THIS TEMPORAU DRIV Y REST RATION EASEMENT, is made and
entered into this a.0 ay of 2020, by NEW PLAN FLORIDA
HOLDINGS, LLC, a Delaware limited liability company,whose mailing address is Ryan
LLC Tax Compliance, PO Box 4900 Dept. 124, Scottsdale, AZ 85261-4900 (hereinafter
referred to as "Grantor"), to COLLIER COUNTY, a political subdivision of the State of
Florida, whose mailing address is 3299 Tamiami Trail East, c/o the Office of the County
Attorney, Suite 800, Naples, Florida 34112 (hereinafter referred to as"Grantee").
(Wherever used herein the terms"Grantor"and "Grantee"include all the parties to
this instrument and their respective heirs, legal representatives, successors and
assigns. Grantor and Grantee are used for singular or plural, as the context requires.)
WITNESSETH:
That the Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and
other valuable consideration paid by the Grantee, receipt and sufficiency of which is
hereby acknowledged, hereby conveys, grants, bargains and sells to the Grantee, a
Temporary Driveway Restoration Easement (hereinafter referred to as the "TDRE") to
enter upon the lands of the Grantor, described as follows (the"Easement Area"):
See attached Exhibit"A", which is incorporated herein by reference.
THIS IS NOT HOMESTEAD PROPERTY NOR IS IT CONTIGUOUS THERETO.
The Easement Area shall be used by Grantee for the purpose of filling, grading
and placing concrete, asphalt or rock on the Grantor's lands for the purpose of
constructing, with materials of like kind, a driveway/turnout and/or to provide for
continuous transition between the existing driveway and the newly constructed road,
sidewalk and drainage improvements to/for the Triangle Boulevard Project No. 60215.
This easement includes the right to remove and use any and all excavated material.
The term of this TDRE shall commence upon the issuance of Grantee's official
Notice to Proceed to its contractor for the construction of the Triangle Boulevard Project
and shall automatically terminate two years therefrom.
IN WITNESS WHEREOF, the GRANTOR has caused these presents to be
executed the day and year first above written.
