Agenda 01/26/2021 Item #16E 5 (Final Settlement Agreement - Hurricane Irma)01/26/2021 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign a final Settlement Agreement between Collier County and Underwriters at Lloyd’s of London, et. al. to close all remaining open claims arising from Hurricane Irma in the amount of $1,477,306.38. OBJECTIVE: To close all remaining property insurance claims arising from Hurricane Irma. CONSIDERATIONS: Hurricane Irma made landfall in Collier County on September 10, 2017 causing significant damage to County owned property and operations. At that time, Collier County had in force a property insurance policy underwritten by Lloyd’s of London as the primary carrier and other secondary carriers (aka the Market) to respond to the event. The Risk Management Division, in coordination with affected Divisions, received and processed eight hundred twenty-nine (829) claim files involving thousands of estimates, invoices, reports, and other documents. The Division coordinated the processing of these files through the County’s adjusting company, Johns Eastern, and the Market. The deadline for all final claims submissions associated with Hurricane Irma ended at midnight, September 9, 2020. Currently, there are thirty-three (33) open claim files. In order to bring closure to the Hurricane Irma event from an insurance perspective, staff reviewed all outstanding invoices and submitted a final payment request to the Market totaling $1,477,306.38. The Market agreed to the payment request and submitted the attached Settlement Agreement to finalize the full release of all claims. Once approved by the Board, the Market will issue payment to the County and the Risk Management Division will issue remaining claims payments to the affected Divisions from Fund 516, Property and Casualty Insurance. This will close the remaining thirty-three (33) files. Finally, the insurance closure process will fulfill the County’s statutory obligations under the Stafford Act that includes the duty to procure and maintain property insurance coverage and to account for insurance proceeds applicable to damaged property. FISCAL IMPACT: The County will receive reinsurance recoveries in the amount of $1,477,306.38 to be credited to Fund 516, Property and Casualty Insurance. These proceeds will be used to issue final claims payments to the affected Divisions. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality and requires majority vote for Board action. -JAK RECOMMENDATION: To approve and authorize the Chairman to sign the attached Release to finalize all outstanding insurance claims arising from Hurricane Irma.
