A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, TO DISCLAIM, RENOUNCE
AND VACATE THE COUNTY AND THE PUBLIC INTEREST IN A
PORTION OF TRACT "A" OF TOLLGATE COMMERCIAL
CENTER PHASE THREE, PLAT BOOK 22, PAGE 95 OF THE
PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, KNOWN
AS BUSH BLVD. THE SUBJECT RIGHT-OF-WAY IS LOCATED
APPROXIMATELY 1600-FEET EAST OF COLLIER BOULEVARD
BETWEEN TOLLHOUSE DRIVE AND I-75 IN SECTION 35,
TOWNSHIP 49 SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA. (PL20200001420)
WHEREAS, pursuant to Resolution 2013-166, Petitioner, Dan Hartley, P.E., of
Peninsula Engineering,on behalf of the property owner, has requested the vacation of the
County and the Public interest in a portion of Tract "A" of Tollgate Commercial Center
Phase Three, Plat Book 22, Page 95 of the public records of Collier County, Florida, in
Section 35, Township 49 South, Range 26 East, Collier County, Florida, being more
specifically shown in Exhibit A, attached hereto; and
WHEREAS, at its September 22nd, 2020 regular meeting, the Board of
Commissioners, via Resolution No. 2020- 153 , approved the scheduling of a public
hearing on October 13, 2020 , pursuant to Resolution 2013-166; and
WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law; and
WHEREAS, the granting of the petitioner's request will not affect the ownership
or right of convenient access of persons owning other parts of the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and
public interest in a portion of Tract "A" of Tollgate Commercial Center Phase Three, Plat
Book 22, Page 95 of the public records of Collier County, Florida, in Section 35,
Township 49 South, Range 26 East, Collier County, Florida, being more specifically
shown in Exhibit A, will be vacated, extinguished, renounced and disclaimed, effective
upon recording of the plat submitted under petition PL20200001173, which includes a
County Utility Easement (CUE) in place of the right-of-way to be vacated, and this action
is declared to be in the public interest and for the public benefit.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board
is hereby directed to record a certified copy of the Resolution in the Public Records and
to make proper notation of this Resolution on the plat of Tollgate Commercial Center
Phase Three, Plat Book 22, Page 95, of the public records of Collier County, Florida.

All that Part of Tract A, Tollgate Commercial Center, Phase Three, being more particularly
described as follows:
COMMENCING at the Southwest corner of Tract 16 of said Tollgate Commercial Center
Phase Three, thence along the South line of said Tract 16, North 89°56'14" East 192.97
feet to a point on the boundary of Tract A of said Tollgate Commercial Center Phase
Three, also being the POINT OF BEGINNING;
Thence along the boundary of said Tract A, in the following seven (7)described courses:
1. 39.27 feet along the arc of a circular curve concave Northwest having a radius of
25.00 feet through central angle of 90°00'14" and being subtended by a chord
which bears North 44°56'16" East 35.36 feet;
2. North 00°03'58" West 419.85 feet;
3. 18.69 feet along the arc of a circular curve concave West having a radius of 25.00
feet through a central angle of 42°50'00" and being subtended by a chord which
bears North 21°29'00"West 18.26 feet to a point of reverse curvature;
4. 231.84 feet along the arc of a circular curve concave South having a radius of
50.00 feet through a central angle of 265°40'00" and being subtended by a chord
which bears North 89°56'03" East 73.33 feet to a point of reverse curvature;
5. 18.69 feet along the arc of a circular curve concave East having a radius of 25.00
feet through a central angle of 42°50'00" and being subtended by a chord which
bears South 21°21'05" West 18.26 feet;
6. South 00°03'58" East 419.85 feet;
7. 39.27 feet along the arc of a circular curve concave Northeast having a radius of
25.00 feet through a central angle of 89°59'46" and being subtended by a chord
which bears South 45°03'52" East 35.35 feet;
Thence leaving said boundary, South 89°56'14" West 110.00 feet to the POINT OF
