RESOLUTION NO. 2021 - 71
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, ACCEPTING FOR OWNERSHIP AND
ALL FUTURE MAINTENANCE AND REPAIR OF THE STRUCTURAL
ELEMENTS OF THE BRIDGE LOCATED ON THE EAST SIDE OF THE
RATTLESNAKE HAMMOCK ROAD AND COLLIER BOULEVARD
INTERSECTION OVER HENDERSON CREEK FOR THE PERPETUAL
USE BY THE PUBLIC IN GENERAL.
WHEREAS, in conjunction with the development of the Hacienda Lakes Community
Development District ("District"), the District funded the construction of a bridge on Rattlesnake
Hammock Road located on the east side of the intersection of Rattlesnake Hammock Road and
Collier Boulevard at the entrance of the Hacienda Lakes development ("Bridge"); and
WHEREAS,the District has requested that the County accept ownership and maintenance
of the structural components of the Bridge; and
WHEREAS, Collier County owns the right-of-way upon which the Bridge is located; and
WHEREAS,County staff has inspected the Bridge and determined it to be in overall good
condition with no major defects; and
WHEREAS, the Board of County ;Commissioners finds that the provisions of Resolution
No. 2019-76 regarding County assumption of ownership of a privately-owned bridge have been
complied with; and
WHEREAS, the District has entered into an Interlocal Agreement with the County to
maintain certain non-standard decorative finishes specific to the Bridge, and certain associated
landscaping; and
WHEREAS, the Board finds it in the best interest of the residents of Collier County for
the County to assume ownership and maintenance responsibilities of the Bridge.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that Collier County hereby accepts
and assumes ownership and all future maintenance, replacement and repair obligations of the
structural elements of the Bridge, to be held for the perpetual use by the public in general.
THIS RESOLUTION is adopted after motion, second and majority vote favoring
adoption this 13 day of QEpri L , 2021.
