREAS, June 7, 2019 CYPRESS COVE acquired the properties identified on Exhibit "B" from The Robert H. Gore III Inter Vivos Trust, dated July 25, 1986 for public use as nature center ("CYPRESS COVE's PROPERTY" OR "NATURE CENTER"); and WHEREAS, the COUNTY and the CYPRESS COVE wish to provide for coordination and cooperation of environmental, educational, and historical outreach information and signage on the properties for the benefit of the citizens of Collier County and others that may visit the properties. NOW THEREFORE, it is agreed as follows: 1. Authority. This MOU is entered into pursuant to Conservation Collier Ordinance No. 07-65, as amended (Section 4, Paragraph 12) and the Action Plan set forth in COUNTY's Interim Management Plan. 2. Duration. This MOU shall remain in effect until it is terminated in writing by either party upon 30 days written notice to the other party. 3. Effect of Recitals. The recitals set forth above are adopted as findings of fact and incorporated into this MOU. 4. COUNTY PROPERTY — DR. ROBERT H. GORE III PRESERVE. A. The County agrees to use the DR. ROBERT H. GORE III PRESERVE in accordance with the Interim Management Plan, as it may be amended or become a Final Management Plan, as amended ("Management Plan"). B. As with all Conservation Collier Property, the Preserve Management Ordinance No. 11-38, as it may be amended or otherwise modified or replaced applies at the DR. ROBERT H. GORE II I PRESERVE. C. No pets will be permitted in on the COUNTY's Property unless the Management Plan indicates that pets are allowed. D. COUNTY will install a lime -rock parking area on COUNTY's Property. The need for parking spaces and the number of spaces will be determined by COUNTY and is initially expected to be 5-6 parking spaces. E. Events that are to occur on at the DR. ROBERT H. GORE III PRESERVE after dusk will be coordinated with CYPRESS COVE. F. CYPRESS COVE employees and volunteers providing services on COUNTY's Property pursuant to this MOU are not considered agents or employees of COUNTY. G. The Interim Management Plan does not allow hunting on COUNTY's property due to the limited acreage and proximity of adjacent homesites. "No hunting" signs will be installed on COUNTY's Property. Signs prohibiting trespass, litter, firearms, all -terrain vehicles and poaching will also be installed on COUNTY's Property, H. Signs on COUNTY's Property will be coordinated with CYPRESS COVE such that signs on COUNTY's Property and signs on CYPRESS COVE's Property are consistent in content. CYPRESS COVE and COUNTY will send each other signage for review that includes mention of each other. Use of each party's logo on signage shall be approved in advance. 5. CYPRESS COVE's PROPERTY — NATURE CENTER A. In the event the NATURE CENTER and/or CYPRESS COVE property is open after dusk, CYPRESS COVE will notify the COUNTY. The intent is for evening events to be limited to reduce traffic for safety of wildlife after dusk. B. Gate located to 40th Avenue SE will be locked when Nature Center is not open. C. CYPRESS COVE will cooperate with COUNTY regarding any well installation COUNTY decides to pursue. D. Signs on CYPRESS COVE's Property will be coordinated with COUNTY such that signs on CYPRESS COVE's Property and signs on COUNTY's Property are consistent in content and appearance. E. CYPRESS COVE will coordinate its grand opening celebration with COUNTY. F. CYPRESS COVE's use of the COUNTY's trails is limited to open hours. _F_.G. The provisions set forth in Section 2.01.03A.9. of the Collier County Land Development Code relating to "Conservation Collier lands" and all "permitted 2 minor improvements" listed therein shall be applicable to CYPRESS COVE's PROPERTY. �y 6. Indemnification. Each party to this MOU agrees to be responsible for the liabilities arising out of their own conduct and the conduct of their officers, employees and agents with COUNTY's indemnification subject to Section 768.28, Florida Statutes. 7. Notice. Any notice sent pursuant to this Memorandum of Understanding shall be sufficient if sent by regular U.S. Mail to the following addresses: A. No advertising sign shall be permitted on any such structure. Locations and setbacks of school bus shelters shall be approved by the school board of Collier County. Mail, newspaper, and other delivery boxes shall be placed in accordance with U.S. Postal Service regulations. All such structures shall be exempt from district setbacks. 2.01.03 Essential Services Essential services are hereby defined as services designed and operated to provide water, sewer, gas, telephone, electricity, cable television or communications to the general public by providers which have been approved and authorized according to laws having appropriate jurisdiction, and government facilities. Essential services are allowed in any zoning district subject to the following conditions: A. The following uses shall be deemed permitted uses in all zoning districts, except CON districts, RFMU sending lands, NRPAS, HSAS, and FSAS: 1. Water lines and sewer lines; 2. Natural gas lines, except those associated with oil extraction and related processing operations as defined in this Code and regulated under applicable federal and state law; 3. Telephone lines, telephone switching stations, and cable television lines; 4. Communication towers, limited to those providing wireless emergency telephone service, subject to all applicable provisions in section 5.05.09 of this Code; 5. C. Additional permitted essential services in commercial and industrially zoned districts. In commercial and industrially zoned districts, in addition to the essential services identified above in section 2.01.03 A., governmental facilities, as defined by this Code, including law enforcement, fire, emergency medical services and facilities, public park and public library services and facilities, shall be considered a permitted essential service. D. Additional permitted essential services in the agricultural and estate zoned districts. Oil and gas field development and production as defined and regulated in this Code remains a conditional use on or beneath Conservation Collier lands established in zoning districts providing for oil and gas field development and production as a conditional use, subject to subsection 2.03.09 B.1.c.i. 2. In residential, agricultural, and estate zoned districts and in RFMU Receiving and neutral lands, in addition to those essential services identified as conditional uses in section 2.01.03 G.1. above, the following essential services shall also be allowed as conditional uses: a. Regional parks and community parks; b. Public parks and public library facilities; C. Safety service facilities; d. Other similar facilities, except as otherwise specified herein. 4. Additional conditional uses in the RFMU sending lands and CON districts. The following essential services shall be allowed as conditional uses: Communications towers, subject to all applicable provisions of LDC section 5.05.09. 5. As such they may not be considered to further the goal of "equitable geographic distribution" of acquired lands. However, appropriate access for nature -based recreation is available through the Pepper Ranch Preserve, though access roads are not paved. Access throughout the Pepper Ranch Preserve is facilitated by a main interior unpaved lime rock road running east to west and an offshoot north/south unpaved track, which is the access easement for the ranching activities that are currently occurring on the Area 1 parcel. The main ranch road can easily accommodate street vehicles. The north /south branch is rougher; however, street vehicles currently access it. Areas 1 and 2 have mm trails already existing that could be used for hiking biking, and horseback riding during_dry season. Because the offered lands are varied in habitat, with large open areas providing scenic vistas, acquisition could enhance the aesthetic setting of Collier County. 3. Does the property offer opportunities for protection of water resource values, including aquifer recharge, water quality enhancement, protection of wetland dependant species habitat, and flood control? Ord. 2002-63, see.10 (1)(c) ®Yes [—]No Acquisition of this property would offer opportunities for protection of water resource values, including moderate recharge of the surficial aquifer and protection of wetland dependent species habitat. A moderate surficial recharge rate would indicate habitat for wetland dependent species is present most of the year. A primary benefit to preserving the offered lands in an undeveloped state would be protection of the Corkscrew swamp and marsh complex and wetlands associated with Lake Trafford. The Corkscrew swamp and marsh complex provides recharge for the Lower Tamiami aquifer, a source of drinking water for many County and private wells east of County Road 951. Acquisition of both Area 1 and Area 2 would protect the quality of this water source by buffering the Corkscrew slough from development and non -point source pollution. As there are no nearby residential properties, it is unknown what benefits acquisition of the property would have for flood control, though it is subject to periodic flooding. 4. Does the property offer significant biological values, including biodiversity, listed species habitat, connectivity, restoration potential and ecological quality? Ord. 2002-63, Sec.10 (1)(d) ®Yes ❑No Both Area 1 and Area 2 offer significant biological values, listed species habitat, restoration potential and moderate to high ecological quality. We can assume that the same listed species observed on Pepper Ranch also utilize this property including but not limited to: American Alligator, Florida Panther, Florida Sandhill Crane, Heron species, Wood Stork. There is significant restoration potential for pasture lands and for forested areas now impacted by invasive exotic plants. Area 1 is directly adjacent to significant County, State, and private conservation lands. Acquisition of Area 2 without also acquiring Area 1 would not provide connectivity with Pepper Ranch Preserve. 5. Does the property enhance and/or protect the environmental value of current conservation lands through function as a buffer, ecological link, or habitat corridor? Ord. 2002-63, Sec.10 (1)(e) ®Yes ❑No Preservation and restoration of these lands would protect the value of the Corkscrew Marsh and the Camp Keais Strand, functioning as buffer to the 60,000 South Florida Water Management District conserved lands that include the CREW Marsh wetlands and as ecological link and corridor for the Camp Keais Strand and other conservation lands to the south. Ord. 2002-63, See.10 (1)(b) ®Yes [—]No The parcels are within the urban boundary for the town of Immokalee and slightly over 4 miles from Pepper Ranch Preserve, the closest Conservation Collier property. The parcels are accessible from various points along paved roads, including Bethune Rd., South 5th St., and Immokalee Road (South 1st St./CR 846), and from the unpaved Sanitation Road. The Bethune road parcel (parcel b.) can be seen from a major public thoroughfare — Immokalee Road. There are pine flatwoods along Immokalee Road, so potentially, a small parking lot could be created here with trails accessing the rest of the parcels south of the slough, at least in dry season. The historic Eustis landfill on the property was closed in 1992, with 20 years of monitoring completed in 2012. The landfill belonged to the County even though the land belonged owners, so liability would remain with the Count.. inquired. Groundwater samples taken from the middle of the landfill in 2012 showed that the site met permit requirements. 3. Does the property offer opportunities for protection of water resource values, including aquifer recharge, water quality enhancement, protection of wetland dependant species habitat, and flood control? Ord. 2002-63, Sec.10 (1)(c) ®Yes ❑No The properties are approximately half wetland and half upland, in a mosaic pattern with the slough and its associated wetlands covering the northern half of the properties. This slough flows from southeast to northwest and is bounded by forested uplands that buffer its water and wildlife from adjoining urban lands. The parcels are located within the core foraging areas of at least 4 wood stork colonies; it is within primM panther habitat; and it lies within the US Fish and Wildlife Service's consultation area for the Florida bonneted bat, all state and federally listed species that depend at least partly on wetlands. The slough is one of the primary overland sources of water to lake Trafford, and it accepts significant water flows that spill out onto adjoining forested lands as evidenced by water marks on cypress and other trees at above 2 feet. Cypress knees reaching 2 feet were observed. 4. Does the property offer significant biological values, including biodiversity, listed species habitat, connectivity, restoration potential and ecological quality? Ord. 2002-63, See.10 (1)(d) ®Yes ❑No Restoration on parcel a. could be costly due to the high disturbance as a result of loggias slash lash pines on the property in 2020. However, this property offers biological value for both upland and wetland species. The properties are connected westward with Lake Trafford through the slough, which then connects to the 2,512-acre Pepper Ranch Preserve and 60,000 acres of CREW lands. South from Lake Trafford there is a landscape connection through the Camp Keais Strand with the 26,400-acre Florida Panther National Wildlife Refuge, the 85,000-acre Fakahatchee Strand State Preserve State Park and the 729,000-acre Big Cypress Preserve. Eastward, there is a connection through undeveloped lands to the 32,370-acre Okaloacoochee Slough State Forest, the 21,714-acre Dinner Island Wildlife Management Area (WMA) and additional privately protected lands. All in all, there is a connection with close to a million preserved acres. 5. Does the property enhance and/or protect the environmental value of current conservation lands through function as a buffer, ecological link or habitat corridor?
