Agenda 02/09/2021 Item #16A11 (Acquisition (4) Parcels - Project 60215)02/09/2021 EXECUTIVE SUMMARY Recommendation to approve an agreement for the acquisition of three fee simple right-of-way parcels (Parcels 101FEE1, 101FEE2 and 101FEE3) and a temporary driveway restoration easement (Parcel 101TDRE) required for the construction of roadway and related improvements to Triangle Boulevard and Price Street. (Triangle Boulevard Project No. 60215.) OBJECTIVE: To acquire the right-of-way needed for construction of the Triangle Boulevard Project (the “Project”). CONSIDERATIONS: Collier County is seeking to acquire three fee simple right-of-way parcels and a temporary driveway restoration easement, needed for construction of the Project. All four parcels are located on the north side of Price Street at the entrance to an improved parent tract owned by Price and 41, LLC (the “Owner”). These parcels are of various shapes and sizes and have a combined estimated value of approximately $25,000 (based upon a pro-rata share of the underlying parent tract value). Please refer in this regard to the attached Valuation Memorandum, dated December 30, 2020 prepared by Harry Henderson, SRA, Review Appraiser, Transportation Engineering Division. The Owner is obliged pursuant to Section 3.C of Exhibit F to the Price Street and 41 CPUD Ordinance No. 16-43 to pay its fair share of the cost of access improvements to be constructed as part of the Project, less the value of the above-referenced four parcels. On November 6, 2018, subsequent to the adoption of Ordinance 16-43, the Collier County and Municipal Infrastructure One-Cent Sales Surtax was passed by the voters. The anticipated contribution from the Sales Surtax was $6M. County staff has received bids that are significantly less than the amount allocated. Therefore, the cost of the Project can be accommodated with the Sales Surtax funding. The attached agreement is the culmination of lengthy negotiations with the Owner and provides, inter alia for: 1) the conveyance of all four parcels to the County; 2) the relocation of two street lights situated in the new right-of-way onto Owner’s property; 3) the satisfaction of all of the Owner’s obligations under the aforementioned Section 3.C; and 4) the surrender and delivery to the Owner of the original standby letter of credit issued for the amount of $33,500 to secure such obligations upon recordation of the conveyance documents in the public records. If these parcels are not acquired by negotiation, they will have to be taken through condemnation. Significant cost and risk factors accrue to the County in any condemnation action, including damage claim exposure. These costs would assuredly far exceed the net cost to the County if the attached agreement is approved. Staff accordingly recommends approval of the agreement. FISCAL IMPACT: Funds estimated not to exceed $200 will be required for recording fees. The primary funding source for this acquisition of right-of-way is impact fees. Should impact fees not be available gas taxes will be used. No maintenance costs are anticipated until such time as the Project is constructed. GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB. RECOMMENDATION: . Approve the attached agreement and authorize the Chairman to execute same on behalf of the Board; . PUD MONITORING One entity (hereinafter the Managing Entity) shall be responsible for PUD monitoring until close-out of the PUD, and this entity shall also be responsible for satisfying all PUD commitments until close-out of the PUD. At the time of this PUD approval, the Managing Entity is Price and 41, LLC. Should the Managing Entity desire to transfer the monitoring and commitments to a successor entity, then it must provide a copy of a legally binding document that needs to be approved for legal sufficiency by the County Attorney. After such approval, the Managing Entity will be released of its obligations upon written approval of the transfer by County staff, and the successor entity shall become the Managing Entity. As Owner and Developer sell off tracts, the Managing Entity shall provide written notice to County that includes an acknowledgement of the commitments required by the PUD by the new owner and the new owner's agreement to comply with the Commitments through the Managing Entity, but the Managing Entity shall not be relieved of its responsibility under this Section. When the PUD is closed-out, then the Managing Entity is no longer responsible for the monitoring and fulfillment of PUD commitments. 2. UTILITIES A. The developer shall connect to the Collier County Water Sewer District (CCWSD) potable water system at locations determined by CCWSD when capacity is available. B. The project shall connect to the CCWSD wastewater collection and conveyance system at locations determined by CCWSD when capacity is available. C. The project shall connect to the CCWSD Irrigation Quality water system at locations determined by CCWSD when capacity is available. 3. TRANSPORTATION A. The development shall be limited to a maximum of 468 two-way unadjusted PM Peak Hour Trips. B. An interconnection to the parcel to the east, currently a Fifth Third Bank parcel will be provided upon approval by the owner of said parcel. C. The owner, its successors or assigns, shall pay, for its fair share payment of the access improvements at the intersection of U.S. 41 and Price Street/Triangle Boulevard and improvements at Price Street/Waterford Drive/Project access as required by the pending Triangle Boulevard/41 Traffic Study by AIM Engineering (i.e. roundabout conceptual plan at Price Street/Waterford Drive/Project Access and US 41/Price Street Northbound/Westbound and Eastbound turn lane improvements). Prior to site development plan approval, the owner shall post a performance guarantee such as a bond or letter of credit in the amount of $33,500.00. The subject site contains approximately 1.83 acres of native vegetation, of which 15% (0.27 acres) is required to be preserved. The native vegetation preservation requirement will be satisfied off-site in accordance with Section 3.05.07.H.1.f of the Land Development Code. 5. PLANNING A. Amplified outdoor sound associated with the food store and fuel pump facilities is limited to 7 a.m. to 10 p.m. daily.
