EXECUTIVE SUMMARY
Recommendation to conduct a public workshop on the proposed expansion of the Big Cypress
Basin in conjunction with impacted county and municipal leaders and representatives of the South
Florida Water Management District and Big Cypress Basin.
OBJECTIVE: To conduct a public workshop on the proposed expansion of the administrative
boundaries of the Big Cypress Basin with impacted county and municipal leaders and representatives of
Basin administration.
CONSIDERATIONS: On February 9, 2021, the Board of County Commissioners (Board) unanimously
adopted a formal position opposing the language of Senate Bill 406 and House Bill 209, and dispatched a
letter to the sponsors of the bills and to the Collier County Legislative Delegation stating that this
opposition would continue until technical deficiencies in the bill are addressed, issues of policy and
practical application of the initiative are better defined and discussed, and the public is informed and
educated on how this will impact water quantity and quality management in both Lee and Collier
counties.
At the February 23, 2021, meeting of the Board, a resolution was adopted maintaining this opposition
unless and until amendments proffered by the Board were incorporated in the Basin expansion legislation.
These amendments addressed Basin governance, uses of ad valorem, and provided for a delayed effective
date of the legislation to allow for administrative changes and, if necessary, any applicable rulemaking
thereby facilitating public input prior to enactment.
Since the adoption of the resolution, there has been individualized outreach to Board members from the
bills’ sponsors and from county and municipal leaders that would be added to the Basin. To facilitate an
open discussion by all impacted parties, a public workshop would be beneficial to address concerns and
identify opportunities provided by the legislation and would assist in public education on the proposal.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: This action will result in no growth management impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board conduct a public workshop on the proposed expansion of the
Big Cypress Basin in conjunction with impacted county and municipal leaders and representatives of the
South Florida Water Management District and Big Cypress Basin.
