The presiding Chairman and Vice-Chairman shall be 30 elected by a majority of the members of the Board of County Commissioners and said 31 election shall occur at the first regularly scheduled Board meeting in January of each 32 year. Commencing with the first regularly scheduled Board meeting in January 2021, the 33 position of the Chairman shall be rotated in numerical order based on the Commission 34 District number beginning with the Commissioner of District 4. The position of the Vice- 35 Chair shall also rotate in numerical order beginning with the Commissioner of District 5. 36 A prerequisite to being Chairman shall be one year's tenure on the Board. Should the 37 Commissioner of the District scheduled to be Chair not meet the tenure requirement,then 38 for that year the Chair shall skip to the next qualified Commissioner in the rotation, with 39 the Vice-Chairman always being next in line for Chair. Page 1 of 2 C 41 42 SECTION TWO: Conflict and Severability. 43 In the event this Ordinance conflicts with any other ordinance of Collier County or other 44 applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held 45 invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a 46 separate, distinct and independent provision and such holding shall not affect the validity of the 47 remaining portion. 48 49 SECTION THREE: Inclusion in the Code of Laws and Ordinances. 50 The provisions of this Ordinance shall become and be made a part of the Code of Laws and 51 Ordinances of Collier County, Florida. The presiding Chairman and Vice-Chairman shall be elected by a majority of the members of the Board of County Commissioners and said election shall occur at the first regularly scheduled Board meeting in January of each year. Commencing with the first regularly scheduled Board meeting in January 2021, the position of the Chairman shall be rotated in numerical order based on the Commission District number beginning with the Commissioner of District 4. The position of the Vice- Chair shall also rotate in numerical order beginning with the Commissioner of District 5. A prerequisite to being Chairman shall be one year's tenure on the Board. Should the Commissioner of the District scheduled to be Chair not meet the tenure requirement,then for that year the Chair shall skip to the next qualified Commissioner in the rotation, with the Vice-Chairman always being next in line for Chair. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION THREE: Inclusion in the Code of Laws and Ordinances. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION FOUR: Effective Date. This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
