Impact Fees…
Provide funding for growth–related capital infrastructure
Development is required to contribute its fair share of the costs of providing
needed public facilities
Impact Fees may not be collected in excess of the amount reasonably
anticipated to fund improvements and the amount attributable to the new development
Impact Fees are not used to fund maintenance or operations.

Impact Fee Rate Schedules – Land Uses
Institute of Transportation Engineers (ITE) Trip Generation Manual contains
data on more than 176 land uses
Collier County’s Road Impact Fee Rate Schedule contains 57+ of the most
common land uses
Correctional Facilities, EMS, Government Buildings and Law
Enforcement Impact Fee Rate Schedules mirror the Road Rate Schedule
and utilize some data from ITE in the individual methodologies
For uses not contemplated under the adopted rate schedules there are options
within the Code provisions to assist with proper assessment of impact fees.

Individual Calculations

Section 74-202(k) of the Collier County Code of Laws and Ordinances provides:
In the event a development involves a land use not contemplated under the impact fee land use categories set forth in the rate schedules in appendix A, the county manager shall calculate
the appropriate impact fees utilizing the methodologies contained in the impact fees adopted by section 74-106. The county manager shall utilize as standards in has determination the
impact fee rate calculation variables applicable to the most similar land use categories in the applicable impact fee rate schedules.
This option can be utilized for land uses that are included in ITE but do not appear on the adopted impact fees schedules.

Alternative Fee Calculations

Section 74-204 of the Collier County Code of Laws and Ordinances provides guidelines for an applicant to conduct and submit and alternative fee calculation. This process is often used
when:
The applicant believes that the nature, timing or location of the proposed development makes it likely to generate impacts costing less than the amount impact fees generated by application
of section 74-201 and the impact fee rate calculations in 74-302 through 74-309, for the public facilities at issue…
Different than the Individual Calculation, this option is often utilized for land uses that are not included in ITE, do not appear on the adopted impact fee schedules, and/or have characteristics
that make the land use substantially different as to demand created, etc.

Proposed ULINE Regional Facility
940,000+/- square feet located in close proximity to I-75
Data from another ULINE Regional facility and a separate ITE
study support adjustments for interstate truck travel, relieving demand on
County roads
ULINE requested a review of the land use/ impact fee calculations
Due to the size and characteristics of the proposed development,
land uses/rates on the adopted impact fee schedules do not correlate
as closely to demand created and likely would result in an overcharge.

ULINE Regional Facility – Individual Calculation
Utilizes data from ITE for land use and truck travel analysis
Calculated and recommended by Collier County’s Impact Fee Consultant,
consistent with adopted impact fee methodology and Code provisions
Provides rates that are equitable and reasonably attributable to the
demand to be created by the new facility
Rates are appropriate for use on other regional distribution facilities
of similar size, located near an interstate.
