Ordinance 2007-03 / _" i ,., ,,' .y;,"i'"'' .', 'v ~^\, ~"-: # ~ (,~ ~ ~~~ ~.9~ ~ 1,.'0 l> r~ ~~ ORDINANCE NO. 07- 03 AN ORDINANCE AMENDING ORDINANCE NUMBER 2004-41, AS AMENDED, THE COLLIER COUNTY LAND DEVELOPMENT CODE WHICH ESTABLISHED THE COMPREHENSIVE ZONING REGULA TIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, FLORIDA, BY AMENDING THE APPROPRIATE ZONING ATLAS MAP OR MAPS BY CHANGING THE ZONING CLASSIFICATION OF THE HEREIN DESCRIBED PROPERTY LOCATED ON WOLFE ROAD APPROXIMA TEL Y Y2 MILE WEST OF COLLIER BOULEVARD IN SECTION 34, TOWNSHIP 48 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA, FROM THE RURAL AGRICULTURAL (A) ZONING DISTRICT TO THE RESIDENTIAL MUL TI- FAMIL Y-6 ZONING DISTRICT (RMF-6[4]) FOR A 4.61:!: ACRE PROJECT KNOWN AS SCENIC WOODS; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, William L. Hoover of Hoover Planning & Development, and Richard Y ovanovich of Goodlette, Coleman, & Johnson, P.A., representing Buckstone Estates LLC, petitioned the Board of County Commissioners to change the zoning classification of the herein described real property. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: The zoning classification of the real property as more particularly described by Exhibit "A", attached hereto and incorporated by reference herein, and located in Section 34, Township 48 South, Range 26 East, Collier County, Florida, is changed from the Rural Agricultural (A) zoning district to the Residential Multi-Family-6 zoning district (RMF-6[4]) for a 4.61:!: acre project known as Scenic Woods and the appropriate zoning atlas map or maps, as described in Ordinance 2004-41, the Collier County Land Development Code is/are hereby amended accordingly. The herein described real property is the same for which the rezone is hereby approved subject to the conditions shown in Exhibit "B." Prior to the issuance of any certificates of occupancy for any units in the project, the developer or its successors and assigns, shall pay to the Collier County Affordable Housing Trust Fund the sum of $1,000 for each unit. The payment of this sum shall be credited against the project's obligations to pay linkage or other fees that may be adopted in the future by the County relating to the provision of affordable or workforce housing. 2. Certificates of occupancy shall not be issued for any units in the project until the six-Ianing roadway improvements for the segment of Vanderbilt Beach Road from County Road 951 west to Airport-Pulling Road have been substantially completed and the roadway is fully operational.
