EXECUTIVE SUMMARY
Recommendation to authorize a Budget Amendment in the amount of $3,475,036 for Capital
Improvements for the Collier County Courthouse, Building L, and approve the utilization of Court
Maintenance Fee funding in Fund 181.
OBJECTIVE: To provide the necessary funding in Project 50195.2 to complete budgeted Collier
County Courthouse Capital Improvements and to utilize Fund 181 for other Capital Improvements.
CONSIDERATIONS: In accordance with Florida Law (F.S. 318.1.8(13)), Collier County Ordinance
2009-41 provides a supplemental funding source for improvements to the State Court Facilities that is to
be utilized upon approval by the Chief Judge and by the Board.
The Court Administration Office, in collaboration with the Facilities Management Division, have
identified the required County's Courthouse Capital Improvements. The Collier County Courthouse
Building L 6t' floor renovation will construct two new criminal courtrooms and associated courthouse
facilities and upgrade the training/meeting rooms and restrooms to support current and projected
courthouse operations. In addition, security (G4S) overtime support is also required during the renovation
and is incorporated into the budget amendment.
On August 03, 2020, the County Manager's Office submitted a letter, with an estimated budget provided
by Facilities Management, to the Chief Judge recommending and requesting approval to use the
supplemental funds to proceed with the renovations. Chief Judge, Hon. Michael T. McHugh, approved
the request on August 21, 2020 for the project.
FISCAL IMPACT: A budget amendment is needed to move funding in the amount of $3,475,036 from,
Court Facilities Maintenance Fee Fund (181) reserves to Project No. 50195 (Courthouse Improvement).
The source of funding for this project is court fees for non -criminal traffic infractions set forth in Chapter
318 Florida Statutes.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues, and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners authorize a Budget Amendment in
the amount of $3,475,036.00 and approve the utilization of Court Maintenance Fee funding for the
courthouse 6' floor renovations for the County's Courthouse Capital Improvements.

I have had an opportunity to review your letter date August 3, 2020 requesting concurrence of
your proposed Fund 181 outlays for courthouse construction and renovations on the 6" floor.
Based on the information that I have received, it appears that this request is reasonable. It also
appears the Fund 181 reserve is sufficient to cover these expenses. Based on all of this I am

Dear Judge McHugh:
As you know, Florida Statute 318.18(13) provides that local governments may impose a $30
surcharge for any infraction or violation to fund "state court facilities." In compliance with this
statute, Collier County Enacted Ordinance No. 2009-41, which amends our earlier Ordinance
No. 2004-43, to reflect the Florida Legislature's 2009 amendment to F.S. 318.18(13), raising the
traffic infraction surcharge from $15 to $30.
In addition, Section 1(c) provides that:
The funds collected pursuant to this Ordinance shall be used to fund state courtfacilities.
Funds collected pursuant to this Ordinance shall be expended as provided by the Board
of County Commissioners in consultation with the Chief Judge.
Accordingly, the County wishes to utilize these monies for the following courthouse construction
and renovations on the 61h floor:
• Construction of two new courtrooms, renovation and upgrades to the existing
meeting rooms/restrooms and relocation/upgrade of the training room. Security
(G4S) overtime support is also required during renovations: $3,475,036
The budget for these projects is estimated at $3,475,036
The current reserve funding totals at $6,399,814
Pursuant to Section 1(c), we are seeking your consideration and concurrence to move forward on
the above -referenced courthouse renovations. Your anticipated cooperation in this matter is
greatly appreciated and we look forward to your response.
