EXECUTIVE SUMMARY
Recommendation to approve the release of two code enforcement liens, with an accrued value of
$744,400 for payment of $450 in the code enforcement action titled, Board of County
Commissioners v. Craig Morris, related to property located at 5845 Painted Leaf Lane, Collier
County, Florida.
OBJECTIVE: That the Board of County Commissioners accepts an offer to release two code
enforcement liens, with an accrued value of $744,400 for payment of $450 in relation to Code
Enforcement Board Case Nos. CEPM20120004563 and CESD20120006219.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of two liens against Craig
Morris, in Case Nos. CEPM20120004563 and CESD20120006219, for code violations to the property
located at 5845 Painted Leaf Lane. The violations consisted of a dwelling with a missing roof, windows,
doors and damaged interior and exterior walls, and construction of an unpermitted garage or carport on
the property.
The lien in Case No. CEPM20120004563 was recorded in the Official Records on February 6, 2013, at
O.R. Book 4883, Page 2983. The lien amount of $211,400 is based on 1,057 days of accrued fines ($200
per day from December 27, 2012, through November 18, 2015) $211,400. The property was brought into
compliance on November 18, 2015. The lien in Case No. CESD20120006219 was recorded in the
Official Records on February 6, 2013, at O.R. Book 4883, Page 2989. The lien amount of $533,000 is
based on 2,665 days of accrued fines ($200 per day from December 27, 2012, through April 13, 2020).
Operational costs of $161.72 were paid on September 28, 2015. The property was acquired by Joseph
Truncale via Special Warranty Deed, recorded on October 5, 2015. The property was brought into
compliance by the current owner.
Pursuant to Resolution No. 2012-46, a request for a reduction of fines may be considered, in part, when a
lien encumbers property under new ownership, and the new owner has diligently pursued abatement and
achieved compliance and/or when payment of the lien would impose a severe financial hardship on the
owner. The new owner took title to a severely damaged, foreclosed property with uncorrected code
violations, with the intent of building his future home. As a self -employed business owner, Mr. Truncale
continued to work diligently after Hurricane Irma flooded and damaged the newly built home. There were
many obstacles caused by a natural disaster and the Covid-19 pandemic. Approximately $56,000 was
expended for the demolition of the previous building, installation of utilities, clean up, inspections, and
permit fees. It took a substantial amount of time and commitment, with extensive follow-up and repairs,
to abate the property. The property is actively maintained, and the owner has paid $450 in settlement of
fines. The owner is requesting a waiver of $743,950 in accrued fines. There are no known code violations
remaining on the property.
FISCAL IMPACT: Payment of $450 in settlement of fines has been received. If approved by the Board,
accrued fines in the amount of $743,950 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. JAK

To whom it may concern and lliana,
I would like to notify you that I have now completed all the safety and permitting requirements of Collier County at
property 5845 Painted Leaf Lane. This letter is a request to have allfines waived. Many violations were placed against
this property in 2012 prior to my ownership. The property went into foreclosure October 2013. I subsequently
purchased the property on September 29'h, 2015. Additional fines continued to be added to the Prior Ownerships
Penalties until the completion of all county inspections.
Due to the extensive havoc of this property, overgrowth of vegetation, no electricity, and uninhabitable building
conditions, my primary goalwas to bring this property up to safety compliance. In addition, to relieve the eyesore and
improve the neighborhood. Upon purchasing the property, I had a meeting with code official Mr. Renald Paulto discuss
County requirements to bring the property into code compliance. We knew it would be a lot of time, work,
commitment, and expense to do all the demolition, clean up and build-out but an estate property has been a goal of
mine for many years. During this entire process lstayed in contact with the code officials assigned to this case. I have
complied with, and even exceeded, all the County's requirements and concerns.
Despite maintaining the Master Permit time-lines, fines continued to accrue based on the property's originalviolations.
While I would have liked to have moved the project to completion quicker, there were financial and various unforeseen
obstacles that came into play. For example, during this time Naples was hit by "lrma" a major hurricane. I suffered
majorfinancial hardship as so many other Naples residents had during this time and damaging setbacks. Notonlydid
this property I was working on obtain damage and flooding that needed to be tended to, my existing home also needed
repairs to be able to continue to occupy it. This led to more delays and expenses to make the repairs needed to
continue moving forward. ln addition, post hurricane, as an air conditioning repairman, my focus was diverted for
months to working around the clock to assisting the Naples community with repairs to their AC Systems to allow for
appropriate living conditions. Unanticipated delays havealsocomeaboutoverthe past several monthswiththe
Covid19 pandemic. These unforeseen natural disaster and pandemic delayed not only my progress, but the county has
also had times of closure and delays.
I have pulled, passed and paid for all the required permits and fees. This process has taken a considerable amount of
time as I am a single person, that is self-employed, working full time, and doing almost all the properties work myself. I
have been working diligently and progressing as I have been able to obtain funds to pay for the necessary improvements
and repairs. I ensured that permitting requirements were fulfilled timely and without any expiration of the Master
Permit.
