EXECUTIVE SUMMARY
Recommendation to approve the document necessary to convey an easement to Florida Power &
Light Company over property owned by Collier County at the proposed Heritage Bay Government
Center site.
OBJECTIVE: To convey an easement for installation of electric infrastructure on Collier County
property required to power proposed facilities within the proposed Heritage Bay Government Center site.
The public purpose is to bring infrastructure into compliance with current County standards while
meeting demand, improving reliability, protecting public safety and providing environmental protection.
CONSIDERATIONS: The Heritage Bay Government Center will consist of construction of a new
23,000 square foot government services facility to provide services of the Collier County Government,
Tax Collector, Property Appraiser, Clerk of Courts and Supervisor of Elections. The Heritage Bay
Government Center will be modeled after the North Collier Government Services Center location on
Orange Blossom Trail.
On November 12, 2019, under Agenda Item 16C1, the Board of County Commissioners (Board)
approved the selection committee’s ranking selection for RPS No. 19-7634 for the design, permitting and
construction of the proposed Heritage Bay Government Center.
The proposed project includes the installation of a new electric line and transformer to provide power to
the proposed facilities. An easement to Florida Power & Light Company (FP&L), for the installation of
electric lines and fiber, including, but not limited to, conduit, poles, and transformer box is required. The
easement area measures approximately 4,453.39 square feet (approximately 0.10 acres) and is shown and
described on Exhibit “A” to the Easement. The County will not be compensated because the easement is
a requirement for FP&L to provide the electrical facilities necessary for the operation of proposed
facilities for the Heritage Bay Government Center.
FISCAL IMPACT: The Government Service Center is funded by the Collier County Tax Collector’s
Office and the related contract for that portion of the work has been negotiated separately between the
Tax Collector and the contractor. The total cost for recording and obtaining copies of the FPL easement
document will not exceed $50.00, which is available in Facilities General Fund, Fund 301, Project No.
52525.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote. - JAB
RECOMMENDATION: To approve the Easement, authorize the Chairman to execute the Easement,
and direct the County Manager or his designee to follow all appropriate closing procedures and record the
Easement in the Public Records of Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to Florida Power & Light Company, its affiliates, licensees, agents, successors, and assigns ("FPL"), a non-exclusive easement forever for the construction, operation and maintenance of underground electric utility facilities (including cables, conduits, appurtenant equipment, and appurtenant above-ground equipment) to be installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the voltage as well as the size of, and remove such facilities or any of them within an easement described as follows:

Together with the right to permit FPL to attach or place wires to or within any facilities hereunder and lay cable and conduit within the Easement Area and to operate the same for FPL's communications purposes in connection with electric service; the right of ingress and egress to the Easement Area at all times; the right to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the Easement Area; the right to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the Easement Area, which might interfere with or fall upon the lines or systems of communications or power transmission or distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at all, the rights hereinabove granted on the Easement Area, over, along, under and across the roads, streets or highways adjoining or through said Easement Area.
