EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement (Agreement) for Lot 8, Santorini Villas
at Olde Cypress, according to the plat thereof as recorded at Plat Book 34, Page 47 of the public
records of Collier County.
_____________________________________________________________________________________
OBJECTIVE: To approve an Easement Use Agreement between the County and the current property
owners of Lot 8, Santorini Villas at Olde Cypress, in order to allow a brick paver step, a conc rete pool
equipment pad and concrete AC pad to encroach into the 7.5-foot wide drainage easement, more
specifically shown on Exhibit “A”.
CONSIDERATIONS: The property is located at 3099 Santorini Court. There is an existing brick paver
step (encroaching 1.1-Feet), a concrete pool equipment pad (encroaching 2.5-Feet), and a concrete AC
pad (encroaching 1.3-Feet), that have been constructed and installed on the Subject Property, resulting in
previously mentioned encroachments into the 7.5-foot wide Drainage Easement along the east side of the
Subject Property. The current owners purchased the property in 2015 with this encroachment already in
place. According to the plat of Santorini Villas at Olde Cypress (Plat Book 34, Pages 47-48), the subject
easement is dedicated to the Santorini Villas Home Owners Association, Inc., with responsibility for
maintenance and to Collier County with no responsibility for maintenance.
Development Review and the Collier County Stormwater Program has reviewed the Agreement and
Exhibits and recommends approval of the Easement Use Agreement.
FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the
recording fees of this Agreement.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. DDP
RECOMMENDATIONS: Approve the Easement Use Agreement between the County and current
property owners of Lot 8, Santorini Villas at Olde Cypress, and authorize the Chairman to execute the
Agreement and direct the Clerk to record the Easement Use Agreement into the public records of Collier
County, Florida.

The subject residence is localed in the Santorini Villas section of Olde Cypress. Olde Cypress is
a residential PUD with multiple housing types, a golf course. and related amenities. In 2000, the
Santorini Villas community was subdivided per the Plat of Santorini Villas at Olde Cypress (the
"Plat"). See Exhihil A.
The residence is located on Lot 8 of the Plat. Nearly all lots as platted are approximately 40 feet
wide. but Lot 8 is unique to other lots in this subdivision in that it is burdened by a drainage
easement across 7.5 feet ofthe side yard. The peculiar situation creates a constraint on buildable
area fbr this property. The regulatory setback from the side property line is otherwise 0 feet.
A Certificate of Occupancy for the residence was issued in 2004. The residence was approved
uith minor encroachments by concrete equipment pads into the aforementioned side yard
easement. A current survey is enclosed fbr reference. See Exhibit B.
The concrete pads have existed in the same location without complaint or objection for nearly I 6
years. The purpose ofthe application is to allow the minor encroachments to continue to exist in
their current location. subject to the terms and conditions of the County's promulgated Easement
Use Agreement.
