A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AUTHORIZING THE CONVEYANCE OF A PARCEL OF
LAND (PARCEL 358FDOT) SITUATED ON THE WEST SIDE OF SR 951 AT ITS
INTERSECTION WITH MANATEE ROAD TO THE STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION.
WHEREAS, the State of Florida Department of Transportation proposes to construct
improvements to SR 951 between Henderson Creek Drive and a point approximately 1,300 feet
south of Manatee Drive ("the Project"); and
WHEREAS, it is necessary that a parcel of land ("Parcel 358FDOT" or "the Property")
presently owned by Collier County, be conveyed to the State of Florida Department of
Transportation for construction of the Project; and
WHEREAS, pursuant to Section 125.38, Florida Statutes, a Resolution setting forth such
conveyances to the State of Florida Department of Transportation, must be approved by the Board;
and
WHEREAS, the State of Florida Department of Transportation has made application to
Collier County to execute and deliver to the State of Florida Department of Transportation the deed
set forth in Exhibit "A", conveying all rights, title and interests that Collier County has in and to the
Property transportation and stormwater management purposes, at no additional cost to the State of
Florida Department of Transportation, and said request having been duly considered; and
WHEREAS, said use is in the best interest of Collier County; and
WHEREAS, the Property is no longer necessary for Collier County purposes.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Collier
County, that the application of the State of Florida Department of Transportation for conveyance of
the Property owned by the County is for transportation and stormwater management purposes that
are in the public or community interest and for public welfare; that the Property required for such
purposes by the State is no longer needed for Collier County purposes; and that the Chairman is
hereby authorized to execute the deed set forth in Exhibit "A" in favor of the State of Florida
Department of Transportation, conveying all right, title and interest of Collier County in the
Property described in Exhibit "A", along with such other closing documents needed to effectuate

transfer, after approval by the Office of the County Attorney, at no additional cost to the State of
Florida Department of Transportation.
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded
