EXECUTIVE SUMMARY
Recommendation to waive a requirement in the Collier County Fairgrounds Lease,which bars
amplified sound or music after 7:00 p.m. on Sundays through Thursdays, to allow for a concert
to be held on Sunday,December 6,2020 to end at 9:00 p.m.
OBJECTIVE: To waive the Collier County Fairgrounds Lease requirement of a 7:00 p.m. cut-off
for amplified sound and extend the end time for a concert to be held at the Collier County
Fairgrounds on Sunday,December 6th to 9:00 pm.
CONSIDERATIONS: The Collier County Fair Board has requested that the County Commission
consider allowing a change to the ending time for a concert to be held on Sunday, December 6, 2020.
The Fourth Amendment to the lease provides that "Except for the annual County Fair, no amplified
sound or music is permitted after 10 p.m. on Fridays and Saturdays or 7 p.m. on Sundays through
Thursdays."The Fair Board would like the Commission to consider allowing that time to be extended
to 9:00 p.m. on December 6, 2020 for a concert being presented by Tamiami Ford beginning late
afternoon and concluding at 9:00.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved
as to form and legality, and requires majority vote for Board approval. -JAK

EXECUTIVE SUMMARY
Recommendation to approve the award of Invitation for Qualifications ("IFQ")#20-7801 to the A2
Group, Inc. ("A2"), for Preconstruction Services for the Sun-N-Fun Waterpark Restoration and
Renovation Project, to be memorialized under a subsequently prepared Construction Manager at
Risk ("CMAR") agreement, and authorize the County Manager, acting on behalf of the Board, to
enter into the CMAR Agreement for those Pre-construction Services with A2 in the amount of
$50,617,subject to formal ratification by the Board at its December 8,2020 meeting.
OBJECTIVE: To retain a firm to provide CMAR services for the Sun-N-Fun Water Park Rehabilitation
and Restoration to obtain a high level of schedule and cost control for the project.
CONSIDERATION At the October 13, 2020, the Board approved the selection committee's ranking
and authorized staff to negotiate a contract with the top-ranked firm, A2 Group, Inc. ("A2"), for CMAR
services for Sun-N-Fun Waterpark Restoration and Renovation (Agenda Item 16.D.5). A CMAR is a
procurement delivery method that entails a commitment by the Construction Manager to deliver a project
within a Guaranteed Maximum Price ("GMP"), which is based on the construction documents and
specifications at the time the GMP is determined.
Staff expedited negotiations and reached an agreed fee with A2 to provide pre-construction services for this
project in the amount of$50,617. The preparation of a contract,which will be based upon similar recent
Board approved CMAR agreements is in process; but due to the late date in arriving at the agreed upon
negotiated fee, a fully vetted and agreed upon CMAR agreement could not be prepared prior to the
November agenda deadline. Subject to the Board's approval of this pre-construction services
phase/CMAR,as Amendment to the CMAR would also be brought back to the Board to establish the GMP
for the subsequent construction phase of the project.
The immediate commence of the proposed preconstruction services is critical to re-opening Sun-N-Fun
facilities, which has been closed since March. The design is progressing rapidly and has reached the 60%
Design Development phase. Input from the Construction Manager is needed to guide and provide
specialized insight to the scope details, constructability and estimating for the project. Staff requests that
the Board delegate to the County Manager the authority to enter into a CMAR agreement for the
preconstruction services once finalized in order to expedite activity on this critical project. The finalized
CMAR agreement entered into between the A2 and the County Manager will be brought back to the Board
for ratification at the Board's December 8, 2020 meeting.
FISCAL IMPACT: The funds are available in the existing Fund 308 budget,project number 80421.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote

STATEMENT OF COMPLIANCE
The development consists of 616±acres of property in Collier County as a Mixed Use Planned Unit
Development (MPUD) to be known as the Orange Blossom Ranch MPUD, which will be in
compliance with the goals, objectives, and policies of Collier County as set forth in the Collier
County Growth Management Plan (GMP). The Orange Blossom Ranch MPUD is a mixed-use
residential community with associated community facility, recreational, and commercial uses and
will be consistent with the applicable elements of the Collier County GMP for the following reasons:
1. The subject property is within the Settlement Area District Designation as identified on the
Future Land Use Map, which permits a wide variety of land uses, including commercial,
residential, community facility and recreation.
2. The total acreage of the MPUD is 616 ± acres. The maximum number of dwelling units
to be built on the total acreage is 6001,950. The number of dwelling units per gross acre,
less the 44±acre Commercial/Office area, is approximately 2.8 3_4 units. The density on
individual parcels of land throughout the project may vary according to the type of
housing placed on each parcel of land. No maximum densities have been established in
the Settlement Area District.
SECTION I
PROPERTY OWNERSHIP AND GENERAL DESCRIPTION
1.6 PROJECT DESCRIPTION
The MPUD is a mixed-use residential single family and multi-family community with a
maximum of600 1.950 units designated "R/G" dwelling units and 200,000 square feet of
commercial and office leasable area within areas designated "C/O" on the master plan.
Recreational facilities may •be provided in conjunction with the dwelling units. Residential
land uses, recreational uses, community facility uses, commercial uses and signage are
designed to be harmonious with one another in a natural setting by using common architecture,
appropriate screening/buffering, and native vegetation,whenever feasible.
SECTION III
RESDIENTIAL/GOLF

3.1 PURPOSE
The purpose of this Section is to identify permitted uses and development standards for areas
within the Orange Blossom Ranch MPUD designated on the Master Plan as "R/G",
Residential/Golf.

3.2 MAXIMUM DWELLING UNITS
A maximum of 1,600 1,950 dwelling units of various types may be constructed within areas
designated R/G on the Master Plan.
SECTION VI
GENERAL DEVELOPMENT COMMITMENTS
6.1 PURPOSE
The purpose of this Section is to set forth the development commitments for the Orange
Blossom Ranch MPUD.
6.2 MPUD MASTER DEVELOPMENT PLAN
A. All facilities shall be constructed in accordance with the final site development plans,final
subdivision plans and all applicable State and local laws, codes and regulations except
where specifically referred or modified herein.
B. The MPUD Master Plan(Exhibit A)is an illustration of the conceptual development plan.
Tracts and boundaries and acreage allocations shown on the plan are conceptual and
approximate and shall not be considered final.Actual tract boundaries shall be determined
at the time of preliminary subdivision plat or site development plan approval.
C. All necessary easements, dedications, or other instruments shall be granted to insure the
continued operation and maintenance of all utilities.
D. Prior to issuance of the certificate of occupancy for the 1,601'dwelling unit,the Developer
shall have constructed an additional 150 parking spaces and additional amenity features
as identified in the Developer Commitment Exhibit. Additional parking spaces will be
constructed concurrently with the surrounding infrastructure.
E. Prior to issuance of the certificate of occupancy for the 1,601st dwelling unit,the Developer
shall provideaccess point to the development parcels north of Oil Well Road and
__two access points to the development parcels south of Oil Well Road that are open and

F. Concurrent with Collier County's construction of the public access road depicted in the
PUD Master Plan, the Developer shall provide an additional access point to the
development parcels to the north of Oil Well Road that interconnects with the public
access road. Prior to Collier County's completion of the public access road,the temporary
construction access depicted on the PUD Master Plan will be permitted for construction
and emergency uses.
G. Prior to the issuance of the certificate of occupancy for the 1,601st dwelling unit, the
Developer shall construct a second amenity center on the development parcels to the south
of Oil Well Road in the area depicted on the PUD Master Plan. The proposed amenities

H. If the Developer elects to develop a townhome or multifamily use on the development
parcels to the south of Oil Well Road,then such townhome or multifamily use may only
be developed in Tract A identified on the PUD Master Plan. If a townhome or multifamily
use is developed in Tract A, there shall be no internal vehicular interconnection between
Tract A and Tract B identified on the PUD Master Plan, except that a gated emergency-
only connection will be provided. If a townhome or multifamily use is developed in Tract
A,a Type B Landscape Buffer,which shall include a 6 foot tall opaque precast fence,shall
be provided along all internal perimeter boundaries between Tract A and Tract B (not
including lake banks). The required plantings shall be located on the outside of the fence,
facing Tract B. Trees shall be spaced no more than 25 feet on center where the buffer is
adjacent to a lake, the required plant materials may be clustered to provide or maintain
views.
I. If the Developer elects to develop a townhome or multifamily use in Tract A,the required
Type D Buffer along the Tract A Oil Well Road frontage as depicted on the PUD Master
Plan, shall include a 6 foot tall wall or precast fence, which may be located on top of a
berm.The required landscaping shall be located on the Oil Well Road side of the fence.
