PETITION No. BDE-PL20200001959 - Request for a 8-foot boat dock extension over the
maximum 20 feet allowed by Section 5.03.06 of the Collier County Land Development Code
for waterways greater than 100 feet in width for a total protrusion of 28 feet into a waterway
that is 830 feet wide to accommodate a boat dock facility with two boat -lifts, one for a 30-
foot vessel and the other for personal watercraft, located at Lot 13 and the West 1/2 of Griffis
Highway between Lots 13 and 14, Isles of Capri No. 1, also known as 4 Pelican Street West,
in Section 05, Township 52 South, Range 26 East, Collier County, Florida.
GENERAL PURPOSE FOR THE PETITION.
The petitioner seeks to replace the existing boat dock with a smaller "L" type boat dock to
accommodate a 30-foot vessel and two personal watercrafts. The proposed boat dock protrudes
into the waterway from the seawall 28 feet where 20 feet is permitted as of right. Therefore, the
request is for an additional 8-foot extension.

1. The Hearing Examiner has jurisdiction over this Petitioner pursuant to Sec. 2-87(4) of the
Collier County of Ordinances, Sec. 8.10.00 of the Land Development Code, and Chapter 9 of
the County Administrative Code.
2. The public hearing for this Petition was properly noticed and conducted in accordance with all
County and state requirements.
3. The public hearing was conducted electronically and in -person in accordance with
Emergency/Executive Order 2020-04.
4. The Petitioner and/or Petitioner's representative executed the Hybrid Virtual Quasi -Judicial
Public Hearing Waiver related to conducting the public hearing electronically and in -person.

5. The County planning staff presented its staff report for the Petition, followed by a presentation
from the Petitioner and/or Petitioner's representative, a public hearing, and rebuttal by
Petitioner and/or Petitioner's representative. There were no objections at the public hearing.
6. The County's Land Development Code Section 5.03.06.H lists the criteria for a dock facility
extension. Accordingly, in order for the Hearing Examiner to approve a boat dock extension
request, the Hearing Examiner must determine that at least 4 of the 5 primary criteria, and at
least 4 of the 6 secondary criteria, have been met. These criteria are as follows:'
a. Whether the number of dock facilities and/or boat slips proposed is appropriate in relation
to the waterfront length, location, upland land use and zoning of the subject property.
Consideration should be made of property on unbridged barrier islands, where vessels are
the primary means of transportation to and from the property. (The number should be
appropriate; typical single-family use should be no more than two slips; typical multi-
family use should be one slip per dwelling unit; in the case of unbridged barrier island
docks, additional slips may be appropriate.)
The testimony and evidence presented at the hearing satisfies this criterion. The property
is located within a residential single-family zoning district and the request is for a single
boat dock facility with two boatlifts, one to accommodate a 30 foot vessel and the other
two personal watercraft. The proposed dock shall protrude 28 feet from the property line
which has been identified as the most restrictive point per LDC Section 5.03.06. C.1.
b. Whether the water depth at the proposed site is so shallow that a vessel of the general
length, type and draft as that described in the petitioner's application is unable to launch or
moor at mean low tide (MLT). (The petitioner's application and survey should establish
that the water depth is too shallow to allow launching and mooring of the vessel(s)
described without an extension.)
The testimony and evidence at the hearing is insufficient to declare this criterion met.
Although Attachment A, Sheet 05 of 08 — Cross Section provides MHW and ML W measures
it does not depict the draft of a vessel therefore this criterion has not been satisfied by the
applicant.
c. Whether the proposed dock facility may have an adverse impact on navigation within an
adjacent marked or charted navigable channel. (The facility should not intrude into any
marked or charted navigable channel thus impeding vessel traffic in the channel.)
The testimony and evidence presented at the hearing satisfies this criterion. The proposed
boat dock facility will protrude 28 feet into the waterway which is 7 feet less than the
existing dock facility. Additionally, the marked navigational channel is located south of the
subject dock facility. As proposed, the new dock facility is consistent with neighboring
docks and will not impact navigation within the subject waterway.

d. Whether the proposed dock facility protrudes no more than 25 percent of the width of the
waterway, and whether a minimum of 50 percent of the waterway width between dock
facilities on either side is maintained for navigability. (The facility should maintain the
required percentages.)
The testimony and evidence presented at the hearing satisfies this criterion. The dock
facility is proposed to protrude 28 feet into a waterway that is approximately 830 feet wide
which is approximately 3.37% of the width of said waterway.
Secondary Criteria:
e. Whether there are special conditions not involving water depth, related to the subject
property or waterway, which justify the proposed dimensions and location of the proposed
dock facility. (There must be at least one special condition related to the property; these
may include type of shoreline reinforcement, shoreline configuration, mangrove growth,
or seagrass beds.)
The testimony and evidence presented at the hearing satisfies this criterion. The BCC
Resolution 88-11 approved a 15 foot protrusion in excess of the allowable 20 foot
protrusion for a total protrusion of 35 feet. However, that permitted dock facility is not
compliant with state DEP aquatic preserve rules, requiring the new dock facility to have
less decking and less protrusion into the waterway.
f. Whether the proposed dock facility would allow reasonable, safe access to the vessel for
loading/unloading and routine maintenance, without the use of excessive deck area not
directly related to these functions. (The facility should not use excessive deck area).
The testimony and evidence presented at the hearing satisfies this criterion. The proposed
boat dock facility is only 4-feet in width which the applicant contends is sufficient to comply
with state regulations and provides sufficient area to allow for safe access to the vessel
and personal watercraft.
g. For single-family dock facilities, whether the length of the vessel, or vessels in
combination, described by the petitioner, exceeds 50 percent of the subject property's
linear waterfront footage. (The applicable maximum percentage should be maintained.)
The testimony and evidence presented at the hearing satisfies this criterion. As depicted
within the Map of Specific Purpose Survey that is contained within Attachment A the
subject property has 125 feet of waterfront. The proposed boat dock facility plans, and
application demonstrate the boat dock facility will be used to dock a 30 foot vessel (LOA)
and two personal watercrafts each measuring 12 feet long. The vessels in combination will
measure 54 feet in length which equates to 43.2% of the available waterfront footage.
h. Whether the proposed facility would have a major impact on the waterfront view of
neighboring property owners. (The facility should not have a major impact on the view of
a neighboring property owner.)

The testimony and evidence presented at the hearing satisfies this criterion. The proposed
boat dock facility satisfies LDC setback requirements from the riparian lines. There is an
existing dock with one boatlift on -site. As proposed the new dock will impact views less
than the existing adjacent docking facilities as the proposed dock has less protrusion and
the overall area of over -water structure than the other docks. Therefore, no new impacts
to neighboring property views of the waterway will result from the proposed project.
i. Whether seagrass beds will be impacted by the proposed dock facility. (If seagrass beds
are present, compliance with subsection 5.03.06.J of the LDC must be demonstrated.)
The testimony and evidence presented at the hearing satisfies this criterion. The submerged
resources survey reveals no seagrass beds are located within 200 feet of the proposed dock
facility, there will be no impact to seagrass bed.
j. Whether the proposed dock facility is subject to the manatee protection requirements of
subsection 5.03.06(E)(11) of this Code. (If applicable, compliance with section
5.03.06(E)(11) must be demonstrated.)
Criterion is not applicable. The provisions of the Collier County Manatee Protection Plan
do not apply to individual docks behind individual residences.
ANALYSIS.
Based on the findings above, on a review of the record including the Petition, application, exhibits,
the County's staff report, and hearing comments and testimony from the Petitioner and/or the
Petitioner's representative(s), County staff and any given by the public, the Hearing Examiner
finds that there is enough competent, substantial evidence as applied to the criteria set forth in
Section 5.03.06.H of the Land Development Code to approve Petition.
DECISION.
The Hearing Examiner hereby APPROVES Petition Number BDE-PL20200001959, filed by Jeff
Rogers of Turrell, Hall & Associates representing Alexander J. Senules, III and Tina M. Senules,
with respect to the property described as Lot 13 and the West'/2 of Griffis Highway between Lots
13 and 14, Isles of Capri No 1, as recorded in Plat Book 3, Page 41 of the Public Records of Collier
County, in Section 5, Township 52 South, Range 26 East. Collier County, Florida, for the
following:
• An 8-foot boat dock extension over the maximum 20 feet allowed by Section 5.03.06.E.1
of the Land Development Code for waterways greater than 100 feet in width for a total
protrusion of 28 feet into a waterway that is 830::L feet wide to accommodate a boat dock
facility with two boatlifts, one for a 30-foot vessel and the other for two personal
watercrafts.

Said changes are fully described in the Proposed Dock Plans and Site Survey attached as Exhibit
"A" and are subject to the condition(s) set forth below.

CONDITIONS.
1. All other applicable state or federal permits must be obtained before commencement of the
development.
2. An ST permit must be sought and approved prior to the issuance of any permits to construct
the subject dock facility, in accord with the following documents contained within
Attachment A: Proposed Dock Dimensions—Sheet 03 of 09.

undertakes actions that result in a violation of state or federal law.
