EXECUTIVE SUMMARY
Recommendation to approve the on-street parking along Hamilton Avenue consistent with Right-
of-Way (ROW) Permit PRROW20200728212 to create a designated parking area within the ROW
on a specific segment of Hamilton Avenue from Thomasson Drive to Bay Street. (This is a
companion item to Agenda Item 16C1. All items must be either approved or denied together on
today’s agenda.)
OBJECTIVE: That the Board of County Commissioners, for the purpose of enhancing public safety,
approve the on-street parking along Hamilton Avenue consistent with ROW permit
PRROW20200728212, to create a designated parallel parking area within the ROW on Hamilton Avenue
from Thomasson Drive to Bay Street.
CONSIDERATIONS: The roadway shoulder along the eastern side of Hamilton Avenue has
historically been used as an unimproved parking area for vehicles and boat trailers for the public using the
boat ramp access at Bayview Park on Danford Street. This unofficial unpaved parking area is in the
County’s ROW adjacent to Hamilton Avenue a narrow roadway with limited pedestrian interconnectivity
to Bayview Park, impacting traffic and pedestrian flow. Collier County Parks and Recreation is
proposing a project to create parallel parking and a shared use access pathway along the eastern portion of
Hamilton Avenue from Thomasson Drive south to Bay Street to improve the parking area and pedestrian
connectivity to Bayview Park. The project has been reviewed for compliance with FDOT, Collier County
ROW and LDC provisions.
GROWTH MANAGEMENT PLAN (GMP) IMPACT: There is no Growth Management Impact
associated with this Executive Summary.
FISCAL IMPACT: All costs are to be borne by the Permit Applicant.
LEGAL CONSIDERATIONS: This item is approved for form and legality. A majority vote is needed
for Board approval. - HFAC
STAFF RECOMMENDATION: That the Board of County Commissioners approve the issuance of the
attached Right-of-Way Permit.

1. Work shall be performed in accordance with approved plan,
Conditions of Permit appearing on reverse side, stipulations
specified as part of this permit and in accordance with Collier
County Ordinance #09-19 and the "Public Right-of-Way
Construction Standards Handbook," latest edition.
2.Applicant declares that prior to filing this application he has
ascertained the location of all existing utilities,both aerial and
underground. Any changes to any utility shall be the responsibility
of the Permittee for all cost.
3.This permit is contingent upon Permittee obtaining necessary
rights of entry for construction and maintenance where required
right-of-way for public use has not been dedicated and accepted by
Collier County.
4. If the application is made by any person or firm other than the owner of
the property involved, a written consent from the property owner shall
be required prior to processing of the application.
5. Growth Management Division approval does not exempt the permittee
from gaining approval from any State, Federal or Local Agencies having
jurisdiction over the proposed work.
6. I have read the Collier County Right-of-Way Permit Notes and
Conditions and agree to conduct all work in accordance with the County
Ordinance #09-19, as amended and all applicable all County and State,
codes and laws, as amended. Under penalties of perjury, I declare that
I have read the forgoing permit application and that facts stated in it are
