1. My name is ROBBIE L. RAYBURN.
2. I was the wife of CHARLES W. RAYBURN (also known as CHARLES WILLIAM
RAYBURN, SR.), who has since deceased. A copy of the Death Certificate is attached
as Exhibit "A".
3. Prior to July, 31,2000, CHARLES W. RAYBURN and I were the owners of that
certain piece of property described as follows:

according to the map or plat thereof as recorded in Plat Book 4, Page 77, Public
Records of Collier County, Florida.
4. CHARLES W. RAYBURN, who owned the aforesaid property with me, is not one and

Liens were filed, as recorded in O.R. Book 2256, Page 531 and O.R. BOOK 2276,
PAGE 1092.

T~~~~BORDINATION, CONSENT AND JOINDER OF EASEMENT given this. 29TH day
of DE , 2006 by WASHINGTON MUTUAL BANK, F. A., whose post office address is
11200 W, Parkland Avenue Milwaukee, Wisconsin (hereinafter referred to as "Mortgagee"), in favor of
BOARD OF COUNTY COMMISIONERS OF COlliER COUNTY, FLORIDA, AS THE GOVERNING
BODY OF COLl.lER COUNTY AND AS EX-OFFICIO THE GOVERNING BODY OF THE COLLIER
COUNTY WATER-SEWER DISTRICT, its successors and assigns, whose address is 3301 East Tamiami
Trail, Naples, Florida 34112 (hereinafter referred to as "CCWSD"). Mortgagee is used as singular or
plural, as the context requires.
WIT N E SSE T H:
WHEREAS, Mortgagee is the owner and holder of that certain Mortgage by and between FERN
ROBERSON SCHMIDT and WASHINGTON MUTUAL BANK, F. A., dated May, 1, 2002 and recorded
on May 8, 2002, in Official Records Book 3033, Page 921 et seq. of the Public Records of Collier County,
Florida (hereinafter referred to as "Mortgage"), encumbering the premises legally described therein
(hereinafter referred to as the "Encumbered Property"); and
WHEREAS, CCWSD has requested and received from the fee simple owner of the Encumbered
Property a perpetual non-exclusive easement for utility and access purposes, over, under, on, and across
a portion of the encumbered premises legally described in Exhibit "A" attached hereto and incorporated
herein by virtue of this reference (which premises are hereinafter referred to as the "Easement Property");
and
WHEREAS, CCWSD has requested that Mortgagee consent to, join in and subordinate its Lien to
the interest that CCWSD has in the Easement Property, to which request Mortgagee has agreed.
NOW, THEREFORE, in consideration of TEN DOLLARS ($10,00) and other good and valuable
consideration, the- receipt and sufficiency of which is hereby acknowledged, the Mortgagee does hereby
consent to, join in and subordinate the lien of its Mortgage to the grant of that certain easement described
herein over, unde', on and across the Easement Property and any interest of CCWSD in any utility and
access facilities h:>cated therein or affixed thereto. Except as subordinated to the easement described
herein over, under, on and across the Easement Property, or any utility and access facilities located
therein or affixed thereto, said Mortgage shall remain in full force and effect.

Boulevard North, Naples, Florida, 34120-1637, (hereinafter referred to as "Grantor"), to the
BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING
BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, its successors and assigns,
whose mailing address is 3301 Tamiami Trail East, Naples, Florida 34112, (hereinafter referred
to as "Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective heirs, legal representatives, successors or assigns.)

Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged,
hereby conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a
perpetual, non-exclusive easement for utility and access purposes, on the following described
lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is
incorporated herein by reference,
Subject to easements, restrictions, and reservations of record.
THIS IS HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter
upon said land, excavate, and place or remove materials, including, but not limited to, water
lines and pipes, well pumps and raw water wells, and other equipment or improvements
appurtenant thereto or thereunder for the purpose of constructing, operating, and maintaining
utility facilities thereon. The easement granted herein shall constitute easements running with
the land and shall burden the lands described above.
