EXECUTIVE SUMMARY
Recommendation to approve an Ordinance amending Ordinance 2006-57 expanding the use of golf
carts to all county roads and streets throughout Goodland, Florida.
OBJECTIVE: To amend Ordinance 2006-57 allowing for the use of golf carts on all public roads in
Goodland.
CONSIDERATIONS: Florida Statute §316.212 prohibits the operation of golf carts on county roads or
streets unless the street has been designated by the county for use by golf carts. On November 28, 2006,
the Board of County Commissioners (Board) approved Ordinance 2006-57 allowing for the use of golf
carts upon designated public roads and streets, including those county roads and streets in Goodland,
"located at least 125 feet west of Sunset Drive". Since that time development has increased along Angler
Drive in Goodland, and residents along that street have requested to be allowed to use golf carts. Based on
this study, it is staff s recommendation to allow the use of golf carts on all public roads in Goodland.
On September 22, 2020, the Board heard the Item 16A13 (#13251), accepted the findings of the
"Goodland Golf Cart Transportation Analysis" and directed the County Attorney to advertise for a public
hearing on an ordinance allowing for the expanded use of golf carts to all County roads and streets
throughout Goodland. The item was duly advertised on October 21, 2020.
FISCAL IMPACT: The cost to advertise this matter was $546, and the cost to allow expansion of golf
cart use is estimated at $500 for sign related tasks. Funding is available within Transportation Fund (101),
Traffic Operations Cost Center (163630).
GROWTH MANAGEMENT IMPACT: This action will result in no growth management impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: To approve an Ordinance amending Ordinance 2006-57 expanding the use of
golf carts to all County roads and streets throughout Goodland, Florida.

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AMENDING ORDINANCE NO. 2006-57,
AS AMENDED, CODIFIED IN CHAPTER 130 "TRAFFIC AND
VEHICLES" OF THE CODE OF LAWS AND ORDINANCES, TO EXPAND
THE USE OF GOLF CARTS TO ALL DESIGNATED COUNTY ROADS
AND STREETS WITHING THE VILLAGE OF GOODLAND, FLORIDA,
SUBJECT TO SPECIFIED RESTRICTIONS; PROVIDING FOR
CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN
THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 316.212(1), Florida Statutes, permits counties to allow golf carts to
be operated on county roads provided the county first determines that golf carts may safely travel
on or cross the public road or street, considering factors including the speed, volume, and character
of motor vehicle traffic using those roads or streets; and
WHEREAS, Section 316.212(8)(a), Florida Statutes, allows counties to enact restrictions
and regulations on unlicensed drivers relating to golf cart operation and equipment which are more
restrictive than the regulations enumerated in Florida Statutes if appropriate signs are posted or the
residents are otherwise informed that such regulations exist and will be enforced within the local
government's jurisdictional territory; and
WHEREAS, the Board of County Commissioners has previously accepted the findings of
the "Goodland Golf Cart Transportation Analysis" dated August 12, 2020, which recommends the
expansion of use of golf carts to all county roads and streets within the Village of Goodland; and
WHEREAS, the Board of County Commissioners believes that the regulations proposed
in the Ordinance promote and enhance the health, safety and welfare of its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Ordinance No. 2006-57, as amended, is amended as follows:
Sec. 130-4. - Use of golf carts upon designated public roads and streets in Collier County,
Florida.

(1) The term "golf cart" is defined as stated in F.S. § 320.01, as a motor vehicle that is designed
and manufactured for operation on a golf course for sporting or recreational purposes and that
is not capable of exceeding speeds of 20 miles per hour.
(2) Golf carts may be operated on these all county roads and streets in Goodland, Florida.

SECTION TWO: Conflict and Severability.
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION THREE: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or
relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or
any other appropriate word.
SECTION FOUR: Effective Date.
This Ordinance shall become effective upon receipt of notice from the Secretary of State
that this Ordinance has been filed with the Secretary of State.
PASSED AND DULY ADOPTED by the Board of County Commissioners of Collier
County, Florida, this day of , 2020.

Background
On Nobemver 28, 2006, agenda item 8D, the Board approved Ordinance No. 2006-57 allowing for the use of
golf carts upon designated county roads in Goodland. Based on a recent community request, the Traffic
Operations Section of the Collier County Growth Management Department reviewed the addition of Angler
Drive to become a portion of the area allowing golf carts on the island of Goodland. This evaluation performed
a review of Ordinance No. 2006-57 which determined that golf carts may be operated on all county roads and
streets in Goodland that are located to the east of Sunset Drive.
Goodland is a community located east of Marco Island in unincorporated Collier County, Florida.
The general study area is illustrated in Fig.1.

Goodland is an isolated community with a low population. It is located off of CR 92 (San Marco Rd). Goodland Co.;
Drive has 11-foot lanes and a posted speed limit of 30 mph from San Marco Road to just east of Angler Drive E
where the speed limit is reduced to 25 mph. The speed limit on the rest of the island is 25 mph. Goodland Drive
is appropriately marked for "NO PASSING" by a double yellow centerline. Q
A pathway adequate for bicyclists and pedestrians runs parellel with but unattached to,Goodland Drive for most
of its length, providing an area out of the roadway for the bike/pedestrian traffic.

Recommendations and Conclusions
A review of the existing ordinance and the field characteristics of Goodland Dr W near the intersections of
Angler Dr and Sunset Dr suggests that the original intent of the golf cart ordinance was to include Angler Dr as
part of the limits allowing golf cart use. It is believed that Angler Dr had only the commercial marina business
and not the numerous adjacent condo's when the original golf cart study was performed. The extents of the
existing golf cart ordinance includes a driveway that may connect to the condos at some point in the future.
Currently Angler Dr. is the only paved accessway to Goodland for golf cart owners that live in the condos.
It is therefore recommended to extend the golf cart use on Goodland to include Angler Drive. This can be easily
accomplished by reloating and changing a few signs. Refer to Appendix I: Sign Considerations

NOTICE OF INTENT TO CONSIDER AN ORDINANCE
Notice is hereby given that a public hearing will be held by the
Collier County Board of County Commissioners on November
10, 2020, in the Board of County Commissioners Meeting Room,
Third Floor, Collier Government Center, 3299 Tamiami Trail East,
Naples, FL., the Board of County Commissioners (BCC) will con-
sider the enactment of a County Ordinance. The meeting will
commence at 9:00 A.M. The title of the proposed Ordinance is
as follows:

NOTE: All persons wishing to speak on any agenda item must

ed to 3 minutes on any item. The selection of any individual to
speak on behalf of an organization or group is encouraged. If
recognized by the Chairman, a spokesperson for a group or or-
ganization may be allotted 10 minutes to speak on an item.

EXECUTIVE SUMMARY
Recommendation to adopt a resolution approving amendments (appropriating carry forward,
transfers and supplemental revenue) to the Fiscal Year 20-21 Adopted Budget.
OBJECTIVE: That the Board of County Commissioners adopts the attached resolution and the related
amendments that amend the Fiscal Year 20-21 adopted budget in accordance with Section 129.06, Florida
Statutes.
CONSIDERATIONS: Section 129.06, Florida Statutes defines how an annual budget, as adopted by the
Board, can be amended. Certain budget amendments that increase the total appropriations of a fund over
the adopted annual budget must be approved by resolution of the Board of County Commissioners after
an advertised public hearing. Budget amendments requiring such approval include the appropriation of
carry forward, interfund transfers, and supplemental revenue.
The budget amendments in the attached resolution cover Board approved items through November 10,
2020.
This is a public hearing to amend the budget for Fiscal Year 20-21. Each of these budget amendments
has been reviewed and approved by the Board of County Commissioners via separate Executive
Summaries.
A summary of the attached resolution has been advertised as required in Section 129.06 Florida Statutes.
The attached resolution was available for public review and inspection with the related budget
amendments and executive summary at the Office of Management and Budget. The amendments and
summary are included herein by reference in the resolution.
FISCAL IMPACT: The amendments and related executive summaries, which were previously
considered and approved by the Board, contained their respective fiscal impact statements.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the attached
resolution for legal sufficiency - JAK.
RECOMMENDATION: That the Board adopts the attached resolution amending the Fiscal Year 20-21
adopted budget.
