The Honorable Special Magistrate Brenda C. Garretson called the Hearing to order at 9:00 A.M.
All those testifying at the proceeding did so under oath.

The Pledge of Allegiance was recited.
Prior to conducting the Hearing, Respondents were given an opportunity to speak with their

Supervisor Ambach presented the case noting the violation has not been abated following
execution of a Stipulation.
Diana Estrada was present and testified:
• The property was her fathers and she inherited it.
• She was not able to remediate the violation as she has been off of work and her brother who
is helping has been working 60 hours a week.
• She is now back at work and requested more time to abate the violation.
Supervisor Ambach reported the property has been cleaned up and the lawn is being mowed. The
violation is not a Health, Safety and Welfare issue and had no objection to the request.
Special Magistrate Garretson CONTINUED the case until June 4, 2021, noting the fines will
continue to accrue in the case.

• It came to her attention a fence was constructed across an easement on property owned
by the Trust.
• She contacted the County Zoning Office, who determined the placement of the fence was
a violation as it was built on a road with designated access to other lands.

• Language in the property deeds confirms the provision of a dedicated access for the area
in question.
Mr. Migliazzo testified:
• The Trust owns a large tract of land in the area which is used for cattle leases.
• The area is subject to constant tresspassing by individuals and illicit activity incuding
archery practice on cows, destrucion of property with firearms, illegal refuse dumping,
etc.
• The County also has property in the area where County monitoring wells are installed and
subject to vandalism.
• The gate was installed on the Trust’s property across the easement to prevent
unauthorized access to the lands in the vicinity and prevent the destruction of property
and other illegal activity.
• The lands beyond the gate are unimproved with no road constructed for vehicle access.
Any landowner may contact him for access through the gate if they so desire.
• The issue about the gate arose when a real estate agent complained about the obstruction
blocking access to a property he had listed for sale. The Trust has now agreed to
purchase the property.
• He would like to meet with County agencies who have an interest in the lands in the area
to develop a solution to the issues.
Manager Letournea noted the investigation was initiated due to a complaint and the gate blocks
legal access to properties not owned or controlled by the Trust. He agreed a viable solution
should be sought, as it is the best interest of all property owners in the area as well as the County.
The violation exists but recommned a reasonable amount of time be allowed to determine if there
is a solution for all parties involved.
Special Magistrate found the Respondent GUILTYof the alleged violation and ordered to:
1. Pay the Operational Costs of $111.65 incurred during the prosecution of the case by April
5, 2021.
2. Obtain all required Collier County Building Permit(s) or Demolition Permit, inspections,
