1. CALL TO ORDER
Steve Hruby called the meeting to order at 8:31 a.m. He read the procedures to be followed.
2. ROLL CALL —COMMITTEE MEMBERS AND STAFF
There were 9 active members present when the meeting started, either in person or through ZOOM,
therefore a quorum was established.
3. APPROVAL OF AGENDA AND MINUTE
a. A motion was made to approve the agenda by Mary Waller and seconded by Denise
Murphy. The motion passed by a vote of 9-0.

b. A motion was made by Litha Berger to approve the minutes from the meeting on August 10
was seconded by Mary Waller. The motion was passed with a vote of 9-0.
4. INFORMATIONAL ITEMS
AHAC Ordinance changes for BCC approval. Cormac reviewed the changes to the ordinance —
one seat will be held by an elected official and 6 seats are outlined in the state statute. The
triennial report has been changed to an annual report.
b. Collier Cares Update — Cormac reviewed the allocations from the CARES money. The money was
divided into different pots for non -profits, childcare, individual, business and foodbanks. There
are 30-50 people working 12-hour days getting applications processed. There will be a report to
the BCC on September 22 with an update.
5. PUBLIC COMMENT
John Harney opened a discussion regarding zoning and planning regarding modifications for Rural
Land Stewardship Areas. He stated 2 villages have gone forward without any affordable housing
included. Cormac said that all villages must have a mix of pricing, incomes and styles, but there
is nothing that states what those levels should be. There is a proposal that 2.5% of the acreage
be set aside for affordable housing. This would equate to approximately 10 units per acre and
about 10% of all overall units.

7. STAFF AND GENERAL COMMUNICATIONS
Housing Trust Fund Subcommittee Update — Mary Waller stated the Trust Fund Subcommittee
has met and are putting together a list of possible sources for funding. They are also setting up
a meeting with Commissioners to try to get funds from private sources. Mary asked the land
trust committee members to go the hearings to find out what is happening. The goal would be
to write an informed letter to the BCC in support of the RLSA. Cormac will draft a short and to
the point letter. Steve Hruby will contact other Boards this week to get their support. Litha
Berger motioned to write the letter, Mary Waller seconded, and the vote was 9-0 in favor. The
group asked if it would be possible to hold a joint workshop in January and invite Habitat, HELP
and other non -profits.
b. Project Updates:
Bembridge PUD — There has been some neighborhood opposition to having affordable housing.
Steve Hruby suggested that AHAC members should go to the public meetings and show support
for affordable housing and speak for themselves as well as the committee. Members should
also get other organizations to attend and show support as well, such as The Chamber and the
School Board. Cormac will make sure all of the public meeting dates are sent out to AHAC
members.

Golden Gate Golf Course —There will be 100 senior affordable rental units and 250 essential
service personnel rentals. This is going to the BCC in October to finalize the developer
agreement.
8. ADJOURN
a. There being no further business for the good of the County, Mary Waller motioned to adjourn the
meeting; Denise Murphy seconded, and the group agreed with a vote of 9-0. The meeting adjourned
at 9:47 a.m.

COLLIER COUNTY, FLORIDA, AMENDING ORDINANCE NO.

HOUSING INITIATIVE PARTNERSHIP (SHIP) LOCAL HOUSING
ASSISTANCE PROGRAM ORDINANCE PROVISIONS; BY AMENDING
SECTION S, DESIGNATION OF RESPONSIBILITY FOR
IMPLEMENTATION AND AMENDING SECTION 6, ESTABLISHMENT
OF AN AFFORDABLE HOUSING ADVISORY COMMITTEE,
CONSISTENT WITH AMENDMENTS TO SECTION 420.9076, FLORIDA
STATUTES; PROVIDING FOR INCLUSION IN THE CODE OF LAWS
AND ORDINANCES; PROVIDING FOR CONFLICT AND
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE OF
OCTOBER I, 2020.
WHEREAS, in 1992, the Legislature of the State of Florida approved the Sadowski
Affordable Housing Act creating the State Housing Initiatives Partnership ("SHIP") Program for
the specific purpose of supporting and expanding the availability of affordable housing resources
within the State; and
WHEREAS, the Collier County Board of County Commissioners (Board) adopted
Ordinance No. 93-19 on April 13, 1993, creating a local housing assistance trust fund, establishing
a local housing assistance program, designating responsibility for the program, and creating an
Affordable Housing Advisory Committee; and
WHEREAS, on July 23, 1991, the Board of County Commissioners adopted Ordinance
No. 91-65, establishing the Collier County Affordable Housing Commission (now known as the
Affordable Housing Advisory Committee), which Ordinance was subsequently amended by
Ordinance Nos. 04-77, 05-69, 08-17, and 09-50; and
WHEREAS, on April 9, 2013, the Board of County Commissioners adopted a single
consolidated Ordinance No. 2013-27 repealing Ordinance No. 93-19, as amended, and Ordinance
No. 91-65, as amended, to comply with the requirements set forth in Florida Statutes, Sections
420.907- 420.9070 and Chapter 67-37, Florida Administrative Code; and

WHEREAS, on Chapter 2020-27, Laws of Florida adopted changes to Section 420.9076,
Florida Statutes, related to the composition of the Affordable Housing Advisory Committee and
the frequency of its reporting requirements; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Title and Citation.
This Ordinance shall be known and cited as the "Collier County SHIP Local Housing
Assistance Program Ordinance".
SECTION TWO: Definitions.
For the purposes of this Ordinance, the definitions contained in Florida Statutes, Chapter
420.9071 and Rule 67-37.002, Florida Administrative Code, as they may be amended or replaced
from time to time, are adopted herein by reference.
SECTION THREE: Establishment of the Local Housing Assistance Program.
The Local Housing Assistance Program is hereby created and established to implement the
requirements of Florida Statutes, Section 420.907 and Rule 67-37, Florida Administrative Code,
adopted herein by reference, as they may be amended or replaced from time to time.
The County shall implement the program within the unincorporated boundaries of Collier
County and may enter into an interlocal agreement with municipalities. The strategies of the
program will be set forth in the County's SHIP local housing assistance plan.
SECTION FOUR: Establishment of a Local Housing Assistance Trust Fund.
Pursuant to the requirements Section 420.907 Florida Statutes, the County hereby reaffirms
establishment of a Local Housing Assistance Trust Fund within the official and fiscal accounting
office of the County as originally established on April 13, 1993, by Ordinance No. 93-19. The
County's local housing assistance trust fund shall be separately stated as a special revenue fund in

the county's audited financial statements, Copies of such audited financial statements shall be
forwarded to the Florida Housing Finance Agency.
All moneys received from the state pursuant to the State Housing Initiative Partnership
(SHIP) Program and any other funds received or budgeted to provide funding for the Local
Housing Assistance Program shall be deposited into the Collier County Local Housing Assistance
Trust Fund.
SECTION FIVE: Designation of responsibility for implementation.

Human Services Division shall be primarily responsible for implementation and administration of
the local housing assistance program,
SECTION SIX: Establishment of an Affordable Housing Advisory Committee.
The Affordable Housing Advisory Committee is created and established in accordance
with Florida Statutes, Section 420.9076 and County Ordinance No. 01-55, Standards for The
Creation and Review of Boards. In the event of a conflict, the provisions of Florida Statutes,
Section 420.9076 shall apply.
Duties of the advisory committee are provided in Florida Statutes, Section 420, 9076(2)(a)
- (k) adopted herein by reference, as they may be amended or replaced from time to time.
Appointments to the Affordable Housing Advisory Committee will be made in accordance
with the membership requirements of Florida Statutes, Section 420.9076, including joint
appointments to prepare a joint plan when a participating municipality enters into an interlocal
agreement to administer its program.
The committee shall consist of one locally elected official from the county or municipality
participating in the State Housing Initiates Partnership and up to ten (10)other eleven-"
members as required by Florida Statutes 420.9076 (2)(a)-(k), appointed by Resolution of the

requirements set forth in Section 420.9076, Florida Statutes. The term of service for all members

shall be for three (3) years or at the discretion of the Board. Terms may be eNtended for one
additional tare, (3) year term. Appointment and removal of members „from the Affordable Housing
Advisory Committee shall be in accordance_ with the provisions of the Collier County Ordinance
No. 2001-55, as it may be amended, or its successor ordinance,
Six (6) members shall constitute a quorum sufficient to permit the committee to take any
formal action. However, if formal action is not taken, the committee may meet to hear
presentations with less than a quorum in attendance, if the meeting is duly noticed.
A majority of concurring votes of the entire membership of the committee shall be
necessary for a decision or recommendation by the committee.
The committee may elect a chairperson or presiding officer.
The committee members serving immediately prior to this Ordinance's adoption shall
fulfill the remainder of their appointed terms.
The committee shall meet at least telly annually and submit a report to the local
governing body that includes recommendations on, and +.;� annually thereafter evaluates
the implementation of, affordable housing incentives as required by Florida Statutes, Section
420.9076(4)(a) _ (k).
The Board of County Commissioners may sunset or suspend meetings of the committee
upon submission of the irin� annual Incentive Report and reconvene no later than March 2 of

SECTION SEVEN: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of Collier County, Florida. The sections of this Ordinance may be renumbered or re -
lettered to accomplish such, and that the word "ordinance" may be changed to "section," "article,"
or other appropriate word or please necessary to accomplish such intentions.

SECTION EIGHT: Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, deemed a separate, distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION NINE: Effective date.
This Ordinance shall become effective October 1, 2020.

This committee was created by Ordinance No. 91-65, as amended, which was repealed and
replaced by Ordinance No. 2013-27. The purpose of this 11 member committee as required and
described by 420.9076 Fla. Stat. is to review policies, procedures, ordinances, land development
regulations, and the adopted local government comprehensive plan, and to recommend specific
actions or initiatives to encourage or facilitate affordable housing. The committee is required to
submit a triennial report to the Board of County Commissioners that includes recommendations
on, and evaluates the implementation of, affordable housing incentives as required by
420.9076(4) Fla. Stat. Terms are three years, and membership must consist of the following:
(a) One citizen who is actively engaged in the residential home building industry in connection
with affordable housing.
(b) One citizen who is actively engaged in the banking or mortgage banking industry in
connection with affordable housing.
(c) One citizen who is a representative of those areas of labor actively engaged in home
building in connection with affordable housing.
(d) One citizen who is actively engaged as an advocate for low-income persons in connection
with affordable housing.
(e) One citizen who is actively engaged as a for -profit provider of affordable housing.
(f) One citizen who is actively engaged as a not -for -profit provider of affordable housing.
(g) One citizen who is actively engaged as a real estate professional in connection with
affordable housing.
(h) One citizen who actively serves on the local planning agency pursuant to s. 163,3174.
(i) One citizen who resides within the jurisdiction of the local governing body making the
appointments.
Q) One citizen who represents employers within the jurisdiction.
(k) One citizen who represents essential services personnel, as defined in the local housing
assistance plan.
Term limits apply to the membership of this committee, per Code of Laws Sec. 114-61,
establishment of an affordable housing advisory committee, which states: "...The term of service
shall be for three (3) years or at the discretion of the Board. Terms may be extended for one
additional three (3) year term."

RE: Joint Letter of Support for Affordable Housing in the RLSA
We, the undersigned Affordable Housing advocacy and support agencies, would like to offer our
recommendation on the proposed Rural Land Stewardship Area (RLSA) comprehensive growth
management plan amendments currently under your review and seeking approval.
We are supportive of the staff recommendation that future towns and villages in the
RLSA set aside land equivalent to 2.5% of the gross acreage of their Stewardship
Receiving Area (SRA) for the purpose of the construction for Affordable Housing.
Furthermore, we agree with the staff recommendation that the construction of
Affordable Housing in an 5RA be deemed a public benefit use and will not require the
consumption of development credits at densities up to 10 units per acre.
Nearly twenty years ago, Collier County embarked on a groundbreaking land development protection and
stewardship program for the future buildout of our eastern lands. That program is based on the
fundamental tenants of innovation, incentivization, and protection. Now looking back on how the RLSA
has been utilized over the last two decades, it is possible to see areas where the program has been a
success and areas where the program has shortcomings.
One area where we believe the RLSA program has shown major shortcomings is in that of Affordable
Housing.
The current GMP and LDC regulations related to Affordable Housing in the RLSA are vague at best, and
worthless at worst. Currently, the GMP requires that new SRAs offer, "full range" and a "diversity" of
housing types and styles. This is certainly open to interpretation to determine what is a full range; and
what type of diversity is needed. The LDC offers a little more specificity by stating that SRAs, "Offer a range
of housing types and price levels to accommodate diverse ages and incomes." However, lingering
questions remain: which price levels? which ages? and which incomes?
At the time of adoption of these policies and regulations, the County relied upon the development
community to truly embrace the incentivization, innovation and flexibility offered through this new RLSA
program to address many traditional development concerns, including the location and provision of

Affordable Housing. Now nearly twenty years later, it appears that the industry is either unable or
unwilling to use that flexibility to address this concern.
There have been three SRAs approved since the RLSA's inception: The Town of Ave Maria, the Villages of
Rivergrass, and Hyde Park.
At the time of its approval, the Town of Ave Maria made significant development commitments to provide
Affordable Housing, both within and outside of the town. Many of these commitments were required by
State planning laws in place at the time (aka DRI). These State laws were rescinded shortly after approval
of the Town, and soon after, the Town likewise petitioned to have its Affordable Housing commitments
removed. The recently approved Rivergrass and Hyde Park Villages were approved with no commitments
for Affordable Housing. However, Rivergrass did make a contingent donation of $500,3W to the
Community Foundation of Collier County to offer ,a down payment assistance program to some of its
future residents.
Additional Villages have also recently been submitted to the County for review and approval. These too
follow the Hyde Park and Rivergrass models of large track development, virtually indistinguishable from
any other large development in Collier County. Likewise, none of these Villages have proposed any
accommodation for Affordable Housing.
The staff recommendation is unique considering the fact that availability of land is one of the biggest
barriers to developing Affordable Housing. To have land set aside helps alleviate this obstacle. Also, by
making the land available, the market rate home builder/developer is then relieved of any further
involvement in the production and marketing of Affordable Housing which is a highly specialized market
that requires wM unique skill sets and partnerships. Also, the availability of such land allows for the
attraction and procurement of developers who have the necessary skills and desire to develop affordable
housing.
The development industry has had twenty years to show Collier County that it could be truly innovative
when offered the great flexibility allowed in the RLSA, but to date, that flexibility has not produced
Affordable Housing. We believe that it is time for Collier County to require a more prescribed approach to
the provision of Affordable Housing in the RLSA and to support the staff recommendation as a means to
do so.
