A RESOLUTION OF THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA PROVIDING FOR THE
ESTABLISHMENT OF A CONDITIONAL USE TO ALLOW
A SPORTS INSTRUCTIONAL SCHOOL AND CAMP FOR
SHOOTING INSTRUCTION AND TRAINING WITHIN AN
AGRICULTURAL (A) ZONING DISTRICT IN THE AREA
OF CRITICAL STATE CONCERN AND SPECIAL
TREATMENT OVERLAY (ACSC/ST), PURSUANT TO
SECTION 2.03.01.A.1.c.19 OF THE COLLIER COUNTY
LAND DEVELOPMENT CODE FOR A 10.77+/- ACRE
PROPERTY LOCATED ON THE WEST SIDE OF STATE
ROAD 29, APPROXIMATELY 8 MILES SOUTH OF I-75, IN
SECTION 7, TOWNSHIP 51 SOUTH, RANGE 30 EAST,
COLLIER COUNTY, FLORIDA. (PL20190001278)
WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida,
and Chapter 125, Florida Statutes, has conferred on Collier County the power to establish,
coordinate and enforce zoning and such business regulations as are necessary for the protection
of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 2004-41, as amended) which includes a Comprehensive Zoning Ordinance
establishing regulations for the zoning of particular geographic divisions of the County, among
which is the granting of Conditional Uses; and
WHEREAS, the Board of Zoning Appeals (Board), being the duly appointed and
constituted planning board for the area hereby affected, has held a public hearing after notice as
in said regulations made and provided, and has considered the advisability of a Conditional Use
to allow to allow a sports instructional school and camp for shooting instruction and training
within an Agricultural (A) Zoning District in the Area of Critical State Concern and Special
Treatment Overlay (ACSC/ST), pursuant to Section 2.03.01.A.1.c.19 of the Collier County Land
Development Code on the property hereinafter described, and the Collier County Planning
Commission has made findings that the granting of the Conditional Use will not adversely affect
the public interest and the specific requirements governing the Conditional Use have been met
and that satisfactory provision and arrangement have been made concerning all applicable
matters required by said regulations and in accordance with Subsection 10.08.00.D. of the Land
Development Code; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board
in a public meeting assembled and the Board having considered all matters presented.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:
Petition Number PL20190001278 filed by Q. Grady Minor & Associates, P.A. on
behalf of Deep 50 Industries, LLC, with respect to the property hereinafter described in Exhibit
A, be and the same is hereby approved for a Conditional Use to allow a sports instructional
school and camp for shooting instruction and training within an Agricultural (A) Zoning District
in the Area of Critical State Concern and Special Treatment Overlay (ACSC/ST), pursuant to
Section 2.03.01.A.1.c.19 of the Collier County Land Development Code, in accordance with the
Conceptual Site Plan described in Exhibit B, and subject to the conditions in Exhibit C. Exhibits
A, B, and C are attached hereto and incorporated herein by reference.
BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this
Board.

Deep 50 Gun Range Conditional Use (PL20190001278)
Proposed Conditions of Approval
The approval of this conditional use is subject to the following condition(s):
1. The Deep 50 Gun Range Conditional Use shall be limited to that which is depicted on the "Deep
50 Gun Range Conditional Use Site Plan and Site Alteration Plan (Per LDC Section 4.02.14), revised
3/26/2020," prepared by Q. Grady Minor&Associates, P.A.
2. The facility is open only to club members,and government and law enforcement members only.
3. The facility shall be gated and secured at all times.
4. No firearms or ammunition shall be stored or sold on the premises.
5. Hours of operation for members shall be from dawn to dusk.Sanctioned competitive events and
law enforcement or governmental training may occur two hours before dawn and two hours
after dusk.
6. The applicant must follow the Best Management Practices for Environmental Stewardship of
Florida Shooting Ranges as developed from time to time by the Department of Environmental
Protection.
7. No excavation of any type shall be allowed on the property. However, any final grading shall be
limited to those areas of the shooting range necessary to facilitate the drainage of the shooting
and parking areas to the water management system.
