Adjournment 21.A.2 Packet Pg. 551 Attachment: Haldeman Creek Agenda Packet 3-8-2021 (15414 : Haldeman Creek MSTU Advisory Committee -March 8, 2021) February 01, 2021 meeting minutes Item 4a HALDEMAN CREEK MSTU MINUTES OF THE FEBRUARY 01, 2021 MEETING The meeting of the Haldeman Creek MSTU Advisory Committee was called to order by Roy Wilson at 3:30 p.m. at 3299 Tamiami Trail E, 3rd Floor BCC Chambers, Naples, FL 34112. I. Roll Call: Advisory Board Members Present: Chair, Roy Wilson, Kate Samblanet, and Jim King. Jacob Dutry van Haeften was approved to attend virtually. MSTU Staff Present: Debrah Forester, CRA Director, Ellen Summers, Principal Redevelopment Specialist, Tami Scott, Project Manager and Shirley Garcia, Operations Coordinator II. Pledge of Allegiance- Was led by Roy Wilson III. Adoption of Agenda: Ms. Forester added under 6a. Markers Survey and under 7c. Vegetation Ordinance. Jim King made a motion to approve the agenda as amended, Kate Riley second. Approved unanimously. IV. Adoption of Minutes: Jim King made a motion to approve the minutes, Kate Riley second, approved unanimously. V. Community / Business – Presentations VI. Old Business: a. Markers Survey- Roy Wilson presented his findings from his tour of the Creek to determine conditions of the markers and signage. He noted the following: Marker 5 is missing but its located within the City of Naples Boundary, Marker 8 has no reflector, Marker 10 reflector is deteriorating, there is a safety issue at Marker 10 due to overgrown mangroves into the navigable waterway it is a corner site line issue, Marker 11 reflector and sign is deteriorating, speed zone sign is located way off of the channel cannot be viewed by boaters and it has an authorization that refers to a Collier County Code on it, Marker 15 is the buoy and not sure if it is reflective at night if and no number on it, if it is not visible at night that could be a safety issue. Staff may need to get a cost estimate on 11(if it is not City of Naples) and 15 to make it reflective and put a number on it. On all the marker poles there will be a need to have them all wrapped if and when someone comes out might as well take care of the marker poles and signs at the same time. Roy Wilson made a motion for staff to get a cost estimate to rewrap the channel markers with reflective tape and replace marker 11, and a final solution to channel marker 15 since it is just a temporary buoy. Kate Samblanet second the motion. Passed unanimously. Ms. Forester suggested we reach out to the City of Naples to attend the next 21.A.2 Packet Pg. 552 Attachment: Haldeman Creek Agenda Packet 3-8-2021 (15414 : Haldeman Creek MSTU Advisory Committee -March 8, 2021) meeting to address the items including City of Naples boundary and maintenance schedule. VII. New Business: a. Haldeman Creek MSTU Advisory Committee appointments- Kate Samblanet – Jim King made a motion to reappoint Kate Samblanet, second by Jaap Dutry van Haeften Passed unanimously. b. Haldeman Creek MSTU Advisory Committee application- William Robbins- Mr. Robbins attended the meeting and gave a brief history about himself and some discussions and questions from the Committee, Jim King made a motion to appoint Bill Robbins to the advisory committee, second by Kate Riley. Passed unanimously. c. Vegetation Ordinance- Roy Wilson provided a brief history about the vegetation ordinance that the Committee was trying to get passed back in 2013 and provided a draft copy for discussion to try and get this back into the County Attorneys’ office to start the process. Ms. Forester recommended that this ordinance be only within the Haldeman Creek boundary and not a county-wide ordinance so that this might be easier to pass. Roy Wilson made a motion for staff to go through the county process to adopt the vegetation in waterways ordinance just for the Haldeman Creek MSTU boundary so it will be easier to pass through the BCC. Kate Samblanet second the motion. Passed unanimously. VIII. Staff Report: a. CRA Directors Report- Ms. Forester provided the report and highlighted some of the projects The CRA closed on the Del’s property and will be demolishing the store portion and the warehouse, in the coming weeks. b. Project Manager Report- Tami Scott highlighted a couple of projects. • Thomasson Drive project is 60% complete, the roundabout should start soon. • Fire Suppression III in the Sabal Shores Neighborhood which includes Coco, Areca, Basin, Captains Cove and Canal Street has started on Areca and Basin and is about a 180-day project. • CRA Parking lot started construction and is also a 180-day project. The hole in the ground is for their stormwater requirements. • Staff is doing some beautification projects on Haldeman Creek Bridge to dress the area up and make it look nice. c. Private Development Update- Ms. Summers highlighted some development projects. • Naples Marina is requesting 2 rezones and a variance request. After some discussion from the Committee Ms. Summers let them know she will keep everyone posted and informed if a formal application gets submitted and what is submitted. Roy Wilson asked about the Bayshore Wine Venue if the Hearing Examiner would have the meeting held via zoom or not for the public to attend. d. Maintenance Report – Maintenance report was provided if anyone has any questions. e. Financials- The financial report was provided. IX. Correspondence and Communications: a. Meeting Summary New Member Orientation- Summary of new member orientation was attached so the committee was aware of the topics of discussion. X. Code information guide Brochure- Ms. Forester attached the updated brochure regarding code regulations for their information. XI. Public Comments: - Bill Robbins asked if the owner of the Naples Marina was doing some dredging off of the residential lot he just bought and if he needed a permit for that or not. After some discussion, no consensus was reached on the requirements. Becki Daniels had a question about Sara Bay Marina whether or not the new owners plan on building the approved SDP that was planned for a 50-foot building for boat storage or are there new plans for a new building? Ellen Summers said there was no new information and nothing new was submitted, Ms Forester said the staff would check to see if that SDP was ever approved and what the status was. Ms. Summers provided her email in the chat box. Michael Adriaanse wanted to know exactly who the CRA public parking lot was servicing and didn’t think it needs to be a parking lot. Ms. Scott provided the background information on why the CRA bought the land to create a public parking lot as well as the description of the design plans for the lot. Ms. Forester mentioned the parking study that was done and the need to provide additional parking, the surface lot was preferred to on-street parking. XII. Staff Comments: None XIII. WHEREAS, on May 9, 2006,the Board of County Commissioners was informed that upon the completion of the Haldeman Creek Dredging project that an involuntary Municipal Service Taxing Unit would be formed with an initial millage to be established not to exceed 3 mils to address any future dredging needs ;and WHEREAS,the Board of County Commissioners, h as determined that the creation of a municipal service taxing unit is the best method for implementing and funding future dredging requirements of the public waterway areas located therein . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that : SECTION ONE . Authority . This Ordinance is adopted pursuant to the provisions of Chapter 125 .01 and Chapter 200, Florida Statutes, and other applicable law . SECTION TWO .Creati on of the Municipal Service Taxing Unit. There is hereby created and established the Haldeman Creek Dredging Municipal Service Taxing Unit, hereinafter referred to as "MSTU." The boundaries of the 1VISTU are as follows : See attached Exhibit "A" which is incorporated herein by referenc&. .Z) SECTION THREE . Purpose and Governing Body . The MSTU is created for the purpose of providing maintenance dredging within the MSTU as determined by the Advisory Committee . The Maintenance Tasks shall include but not be limited to : A . Maintenance Dredging ; B . Maintenance of navigational channel markers ; Item 6a 21.A.2 Packet Pg. 556 Attachment: Haldeman Creek Agenda Packet 3-8-2021 (15414 : Haldeman Creek MSTU Advisory Committee -March 8, 2021) The governing body of the MSTU shall be the Board of County Commissioners of Collier County,Florida. SECTION FOUR.Funding and Levy of Taxes . For the purpose of implementing this Ordinance, the Board of County Commissioners shall annually, at the time required by general budgetary law, make an itemized estimate of the amount of money required to carry out the business of the MSTU for the next fiscal year, which shall be from October 1 to and including September 30 following. The estimate shall describe the purpose for which the moneys are required and the amount necessary to be raised by taxation within the MSTU . At the time and place for fixing the annual rate of taxation for County purposes, the Board shall fix and cause to be levied on all properties within the MSTU subject to taxation a millage rate not to exceed 3 mils per year . SECTION FIVE.Tax Assessment and Collection . Taxes herein provided for shall be as sessed and collected in the same manner and form as provided for the assessment and collection of general County taxes and subject to the same fees for as sessing and collecting as gener al County taxes . SECTION SIX .Creation of the Haldeman Creek Dredging Maintenance Advisory Committee, Appointment and Composition . A . There is hereby created and established the Haldeman Creek Dredging Maintenance Advisory Committee, hereinafter referred to as the "Committee ." B . The Committee shall consist of five (5) members which generally represent the area within the MSTU . Members of the Committee shall be appointed by and serve at the pleasure of the Board of County Commissioners . Said members shall be permanent residents within the MSTU and electors of Collier County . The Board of County Commissioners shall consider appointment of members from different parcels, subdivisions and/or the communities within the MSTU . C . Appointment of the members to the Committee shall be by resolution of the Board of County Commissioners, which resolution shall set forth the date of appointment and the term of office . D . Members of the Committee shall serve without compensation but shall be entitled to receive reimbursement for expenses reasonably incurred in the performance of their duties upon prior approval of the Board of County Commissioners . SECTION SEVEN.Terms of Office of the Advisory Committee . The initial terms of office of the Committee shall be as follows : A. Two (2) members shall be appointed for a term of two (2) years . B . Two (2) members shall be appointed for a term of three (3) years . C . One (1) Member shall be appointed for a term of four (4) years . 21.A.2 Packet Pg. 557 Attachment: Haldeman Creek Agenda Packet 3-8-2021 (15414 : Haldeman Creek MSTU Advisory Committee -March 8, 2021) Thereafter each appointment or reappointment shall be for a term of four (4) years . Appointments to fill any vacancies on the Committee shall be for the remainder of the unexpired term of office . SECTION EIGHT .Officers of the Advisory Committee, Quorum And Rules of Procedure . A. At its earliest opportunity, the membership of the Committee shall elect a chairman and vice chairman from among its members . Officer's terms shall be for one (1) year, with eligibility for re-election . B . The presence of three (3) or more members shall constitute a quorum of the Committee necessary to take action and transact business . C . The Committee shall, by majority vote of the entire membership, adopt rules of procedure for the transaction of business and shall keep a written record of the meetings, resolutions, reports and exhibits, findings and determinations . Copies of all Committee minutes, resolutions, reports, and exhibits shall be submitted to the Board of County Commissioners . D . Committee member attendance requirements, including failure to attend meetings and member removal from office are governed by Ordinance No . 2001-55, as it may be amended, or by its successor ordinance . SECTION NINE .Functions, Powers and Duties of the Advisory Committee. The functions, powers and duties of the Committee shall be as follows : A . To aid and assist the Board of County Commissioners in Carrying out the MSTU as set forth in this Ordinance . B . To prepare and recommend to the Board of County Commissioners an itemized budget of the amount of money required to carry out the business of the MSTU for the next fiscal year . In carrying out this responsibility, the Committee shall, no later than April 1st of each year, meet with the County Manager or his designee and outline to the County Manager or his designee those projects which the committee wishes to see accomplished during the next fiscal year. Based upon this information, the County Manager or his designee shall prepare a proposed budget for the MSTU, in accordance with standard County guidelines regarding preparation of budgets . This proposed budget shall then be reviewed by the Committee and upon approval by the Committee be transmitted through the County Manager or his designee to the Board of County Commissioners for adoption in accordance with procedures for the adoption of budgets set forth under general law and the Board of County Commissioners' policy . Should the Committee fail to approve the budget by June 1 st of each year, the County Manager or his designee shall be 21.A.2 Packet Pg. 558 Attachment: Haldeman Creek Agenda Packet 3-8-2021 (15414 : Haldeman Creek MSTU Advisory Committee -March 8, 2021) authorized to submit a proposed budget to the Board of County Commissioners . C . The Committee shall recommend work programs and priorities to the County Manager or his designee in accordance with the adopted budget or budget amendments which may be adopted by the Board of County Commissioners . The execution of work programs shall be under the direct supervision and responsibility of the County Manager or his designee . Said work may be preformed under contract (in accordance with law) or by County forces . D . The Committee may adopt and amend "Guidelines" to govern its operation and the operation of the MSTU, subject to approval by the Board of County Commissioners . SECTION TEN.Duties of the County Manager or his Designee . The duties of the County Manager or his designee shall be : A . To administer the activities of the MSTU in accordance with established policies of the Board of County Commissioners and guidelines adopted by the Committee . B . To prepare the annual budget in accordance with Section Nine, Paragraph B . above . C . To provide periodic written reports to the Committee, and the Board of County Commissioners of the activities of the MSTU and its fmances in accordance with established guidelines of the Board of County Commissioners and/or the Committee . D . Attend all Committee meetings . SECTION ELEVEN .Review Process . This Advisory Committee shall be reviewed once ever four (4) years commencing 2006, in accordance with the procedures contained in Collier County Ordinance No . 2001-55, as it may be amended, or its successor Ordinances . SECTION TWELVE .Conflict and Severability. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply . He believes that markers 5,6,7, 8 are within the City. RESPONSE- I believe that is correct from at least a historical point of view. If you reference the current US Coast Guard light list, I can’t seem to locate any markers up or near Haldeman Creek other that the four under Royal harbor. (Katie if you have additional info let us know) Marker 5 looks like it needs a new sign and should have 2 reflective bans. Marker 8 needs the two bans. Can you contact the City of Naples to see if they would correct them? RESPONSE- Katie Laakkonen is the city contact. We are not sure about Marker 11 if that falls within the City – that sign needs to be replaced. Can you confirm if it is within the County or is it in the city? RESPONSE- I believe that is in the County so we would correct that marker. Marker 10 reflector is deteriorating, there is a safety issue at marker 10 due to overgrown mangroves into the navigable waterway it is a corner site line issue – can the mangroves be trimmed and replace the reflective bans?, RESPONSE- Yes a mangrove trimming permit from FDEP can be obtained to trim back the mangrove branches. Trimming must be done by a certified arborist. Marker 15 is the buoy and not sure if it is reflective at night. Can it have signage and assure it is reflective? RESPONSE-We installed can buoy 15 when the original wooden channel marker was knocked out from Hurricane Irma. We attempted to replace it with a new pole but limestone rock prevented us from getting it down far enough. The can buoy ordered meets the reflectivity criteria and should be visible at night when a light is pointed at it. RESPONSE-Historically, the County has maintained NAVIGATIONAL (not Manatee markers…that is FWC) markers from 11 and up and will continue to do so. The City has maintained the additional markers from 10 to 5 (Katie …if you believe it was handled differently let us know…most of my dealings were with Roger Jacobsen at the time). Also noted at the meeting was the speed zone sign is located way off of the channel cannot be viewed by boaters and it has an authorization that refers to a Collier County Code on it. I’m not sure if this can be corrected by your department or not. RESPONSE-That is an FWC marker so Kate Gorman would be your contact. The 91-007 is on most manatee signage throughout Collier County. Governor DeSantis signed an official proclamation recognizing March as Florida Bicycle Month. “Whether you bike to work or school, or for recreation, everyone has a right to arrive at their destination safely,” said Florida Department of Transportation Secretary Kevin J. Thibault, P.E. “While taking advantage of Florida’s unique scenery and landscape, the department encourages all bicyclists to always be aware of your surroundings, follow the rules of the road, and never ride distracted.” More people are cycling than ever before, especially in Florida’s beautiful weather. FDOT is committed to reducing crashes, fatalities, and serious injuries involving pedestrians and bicyclists. FDOT has adopted a target of zero traffic fatalities and serious injuries in the state.
