EXECUTIVE SUMMARY
Recommendation to approve the attached Amendments of Conservation Easements that were
deeded by Naples Botanical Garden (NBG) to the South Florida Water Management District
(SFWMD) and Collier County (County), and by NBG to SFWMD.
OBJECTIVE: To approve the attached Amendments of Conservation Easements which provide for the
removal of stormwater management lands that are in a conservation easement area on the NBG property
and for other lands on the NBG property to be designated and added as conservation to replace the lands
that are being removed from conservation.
CONSIDERATIONS: The conservation easements that are proposed to be amended are on NBG lands
where the County intends to install a stormwater management system to disperse, control, and improve
the quality of stormwater run-off associated with boat trailer parking and pedestrian pathways to be
constructed by the County along Hamilton Avenue. The additional parking on Hamilton Avenue is being
provided to support overflow parking from the Bayview Boat Ramp. An agreement with NBG for the
stormwater management area was approved in absentia by the County Manager on August 25, 2020 and
ratified by the Board of County Commissioners on September 8, 2020 under agenda item 16.F.1.e. The
County’s engineering consultant had advised that SFWMD would allow stormwater management in the
conservation area. However, SFWMD has reversed their position and to comply with SFWMD
requirements, the conservation easements are amended as described.
The documents are SFWMD standard form amendments and have been reviewed and approved by
SFWMD, Naples Botanical Garden, and the County Attorney’s Office. A location map showing where
conservation lands are being removed and added is attached.
FISCAL IMPACT: Other than recording fees, there is no fiscal impact to amend the conservation
easements. Recording fees will be $394.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the current Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners:
1. Approve the attached Amendments to the Deeds of Conservation Easements.
2. Authorize the Chairman to execute the Amendments of Conservation Easement.
3. Direct the County Manager or his designee to follow all appropriate procedures, and to record
the Amendments to Conservation Easement in the Public records of Collier County, Florida.

WITIYESSETH:
WIIEREAS' Grantor granted in favor of the District and County that certain Deed of
conservation Easemenr dated February 18,2005 and recorded May 1g, 2b05 in official Record
Book 3801 at Page 2423 ofthe Public Records of Collier County, Florida (hereinafter refened toas the "conservation Easement") encumbering the real property described on Exhibit ..A,'
attached hereto and made a part hereof (hereinafter refened to as the ,,original premises,,); and
WHEREAS, crrantor hereby grants to the District and county a perpetual conservation
easement as defrned in Section 704.06, Florida statutes, over the property discribed on Exhibit"B" attached hereto and made a part hereof (hereinafter referred to as "Additional premises,).
The Grantor is the fee simple owner of the lands described on Exhibit..B,'; and
WIIEREAS, the Conservation Easement over the Additionat Premises described inExhibit'B" shall be subject to all the provisions and restrictions of the Conservation Easement
recorded in official Record Book 3801 at page 2423 of the public Records of collier county,
Florida; and
WHEREAS' Glantor requests the District and County amend the Conservation Easement

WIIEREAS' the District and County are amenable to release the Conservation Easement

Now, TITEREFORE, for good and valuable consideration, consisting of the addition
by crantor of certain propety to the Conservation Easement and relinquishmenl by District andcounty of certain property formerly encumbered by the conservation Easement (as morespecifically described in this Amendment to conservation Easement) the adequacy and receipt of

which are hereby acknowledged, the District and County hereby amend the Conservation
Easement to discharge, terminate and release the Conservation Easement with respect to only the
Release Parcel, without impairing the operation and effect of the Conservation Easement as to
the remainder of the original premises which are not contained within the Release Parcel, (the
original Premises less and except the Release Parcel is hereinafter referred to as the "Remainder
Premises"). The District and County are also agreeable to accept a conservation easement over
the Additional Premises shown on Exhibit "8". The Conservation Easement shall remain in full
force and effect with respect to the Remainder Premises and shall remain unaffected by this
Amendment of Conservation Easement. Al[ references in the Conservation Easement to
"Propeny" shall hereafter mean and refer to the Remainder Premises and Additional Premises.

an address of330l Gun Club Road, West Palm Beach, Florida 33406.
WITNESSETII:
WIIEREAS, Grantor granted in favor of the District that certain Deed of Conservation
Easement dated May 15, 2008 and recorded in Official Record Book 4360 at Page 3031 of the
Public Records of Collier County, Florida (hereinafter refened to as the "Conservation
Easement") encumbering the real property described on Exhibit "A" attached hereto and made a
part hereof (hereinafter referred to as the "Original Premises"); and
WIIEREAS, Grantor hereby grants to the District a perpetual conseryation easement as
defined in Section 704.06, Florida Statutes, over the property described on Exhibit.,B', attached
hereto and made a part hereof (hereinafter refened to as "Additional Premises'). The Grantor is
the fee simple owner ofthe lands described on Exhibit "B"; and
WHEREAS, the Conservation Easement over the Additional Premises described in
Exhibit "B" shall be subject to all the provisions and restrictions of the Conservation Easement
recorded in ofhcial Record Book 4360 at Page 3031 of the Public Records of collier county,
Florida; and
\MHEREAS, Grantor requests the District amend the Conservation Easement to release
the Conservation Easement with respect to only that portion of the Original Premises described
on Exhibit "C" attached hereto and made a part hereof (hereinafter reierred to as the "Release
Parcel"); and
WHEREAS, the District is amenable to release the Conservation Easement only with
respect to the Release Parcel.
NOW, THEREFORE, for good and valuable consideration, consisting of the addition
by Grantor of certain property to t}re Conservation Easement and relinquishment by District of
certain property formerly encumbered by the Conservation Easement (as more specifically
described in this Amendment to Conservation Easement) the adequacy and receipt of which are
hereby acknowledged, the District hereby amends the Conservation Easement to discharge,

terminate and release the Conservation Easement with respect to only the Release Parcel, without
impairing the operation and effect of the Conservation Easement as to the remainder of the
original premises which are not contained within the Release Parcel, (the original Premises less
and except the Release Parcel is hereinafter refened to as the "Remainder Premises"). The
District is also agreeable to accept a conservation easement over the Additional Premises shown
on Exhibit "B". The Conservation Easement shall remain in full force and effect with respect to
the Remainder Premises and shall remain unaffected by this Amendment of Conservation
Easement. All references in the Conservation Easement to "Property" shall hereafter mean and
refer to the Remainder Premises and Additional Premises.
