HALDEMAN CREEK MSTU MINUTES OF THE JUNE 11, 2020 MEETING
The meeting of the Haldeman Creek MSTU Advisory Committee was called to order by
Chairman Jack Bonzelaar at 4:30 p.m. via Hybrid Remote Meeting with CRA staff
present at 3299 Tamiami Trail E, 5t' Floor Training Room, Naples, FL 34112.
I. Roll Call: Advisory Board Members Present: Chairman, Jack Bonzelaar,
Kate Riley, Roy Wilson, Jim King.
MSTU Staff Present: Debrah Forester, CRA Director, Ellen Summers, Principal
Redevelopment Specialist, Tami Scott, Senior Project Manager, and Shirley
Garcia, Operations Coordinator
II. Introduction of new Principal Redevelopment Specialist- Ms. Forester
introduced the new Principal Redevelopment Specialist, Ellen Summers, to the
team.
III. Adoption of Agenda: Jim King made a motion to approve the agenda, Kate Riley
second. Approved unanimously.
IV. Adoption of Minutes: Kate Riley made a motion to approve the minutes, Jim King
second, approved unanimously.
V. Community / Business — Presentations
VI. Old Business:
a. Speed and Signage on Haldeman Creek - Chris D'arco, Coastal Zone
Management attended to provide some statutory requirements for signage and speed
zones on Haldeman Creek. Mr. D'arco explained there are 2 reasons for speed
zones on the water: one is for safety for the boaters, and the other reason is to
protect some species like manatees. The creek is already a manatee zone and to
prevent duplication of effort they could get more restrictive on the waterway. There
are specific criteria under Florida Statutes to become more restrictive which
appeared to be the Committee's request. However, the Creek didn't meet the
criteria. If there is a specific area of concern, the Committee could request that the
Board of County Commissioners adopt an Ordinance and pursue a permit
application with Florida Fish and Wildlife Commission (FWC), the permit is issued
by FWC to create an idle speed zone. Roy Wilson asked if an ordinance that made
Haldeman Creek Idle speed zone back in 1997 was ever repealed because he
remembers that idle zone signs used to be posted in Haldeman Creek with the 1997
ordinance on the sign. Chris D'arco said there are multiple ordinances in the County
for speed on the waterways. Staff is reviewing and will be trying to combine all the

waterway ordinances regarding speed zones into one ordinance. If there was an
ordinance that included Haldeman Creek and there was never an approved FWC
permit and that might be the issue. Kate Riley mentioned that there is a sign on the
east side of Regatta Landings but there is no sign on the west side so folks do not
see the sign heading east, she wanted to ask if there could be an additional sign so
that it is clearly marked that it is slow speed.
Chris D'arco said it would be necessary to apply for a permit to add additional
signage. Roy Wilson asked if Chris could help the MSTU find the existing permit
for the sign so they could possibly amend it to add more signage. Mr. D'arco said
when he gets back into the office, he would double check to see if there are any on
the 3 existing permits for slow speed, but he doesn't remember seeing one for
Haldeman Creek. Mr. D'arco said that the State has hired contractors and they are
putting in new signs all around the County and he will ask them if Haldeman Creek
is slated for the new sign too. Mr. D'arco said he will email Kate Gorman at the
City of Naples as well to ask.
b. Mangrove St. Seawall Update — Amy Patterson, Director Capital Project Planning
attended to provide status of the failing seawall on the property at the end of
Mangrove St. next to Naples Land Yacht Harbor. Code Enforcement has put up a
fence for safety concerns and Ms. Patterson's staff has been working on a scope of
services for an engineering firm to replace the seawall and they are looking at the
area for any needed stormwater outfall. Ms. Patterson wanted to be clear that it
would not be adding any new water to the creek but to would provide a better way
to manage the water. Ms. Patterson understands the concerns the community has
about water quality and everything they do will include better quality water. They
are also considering the site for a potential launch/staging area for debris removal in
the event of another weather event. Once they receive the design plans, they will
proceed to the construction process.
VII. New Business.
a. Committee Vacancy — Action Item
I. Haldeman Creek MSTU Advisory Committee Application- Jacob Dutry van
Haeften — Mr. van Haeften attended and provided a brief summary about
himself and his ability to volunteer as a Committee member. Mr. van Haeften
wanted to let everyone know his nickname is Jaae pronounced Ya. Mr. van
Haeften is an avid boater and he felt it was his time to give back because he is
retired and has banking background. He is excited to work with staff and the
Community.
II. Haldeman Creek MSTU Advisory Committee Application- Greg Orick- Mr.
Orick was not in attendance to provide any background for his application.
-Committee Comment- Jim King wanted to say that Mr. Orick shows his
address at the Marina off of Bayview Drive and although it is a business
location and he shows that he has residential lot on the Creek he did not

attend and wanted to bring that to the Committees attention. Roy Wilson
said that it was important for someone to attend the meeting and he feels
like although Mr. Orick would be a great addition to the Committee, he
should have notified staff if he could not attend.
III. Board Action- Jim King made a motion to approve Mr. van Haeften
application for advisory committee position, seconded by Kate Riley.
Passed unanimously.
b. Budget for Millage- Debrah Forester, CRA Director mentioned the upcoming
budget and asked the Committee if they would vote on millage neutral or tax
neutral, with the staff recommendation of millage neutral because of the property
values increasing. Roy Wilson made a motion to keep it millage neutral, Seconded
by Jim King. Passed unanimously.
VIII. Staff Reuort:�
a. Project Manager Report- Tami Scott provided an update on a few of the
projects listed in her report. The Davis cell Tower is still on track to be
decommissioned and demolished by July 31. Fire Suppression II will be
wrapped up in a couple of weeks. Fire Suppression Phase III project, staff was
partnering with Stormwater Dept. to coordinate improvements but after
analysis there would only be a 2% improvement and the costibenefit would be
minimal, staff is recommending not moving forward on adding stormwater
improvements to the project. Ms. Scott provide an update on the "What is
Your Speed" study conducted in the Sabal Shores Neighborhood and reported
that speeding was not an issue in the community. FPL has installed new LED
light fixtures and some complaints were reported that it was too bright but
after it was reported to FPL they have put on some filters. She noted that if
anyone else has issues with the lights to please contact her. Thomasson Drive
Project is starting, and there are signs up on three locations but if anyone needs
information feel free to contact her directly. CRA Parking lot has gone out to
bid again and received much better bids at a more reasonable price. Sabal
Bay's expansion of Isles of Collier Preserve, south Bayshore Drive, and the
Camden Landing's neighborhood informational meetings are scheduled, and
staff has distributed that information to everyone. The last item is the new
Sun Belt Building on Davis Blvd. That project has gone through the site
development plan and close to approval.

questions.

XI. Staff Comments: Debrah Forester, CRA Director had asked if the committee was
interested in starting summer break in July and only hold a meeting if there was a need.
Jack Bonzaaler asked if there was any news on the permitting portion of the dredging
and Ms. Forester said it was still with the permitting Agencies and no comments have
been received or approvals issued at this time. Jim King commented unless some of the
information comes back to require them to meet, he recommends freeing up CRA Staff s
time and not have any meetings until they have something on the Agenda. Unanimous

XII. Advisory Committee Comments: Kate Riley asked if Ms. Forester will keep them
updated on the signage and when Chris D'arco finds some information to let the
Committee know. Roy Wilson had asked if the committee can pay overtime for some
deputies to work Saturday and Sunday to curb the speeding on the creek. Ms. Forester
wanted a consensus to pursue asking if MSTU funds can be utilized for services from the
Sheriffs Office. Everyone on the committee support it. Ms. Forester will follow-up with
the County Attorney's office.

Please contact me so that I can be present for removal, but if I am unable to, please
photograph the removal and destruction of the vessel and email the images to the
email address provided below after the removal is complete. Please also notify me
of the total cost incurred for the removal and destruction of each individual vessel.
If an owner/custodian can be identified, FWC will send a demand letter to the
owner/custodian on your behalf seeking to recover the costs.
This authorization permits only (1) the destruction of the vessel(s) identified above
and (2) the removal and less any salvage value obtained by the disposal of the
property of salvageable material from this vessel pursuant to subsection 705.103(4),
Florida Statutes. Any other use of the vessel is not authorized. This letter does not
authorize the removal of any vessels other than the vessel(s) identified above.
Once you have informed me the vessel(s) has been removed and I have photographic
documentation of the removal and destruction, FWC will request the Department of
Highway Safety and Motor Vehicles cancel the title and registration.

"Haldeman Creek MSTU Advisory Board requested clarification if they
can use funds from the MSTU to pay for off -duty marine patrol officers to
patrol Haldeman Creek. Please provide written clarification if funds can be
used to pay for off -duty patrols. Thank you."
The short answer to your question is no.
The Ordinance creating this MSTU provides in relevant part as follows:
Sec. 122-2212. - Creation of the municipal service taxing unit.
There is hereby created and established the Haldeman Creek Dredging
Municipal Service Taxing Unit, hereinafter referred to as "MSTU." The
boundaries of the MSTU are as follows: See attached Exhibit "A" which is
incorporated herein by reference.
(Ord. No. 2006-60, § 1; Ord. No. 08-33, § 1; Ord. No. 2018-04, § 1)
Sec. 122-2213. - Purpose and governing body.
The MSTU is created for the purpose of providing maintenance dredging
within the MSTU as determined by the advisory committee.
The maintenance tasks shall include but not be limited to:
(1) Maintenance dredging;
(2) Maintenance of navigational channel markers;
The governing body of the MSTU shall be the Board of County
Commissioners of Collier County, Florida.
(Ord. No. 2006-60, § 3)
If the Advisory Board wishes to expand the types of activities that can be
funded by MSTU dollars, they will need to request that the Board of County
Commissioners amend the ordinance.

1. MINI -TRIANGLE — 5.27 ACRE CATALYST SITE
The closing of the mini -triangle took place on November 13, 2020 (See Naples Daily News Article
— Correspondence)
2. DEL'S PROPERTY ACQUISITION
Closing scheduled for November 20, 2020. Notice to vacate by January 19, 2021 issued. Request
to demolish the two front structures submitted to Collier County Facilitates.
3. PUBLIC ART PLAN —Scheduled for January 26, 2020 BCC Presentation.
4. 17 AC BOARDWALK
Request for Proposal (RFP) is drafted and submitted to the Procurement Department to review
and schedule for advertising. The request is for design services including the boardwalk and other
park amenities and evaluate stormwater capacity. The process for selection of consultant will
take several months.

Paradise Advertising and Marketing, Inc. — New contract was approved by the BCC on October
13, 2020. Scope of work is being drafted.
6. COASTERS/SHUTTLE SERVICE — Coasters and Posters were distributed the week of
November 23 and will continue through season.
7. LAND USE REGULATIONS — November 12 Special Meeting notes attached. Revision
scheduled to be presented at the January 12 Advisory Board meeting. Scope of work is
being drafted to expand Johnson Engineering work to include additional work and extend
the length of the contract.

Fire Suppression System- Phase 3:
Fire Suppression Phase 3 has been approved and the contract with Andrews Siteworks, LLC in the amount of $658,560.00
has been executed. This project included Areca Avenue, Coco Avenue, Basin Street, Canal Street and Captains Cove.
CRA staff has issued a notification to the property owners we anticipate a started date of January 2020. The contract schedule
requires a 150-day substantial completion and a 180-day final completion. The scope of work for this project is limited to the
replacement of the existing waterlines and installation of fire hydrants, this project does not include any stormwater
enhancements or roadway improvement under the Andrewes Sitework contract. CRA staff is working with other County
departments to identify what enhancement can be made in the area.

The Contract has been executed, CRA staff has been in contract with Fort Construction Group of Naples Inc to discuss a start
date, once a schedule is established staff will notify the property owners of the project and will issue the contractor a notice to
proceed. The contract schedule requires a 150-day substantial completion and a 180-day final completion,

Staff has completed the editing for the new Landscape contract, the contract will now include Thomasson drive, Hamilton
Avenue and the community parking lot. The documents are with Collier County procurement department being processed for
solicitation.
Bflyshore Drlve Beautification Renovation /Access Management:
Staff is waiting for the updated access management documents from Trebilcock Solutions, consultant is schedule for the
December 1, 2020 meeting for a presentation.
Moorhead Manor:
Staff has completed the drag agreement end exhibits; all infonnation is with the County Attorneys office for review

Location: 2015 and 2025 Davis Blvd.
Status: First GMD Review Letter sent out on 8/24/2020. Pending resubmittal from
applicant.
The applicant is rezoning this property to a Commercial PUD in order to restore wet
slips in the western basin and allow for recreational boat rental operations
(Freedom Boat Club). Generally, the CPUD is proposing 3 tracts, with permitted
uses that range from marina, rental boat operations, wet slips and associated uses.
This site qualifies for 311 wet and dry slips, due to their `preferred' ranking under
the County's Manatee Protection Plan.
