EXECUTIVE SUMMARY
Recommendation to approve the partial release of a code enforcement lien with an accrued value of
$212,426.17, for payment of $3,500, in the code enforcement action entitled Board of County
Commissioners v. Jeffrey Gallucci, Deborah L. Gallucci, and Mary P. Stevens, Code Enforcement
Board Case No. CESD20140006864, relating to properties known as 41 Henderson Dr. and 3 Creek
Cir., Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners accepts an offer to partially release a code
enforcement lien with an accrued value of $212,426.17 as of September 28, 2020, for payment of $3,500,
as to properties known as 41 Henderson Dr. and 3 Creek Cir. only, in relation to Code Enforcement Board
Case No. CESD20140006864.
CONSIDERATIONS: Due to a code violation at 39 Henderson Drive, for a fence installation, an
addition of a lanai and a shed without first obtaining required permits, the Code Enforcement Board
ordered the imposition of a lien against Jeffrey Gallucci, Deborah L. Gallucci, and Mary P. Stevens in
Case No. CESD201400036864. The lien was recorded in the Official Public Records on February 12,
2015, at O.R. Book 5120, Page 875, and it encumbers all real and personal property owned by Jeffrey
Gallucci, Deborah L. Gallucci, and Mary P. Stevens. The lien amount of $212,426.17 is based on 2,123
days of accrued fines (December 7, 2014, through September 28, 2020) at $100 per day, plus $126.17 in
operational costs.
This request for a partial release is for different properties known as 41 Henderson Dr. and 3 Creek Cir.,
which contain no code violations. These parcels were encumbered by the lien as a result of common
ownership by Jeffrey Gallucci. After a divorce, Deborah L. Gallucci acquired the property via Quit
Claim Deed, recorded on March 16, 2015, at O.R. Book 5129, Page 2127. Most recently the property
was acquired by Wilmington Saving Fund Society FSB through a foreclosure sale, via Certificate of Title
recorded on August 4, 2020, at O.R. Book 5796, Page 2793. Mr. Gallucci did not create the existing code
violations and was further divested of his interest in the property. Mr. Gallucci became aware of the
encumbrance of the lien on his properties when he attempted to sell 41 Henderson Dr.
FISCAL IMPACT: Payment of $3,500 in settlement of fines and costs has been made. If approved by
the Board, accrued fines in the amount of $208,926.17 would be waived with respect to 41 Henderson Dr .
and 3 Creek Cir. only. The lien balance would continue to encumber all other properties owned by
Deborah L. Gallucci and Mary P. Stevens.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46 JAK
RECOMMENDATION: To waive the fines in the amount of $208,926.17 with respect to 41 Henderson
Dr. and 3 Creek Cir only, accept settlement payment amount of $3,500, and authorize the Chairman to
sign the attached partial releases and satisfaction of lien for recording in the Official Public Records.

Dear Collier County Board of Commissioners:
I represent Mr. Jeffrey Gallucci, who is attempting to sell property that he owns at 3
Creek Circle, Naples, Florida. Blocking that sale, however, is a code enforcement lien existing
on the property at 39 Henderson Drive, Naples, Florida. For the below reasons, Mr. Callucci is
requesting that the lien be partially released as to him and as it relates to his properties at 3 Creek
Circle, Naples, Florida and 4l Henderson Drive, Naples, Florida.
At the outset, it should be noted that no code enforcement violations exist at any ofthe
properties for which we are requesting a release (3 Creek Circle and 4l Henderson Drive). Prior
to any code enforcement issues existing on the other property at 39 Henderson Drive, Mr.
Gallucci owned that property with his now ex-wife, Debora Gallucci. The Galluccis divorced in
2006 with a final divorce decree being entered on October 19, 2006, which awarded the property
at 39 Henderson Drive to his now ex-wife. Deborah Callucci. Mr. Callucci has not been
involved in that property since then. For reasons unknown, Mr. Gallucci's ex-wife did not
remove his name from the property and Mr. Gallucci purportedly remained on title until March
I 6, 201 5 when a quitclaim deed was recorded.
More than 8 years after his divorce and his last involvement with the prope(y at 39
Henderson Drive, the subject code enforcement violations became an issue. Ultimately, Mr.
Gallucci's ex-wife did not show up at the code enforcement hearing and ajudgment was entered
not only against her, but also against hirn. Unaware ofthe code enforcement violations and the
judgment, Mr. Gallucci purchased the property at 3 Creek Circle from his parents in 2018. The

code enforcement judgment ostensibly then attached to that property on the recording ofthe
deed, together with the property he already owned at 4l Henderson Drive.
Further complicating matters is that the property at 39 Henderson Drive has been
foreclosed and is now owned by a bank. Even if Mr. Gallucci wished to attempt to resolve the
code enforcement issues at 39 Henderson Drive, it would be impossible to do so with Mr.
Gallucci being divested of possession in 2006.
ln summarv:
Mr. Gallucci was divested of his interest in the property with the existing
violations (39 Henderson Drive) by divorce decree in 2006.
Since the divorce decree in 2006, Mr. Gallucci has been prohibited from entering
the property and dealing with its affairs.
Mr. Gallucci did not create the existing code violations on the property at 39
Henderson Drive and they occurred long after Mr. Gallucci was divested of his
interest in the property.
Mr. Gallucci was unaware ofthe code violations and was unaware ofthe
judgment and its daily fine until recently, when he attempted to sell the property
at 3 Creek Circle and the judgment lien appeared as a requirement on a title
commitment.
The property at 39 Henderson Drive has since been loreclosed upon and is now
owned by a banking entity.

Dear Collier County Board of Commissioners:
I represent Mr. Jeffrey Callucci, who is attempting to sell property that he owns at 3
Creek Circle, Naples, Florida. Blocking that sale, however, is a code enforcement lien existing
on the property at 39 Henderson Drive, Naples, Florida. Forthe below reasons, Mr. Gallucci is
requesting that the lien be partially released as to him and as it relates to his properties at 3 Creek
Circle, Naples, Florida and 4l Henderson Drive, Naples, Florida.
At the outset, it should be noted that no code enforcement violations exist at any ofthe
properties for which we are requesting a release (3 Creek Circle and 4l Henderson Drive). Prior
to any code enforcement issues existing on the other property at 39 Henderson Drive, Mr.
Callucci owned that property with his now ex-wife, Debora Gallucci. The Galluccis divorced in
2006 with a final divorce decree being entered on October 19, 2006, which awarded the property
at 39 Henderson Drive to his now ex-wife. Deborah Gallucci. Mr. Gallucci has not been
involved in that property since then. For reasons unknown, Mr. Gallucci's ex-wife did not
remove his name from the property and Mr. Gallucci purportedly remained on title until March
I 6, 201 5 when a quitclaim deed was recorded.
More than 8 years after his divorce and his last involvement with the properry at 39
Henderson Drive, the subject code enforcement violations became an issue. Ultimately, Mr.
Gallucci's ex-wife did not show up at the code enforcement hearing and ajudgment was entered
not only against her, but also against him. Unaware ofthe code enlorcement violations and the

code enforcement judgment ostensibly then attached to that property on the recording of the
deed, together with the property he already owned at 4l Henderson Drive.
Further complicating matters is that the property at 39 Henderson Drive has been
foreclosed and is now owned by a bank. Even if Mr. Gallucci wished to attempt to resolve the
code enforcement issues at 39 Henderson Drive, it would be impossible to do so with Mr.
Gallucci being divested of possession in 2006.
In summarv:
Mr. Gallucci was divested of his interest in the property with the existing
violations (39 Henderson Drive) by divorce decree in 2006.
Since the divorce decree in 2006, Mr. Gallucci has been prohibited from entering
the property and dealing with its affairs.
Mr. Gallucci did not create the existing code violations on the property at 39
Henderson Drive and they occurred long after Mr. Gallucci was divested of his
interest in the property.
Mr. Callucci was unaware of the code violations and was unaware of the
judgment and its daily fine until recently, when he attempted to sell the property
at 3 Creek Circle and the judgment lien appeared as a requirement on a title
commitment.
o The property at 39 Henderson Drive has since been foreclosed upon and is now
owned by a banking entity.
