Thank you for the time spent with the Regatta Condo. Association officers! As per your request, the minimum development conditions that can change Staff Findings from “not directly compatible”
to “compatible and complementary” are identified below. As a courtesy I am copying the other four elected officials, along with my clients.
Finally, please note that these are development performance standards and not overall ordinance conditions. For example, from a review of the proposed MPUD ordinance and other documents
I did not see a prohibition or restriction of constructing one massive tower on Tract MU One. This was a commitment made by the Applicant's attorney during the Planning and Zoning Commission
hearing in response to an Anthony Pires question and concern. That commitment was to tie the One Naples illustration plan (the plan with the footprints and the basis for the landscape
architecture plans) into the regulatory structure and ordinance. So obviously, that will be required by the Applicant and Staff.
October 2020 Original Staff Minimal Recommended Conditions w./No Optional 15-ft Setback
1. Maximum building height for all Tracts is 76 feet zoned, except that Tract 1 can be increased to ±125 feet zoned height if step back architecture is used for the upper floors of
buildings.
2. Minimum Building setbacks for all Tracts is 25 feet. (no optional 15-ft setback)

3. Mimum 25% Open Space as per code definition and to include common open space (no rooftop open space).
4. Limited access for Vanderbilt Beach Road Project gateway; i.e., right-in/right-out.
