PETITION.
PETITION NO. BDE-PL20180002398 — Daniel L. Koelsch and Connie M. Sofo-Koelsch
request a 5-foot boat dock extension over the maximum 20 feet allowed by Section 5.03.06 of
the Land Development Code,for a total protrusion of 25 feet,to accommodate a new docking
facility with two boat slips including one boat-lift for the benefit of property described as Lot
211,Isles of Capri Unit 2 subdivision also known as 129 Pago Pago Drive West in Section 32,
Township 51 South,Range 26 East, Collier County, Florida.
STAFF RECOMMENDATION.
Approval with conditions.
FINDINGS.
1. The public hearing for this Petition was properly noticed and conducted in accordance with all
County and state requirements.
2. The public hearing was conducted electronically and in-person in accordance with
Emergency/Executive Order 2020-04.
3. The Petitioner and/or Petitioner's representative executed the Hybrid Virtual Quasi-Judicial
Public Hearing Waiver related to conducting the public hearing electronically and in-person.
4. The Petitioner and/or Petitioner's representative presented the Petition, followed by County
staff and then public comment.
ANALYSIS.
Based on a review of the record including the Petition, application, exhibits, the County's staff
report, and hearing comments and testimony from the Petitioner and/or the Petitioner's
representative(s), County staff and any given by the public, the Hearing Examiner finds that there
is sufficient competent, substantial evidence as applied to the criteria set forth in Section 5.03.06.
of the Land Development Code to approve Petition.

DECISION.
The Hearing Examiner hereby APPROVES Petition Number BDE-PL20180002398, filed by
Randy McNeil of WB Marine Group, Inc. d/b/a Naples Marine Construction representing Daniel
L. Koelsch and Connie M. Sofo-Koelsch, with respect to the property described as129 Pago Pago
Drive West, further described as Lot 211, Isles of Capri No. 2, in Section 32, Township 51 South,
Range 26 East. Collier County, Florida for the following:
• A 5-foot boat dock extension, over the maximum permitted protrusion of 20 feet allowed
by Section 5.03.06 of the Land Development Code (LDC) for waterways greater than 100
feet in width, for a total protrusion of 25 feet to accommodate a new docking facility with
two boat slips including one boat-lift for the benefit of the property
Said changes are fully described in the Survey and Site Plan attached as Exhibit"A"and are subject
to the condition(s) set forth below.

LEGAL DESCRIPTION.
129 Pago Pago Drive West, further described as Lot 211, Isles of Capri No. 2, in Section 32,
Township 51 South, Range 26 East. Collier County,Florida.
CONDITIONS.
1. All other applicable state or federal permits must be obtained before commencement of the
development.
DISCLAIMER.
Pursuant to Section 125.022(5)F.S., issuance of a development permit by a county does not in any
way create any rights on the part of the applicant to obtain a permit from a state or federal agency
and does not create any liability on the part of the county for issuance of the permit if the applicant
fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or
undertakes actions that result in a violation of state or federal law.
APPEAL OF BOAT DOCK EXTENSION TO BOARD OF COUNTY COMMISSIONERS.
As to any boat dock extension petition upon which the Hearing Examiner takes action, an
aggrieved petitioner, or adversely affected property owner, may appeal such final action to the
Board of County Commissioners. Such appeal shall be filed with the Growth Management
Department Administrator within 30 days of the Decision by the Hearing Examiner. In the event
that the petition has been approved by the Hearing Examiner, the applicant shall be advised that

he/she proceeds with construction at his/her own risk during this 30-day period. Any construction
work completed ahead of the approval shall be at their own risk.
