hearing be held on this item, all participants are required to be sworn in. Recommendation
to approve Petition PL20200001420, to disclaim, renounce and vacate the County and the public
interest in a portion of Tract “A” of Tollgate Commercial Center Phase Three, Plat Book 22, Page
95 of the public records of Collier County, Florida, known as Bush Boulevard The subject Right -of-
Way (ROW) is located approximately 1600-feet east of Collier Boulevard between Tollhouse Drive
and I-75 in Section 35, Township 49 South, Range 26 East, Collier County, Florida.
OBJECTIVE: To adopt a Resolution to vacate a portion of Tract “A” of Tollgate Commercial Center
Phase Three, Plat Book 22, Page 95 of the public records of Collier County, Florida, located in Section
35, Township 49 South, Range 26 East, Collier County, Florida, being more specifically shown in Exhibit
A.
CONSIDERATIONS: Petition PL20200001420 has been received by the Development Review
Division, Growth Management Department from Dan Hartley of Peninsula Engineering, as agent for the
property owner, to vacate a portion of Tract “A” of Tollgate Commercial Center Phase Three, Plat Book
22, Page 95 of the public records of Collier County, Florida, located in Section 35, Township 49 South,
Range 26 East, Collier County, Florida.
The project site was originally platted to support commercial outparcels and includes a portion of Tract A
and all of Tracts 16‐20 of Tollgate Commercial Center Phase Three (Plat Book 22, Page 95), and a part
of Tract 11 of Tollgate Commercial Center Phase Two (Plat Book 18, Page 23). The project site has been
purchased by Creekside Tollgate LLC for the development of fleet vehicle storage and is being re‐platted
into a single tract under the proposed Replat Application PL20200001173. A companion Site
Development Plan application is currently under review (PL20200000246).
Certain existing drainage and utility infrastructure will remain on‐site, and appropriate replacement
easements are provided within the proposed plat for maintenance of that infrastructure by the appropriate
entities. These easements will replace previously platted easements within the portion of the ROW to be
vacated, and letters of no objection have been secured from related entities, as applicable. Other existing
easements are being shifted and/or widened, based on discussions with County staff.
Accordingly, the ROW within the property is no longer required to serve as access to the subdivided
property, and appropriate replacement easements have been provided via replat to replace those vacated
with the ROW. The vacation of this ROW is required for the development of the property for fleet
vehicle storage, serving the public interest.
The Applicant has secured letters of no objection from the requisite agencies and adjacent property
owners.
The Development Review Division has reviewed this Petition and found no reason for objection.
FISCAL IMPACT: Growth Management Department, Development Review Division staff, has
collected a $2,000 “Petition to Vacate” fee from the petitioner, which covers the County’s cost of
recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.

LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. -DDP
RECOMMENDATION: To approve the attached Resolution, relating to Petition PL20200001420,
which will vacate a portion of Tract “A” of Tollgate Commercial Center Phase Three, Plat Book 22, Page
95 of the public records of Collier County, Florida, located in Section 35, Township 49 South, Range 26
East, Collier County, Florida, being more specifically shown in Exhibit A, and direct the Clerk to the
Board to record a certified copy of the Resolution in the public records and to make proper notation of
this Resolution on the plat of Tollgate Commercial Center Phase Three, Plat Book 22, Page 95 of the
public records of Collier County, Florida.

identifying the existing ROW and easements within the property, and the revised proposed easements.
The area of ROW/easements in the existing and proposed conditions are provided.
To summarize revisions to the proposed easements:
· The proposed 60’ DE/CUE (center of site) was extended north to meet the east/west DE
· The east/west DE was expanded to 20’ wide
· The existing 60’ DE, which was previously proposed to be reduced to 30’ DE, now remains at 60’
wide but has been shifted east 5’ to be clear of the proposed 5’ LBE just west of the DE.
Following your review, please advise if the revised design meets County’s approval to support the
Letters of No Objection for DE revision and ROW Vacation.

1. Would you please provide the back-up information related to the SFWMD permit modification
for the outfall swale being replaced with a pipe.
· SFWMD ERP Application 911216-3 originally approved a combination of pipe and swale
for the conveyance in question (see attached plan excerpt from SFWMD permit file).
Upon review of available permit history files via SFWMD ePermitting, specific

documentation reflecting the extension of the pipe through Tract 18 and terminating at
the headwall within the preserve area north of Tract 18 has not been found. However, it
is apparent that the pipe and headwall were originally installed as they exist today.
Aerial imagery from 1995 indicates the headwall was in the current existing condition
(see attached), and the headwall has also been reflected in surveys as early as 1998 (see
attached).
· It is presumed that the extension of the 78” RCP and headwall, and the associated
absence of drainage swale, were coordinated as field changes during construction, and
lack of specific documentation is due to the age of the project (28+/- years).
· Application 911216-3 was eventually inspected by SFWMD and converted to Operation
Phase in 2014. Refer to attached SFWMD inspection report, and Conversion to
Operation Phase letter. These document that the project, in its condition as of 2014,
was approved by SFWMD.
2. We assume that the reason for the vacation request is that the area is going to be utilized for
improvements. Would you please provide additional information on what will be constructed.
· The proposed development is an outdoor storage area for vehicles. The development is
being constructed to support the upcoming Amazon distribution facility (located at the
southwest corner of Davis Blvd and Collier Blvd), and will provide required vehicle
storage and parking for Amazon fleet vehicles.
· Attached is a draft site plan for reference (SDP is under review).
3. Stormwater Management has a strict vacation policy which typically includes the applicant
providing replacement easements. Also, easement vacations require a valid public
purpose. Both of these items will require further information and discussion.
· Final Plat Application PL20200001173 (for which this Letter of No Objection is required)
proposes to re-plat a part of Tract A and all of Tracts 16-20 of Tollgate Commercial
Center Phase Three, and a part of Tract 11 of Tollgate Commercial Center Phase Two,
into a single tract. Accordingly, the portion of Tract A (ROW) within the project
boundary is no longer required to provide access to subdivided properties, which is the
basis of the ROW Vacation request.
· The proposed replat provides replacement easements, as appropriate. Please refer to
attached draft plat as submitted to Collier County (has not yet been revised per
comments received). Appropriate letters of no objection are being secured from entities
with easement rights, as appropriate.

For your review/reference during further discussions, please see attached Boundary Survey showing the
existing easements onsite (including the existing 60’ DE), and draft sheet from our SDP submittal
(PL20200000246), which shows the existing 78” RCP in relation to the proposed development (private
storage lot for vehicles). The draft SDP plan sheet also includes a “Site Easements Detail” (near top of
page, toward right), that shows the proposed easements as reconfigured.

This email is regarding a stormwater review comment for the Tollgate Plaza Parking Lot SDP submittal
(SDP Project No. 20200000246). The comment stated, “Per Resolution 2013-166, provide a Letter of No
Objection from the Capital Project Planning, Impact Fees and Program Management Division,
Stormwater Management Section for the reduction of the 60’ drainage easement.” As such, this email

details the reasoning behind the reduction of the 60’ drainage easement and respectfully requests a
Letter of No Objection.
The construction plans for the Tollgate Commercial Center from April 1992 had the storm drainage
running through a short 78” RCP pipe and into a swale which would then discharge to the north. The 60’
drainage easement was needed in order to allow for the maintenance of the swale. The picture below,
taken from page 3 of the historical plan set, shows the drainage design from the April 1992 plans:
This design was then revised in 1994 to have the 78” RCP discharging pipe run along the entire west side
of Tract 18. Refer to page 7 of the attached historical plan set for more details. The need for the
discharge swale was eliminated with this design. The below picture shows the existing storm design:

The submitted project proposes to reduce the 60’ drainage easement to a 30” drainage easement to still
allow room for maintenance. A picture of the area in question within the proposed plat is shown below:

The historical plan set, originally from 1992 with revisions from 1994, as well as the recently submitted
proposed plat are included as attachments within this email.
If there are no objections to the reduction in area of the Drainage Easement, we respectfully request a
Letter of No Objection. Otherwise, please feel free to contact us with any questions or concerns you
may have.
