Past
Order(s): On August 23, 2018, the Code Enforcement Board issued a Findings of Fact,
Conclusion of Law and Order. The Respondent was found in violation of the
referenced ordinances and ordered to correct the violation. See the attached Order
of the Board, OR 5549 PAGE 961, for more information. On January 24, 2019,
the Code Enforcement Board Granted a Continuance. See the attached Order of the
Board, OR 5603 PAGE 2096, for more information. On July 25, 2019, the Code
Enforcement Board Granted a Continuance. See the attached Order of the Board,
in Documents and Images, for more information.
The violation has been abated as of September 29, 2020.
FINES AND COSTS TO DATE ARE AS FOLLOWS:
Fines have accrued at a rate of$100.00 per day for the period from December 22, 2018 to

Dear Sir, Madam,
My parent's and I purchased the property at 138 3rd St. early in 2015. The Idea was to clean up the
property, update the interior by painting„ moldings and redecorating. We thought that possibly, one day
in the future, we would do some renovations, possibly add a bath, enlarge a closet and put a new roof on
the home. Hurricane Irma, struck on Sept 9, 2017 and changed all our plans.
The house was severely damaged from the storm. Windows were broken, and the exterior siding was
torn apart and hanging off everywhere. The roof was damaged beyond repair. Two (2) of 13 large trees,
that fell on our property, fell on the house causing structural damage to the corner and walls of 2 sides of
the house.
On Sept 7, 2017, 2 days prior to Irma, my step dad, Joseph Costa Jr., co owner of our home, died from
cancer at my parent's home in Mass. So initially after the storm, I returned to Fl. to just tarp the roof,
remove the gross debris and secure the home at 138 3rd St. I then had to return to MA. For services and
assist my Mom, Rosemary Costa,who was devastated with the loss of my Step Dad.
When the Collier County Inspector came to our property in early Feb, I had really just begun working on
repairs to the house for about 2 weeks.. Replacing tarps on the roof, repairing broken and bent windows,
tearing off the siding and securing the structural damage to our home.
He explained he was there due to an anonymous phone call that"The repairs to 138 3rd St were being
done by an unlicensed contractor,." He informed me he was there to investigate. I explained that I was
the co-owner of the property and I was trying to repair and secure the house, but because of the extent of
the damage I was convinced that I should just go ahead with adding the bathroom and closet, seeing the
house was going to need windows, doors, siding and a new roof.
He told me "those kind of major repairs would require drawings and permits." I told him that I
understood that and intended to apply for permits and do what was needed prior to making any
structural changes to our home. However; I was still making necessary repairs to just secure the home
and had not arrived at that point yet. He proceeded to place a "Cease & Desist order on our home,"
thus preventing me from doing any further work to secure the home.
It took me nearly 3. 5 months before I was able to get any architect to come out to the property and even
speak to me about the project. At that time he said he would help me,but it would be 6 to 8 weeks
before he could even start the project. Five, 5 weeks later, he came out to take measurements to start the
drawings. We communicated when he had questions,but it was nearly 5 more weeks before the first
drafts were finished. Then per protocol, the drawings needed to go to the engineer for his stamp of
approval and calculations.
December, 2019 is when I appeared in court before the committee and there was a vote to begin fining
me until the home was completed.
I received final approved drawings from the engineer shortly after my court appearance and was able to
submit them to the county for approval and permits. Of course, they too were considerably behind, as we
were just over a year out from the hurricane.
Mid March was when my drawings were finally approved for permitting. I stayed in regular contact
with code enforcement, both Jonathan and Joe Mucha, to give them consistent updates on approvals.
I began the structural part of the project,within a week of receiving the permits and I informed Joe and
the court that I had a full time job and as the owner, builder, the project would be a long and difficult one.
I informed everyone that I could only work on the house on my days off. My job was and still is as
Assistant Golf Professional, Fiddlers Creek, Naples Fl..
I have returned to court 2 more times for reviews and extensions which were granted both times. Again I
have been keeping in constant contact with code enforcement giving them updates of my progress.
When everything was shut down for Covid 19, as was my golf course, I was laid off for just over 3 months.
It was during this time that I was able to commit 7 days a week to finally finishing up the remainder of
the construction.
All of my inspections were passed without fail, except for one electrical inspection that failed due to a
panel that was not finished being labeled and that was quickly rectified and re-inspected within a week.
I received my C. 0. from, Renauld Paul on, Monday Sept 28, 2020, before I left for a lengthy trip up north
to see family and help family with a property that needs extensive repairs.
I am due back to work at Fiddlers Creek, on a full time basis starting the first week of November. I will be
arriving back in Naples Fl by the 3rd of Nov and would be happy to come back to meet with anyone and
explain my story and the process for the time it took to complete this project, if we are not able to resolve
the matter through this communication and Joe Mucha.
Joe has been a great resource for me and I thank him for meeting with and talked with me throughout
this long process. Thank you for your consideration of my letter.

1) Pay operational costs in the amount of $59.28 incurred in the prosecution of this case within 30
days of this hearing.
2) Abate all violations by: Obtaining all required Collier County Building Permit(s) or Demolition
permit(s), including all required inspections and a certificate of completion/occupancy for the
remodeled kitchen and open porch conversion within 90 days of this hearing or a fine of
$200.00 per day will be imposed until the violation is abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday, Sunday or legal
holiday,then the notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)

Mccann, enters into this Stipulation and Agreement with Collier County as to the resolution of Notices of
Violation in reference (case) number CEAU20200001629 dated the 18th day of May, 2020.
This agreement is subject to the approval of the Code Enforcement Board. If it is not approved, the case may
be heard on the scheduled Hearing date, therefore it is strongly recommended that the respondent or
representative attend the Hearing.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for October 23rd, 2020; to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence,
and that I have been properly notified pursuant to Florida Statute 162.
THEREFORE, it is agreed between the parties that the Respondent shall;

County, permits, inspections, and certificate of completion within 60 days of this hearing or a
fine of $100.00 per day will be imposed until all violations are abated
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
