EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20190002863, to disclaim, renounce and vacate the County and the public interest
in a portion of the Pelican Bay Improvement District Drainage Easement (P.B.I.D.D.E.), as
recorded in Official Record Book 790, Page 1803 of the Public Records of Collier County, Florida,
located approximately 540 feet west of the intersection of Pelican Bay Boulevard and Nicholas
Boulevard, located in Section 4, Township 49 South, Range 25 East, Collier County, Florida.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the
Pelican Bay Improvement District Drainage Easement (P.B.I.D.D.E.), as recorded in Official Record
Book 790, Page 1803 of the Public Records of Collier County, Florida, located in Section 4, Township 49
South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A.
CONSIDERATIONS: Petition VAC-PL20190002863 has been received by the Development Review
Division, Growth Management Department from Michael J. Delate, P.E., of Q. Grady Minor &
Associates, as agent for the property owner, to vacate a portion of the Pelican Bay Improvement District
Drainage Easement (P.B.I.D.D.E.), as recorded in Official Record Book 790, Page 1803 of the Public
Records of Collier County, Florida, located in Section 4, Township 49 South, Range 25 East, Collier
County, Florida.
The County acquired its interest in the P.B.I.D.D.E., as recorded in Official Record Book 790, Page 1803,
through Resolution 1991-216, which transferred title to all property and property rights of the Pelican Bay
Improvement District to the County. The applicant now seeks to vacate this easement in order to perform
common area renovations and expand the pool deck.
The portion of the easement to be vacated does not function to convey stormwater but acts to provide
volume in flood events. The easement area will not be filled and will continue to retain equivalent volume
for flood events. In addition, the applicant is providing replacement easements in order to accommodate
future stormwater needs. There are no known County drainage facilities or pipes within the existing
drainage easement proposed to be vacated.
There is no public detriment associated with this vacation because adequate replacement easements are
being provided as part of the vacation to accommodate future stormwater needs, and there will be no
adverse impact on adjacent property owners.
Letters of No Objection has been received from Collier County Capital Project Planning and the Crown
Colony Village Association, Inc. A letter from the Army Corp of Engineers has been received stating "No
Permit Required" (NPR).
The Development Review Division has reviewed this petition and found no reason for objection.
FISCAL IMPACT: Growth Management Department, Development Review Division staff has
collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of
recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.

LEGAL CONSIDERATIONS: Petitioner is requesting vacation of a portion of the Pelican Bay
Improvement District Drainage Easement (P.B.I.D.D.E.), as recorded in Official Record Book 790, Page
1803 of the Public Records of Collier County, Florida,
Pursuant to Resolution 2013-166 and Florida Statutes Sections 125.01 and 125.37, the Board may adopt
resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof,
granted to the County or public by any instrument recorded in the public records of Collier County and to
renounce and disclaim any right of the County and the public in and to any land in connection therewith;
when such interest is granted to the County or public by any instrument recorded in the public records
other than on a subdivision plat, when the following criteria are met:
1. Public benefit is established or no public detriment is established.
2. The Petitioner owns the fee simple title to the whole or that part of the parcel on which a public or
County dedicated easement is sought to be extinguished

which will vacate the County and the public interest in a portion of the Pelican Bay Improvement District

Records of Collier County, Florida, located in Section 4, Township 49 South, Range 25 East, Collier
County, Florida, being more specifically shown in Exhibit A, and directs the Clerk to the Board to record
a certified copy of the Resolution in the public records of Collier County, Florida.

who a mailing address is 6585 Nicholas Blvd, Naples, FL 34108, (hereinafter referred
to as "Grantor"), to COLLIER COUNTY, a political subdivision of the State of Florida,
whose mailing address is 3299 Tamiami Trail East, c/o the Office of the County
Attorney, Suite 800, Naples, Florida 34112 (hereinafter referred to as "Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to
this instrument and their respective heirs, legal representatives, successors and
assigns. Grantor and Grantee are used for singular or plural, as the context requires.)
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, a
perpetual, non-exclusive drainage easement to enter upon and to install drainage
structures, including but not limited to ditches, swales, earthen berms, rip -rap and
retaining wall systems, underground pipes, various types of water control structures,
and other drainage and stormwater improvements, located over, under, upon and
across the following described lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is
incorporated herein by reference (the "Parcel")
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY NOR IS IT CONTIGUOUS THERETO
Said Parcel having been submitted to condominium ownership pursuant to Chapter
718 of the Florida Statutes by that certain Declaration of Condominium of St. Kitts
recorded at O.R. Book 1756, Pages 1930, et seq. of the Collier County Public Records
on September 30, 21992, as subsequently amended.
TO HAVE AND TO HOLD the same unto the Grantee and its assigns, together with
the right to enter upon said land and to place and/or excavate materials and to maintain
the lakes, ponds, water courses, ditches, canals, pipes, inlets and/or water control
structures located within said drainage easement at Grantee's sole discretion. Grantee
having no obligation or responsibility for maintenance with respect to the drainage
easement, the same being the sole responsibility of the Grantor This easement includes
the right to remove and use any and all excavated material.

Hi Lisa,
I wanted to reach out regarding the Pelican Bay St. Kitts project. Correction Comment #5 in the
attached Easement Vacation application requests a letter of no objection from the PBF. I attended the
DRC meeting where it was approved to go to the PBF, but just wanted to see if it had gone to the PBF
and if a letter of no objection could be provided? The PBF letter of no objection is the last item needed
for the easement vacation application. The easement vacation approval is also the last remaining item
needed for the SDPA approval so once we have the easement vacation approved, we can move forward
with the SDPA approval as well.
If it hasn't gone to the PBF yet, could you please let me know when they will be considering it.

If you spoke with Roger today, I'm sure he told you that we received approval yesterday from the PBSD
Water Management Committee. They chose not to vacate that portion of the drainage easement but
approved the encroachment and will issue a letter of "no objection". We will try to get that to you
before December 4th.
Concerning the SDPA, the county has said they can turn around the final permit within 5 days of
receiving the last few minor items they have requested, which I think Julien plans to submit at the
beginning of next week.
One of those items is the architectural plans of the renovation with building area and code
information. Having done this, I would like to ask you to replace the architectural drawings submitted
with the application (04 stk.car.191112.pdf) with the final SDPA set (04 stk car 191119.sdpa.s3). I'm not
sure you need the building area and code information, but this set also corrects the titles of the
perspective views on sheet A4.2. You can download this set from our ftp site using the following link:

With the intervention of Thanksgiving in the week that the county would have to issue a final SDPA
before your 12/04/19 deadline, we might not have the final SDPA approval until a day or two after
12/04. We'll push as hard as we can, but is there any leeway possible? Would it suffice to have the two
review officials with outstanding objections email your office to confirm that they have what was
requested and that their review will be complete by, say, 12/06?

RESOLUTION NO. 90-335
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, EXERCISING ITS ABILITY
TO SUCCEED TO THE POWERS, RIGHTS, DUTIES, FUNCTIONS,
AND OBLIGATIONS OF THE PELICAN SAY IMPROVEMENT DISTRICT.
WHEREAS, the Pelican Bay Improvement District, in Collier
County, Florida, was created by Chapter 74-462, Laws of Florida;
and
WHEREAS, the Board of County Commissioners has found that it
is in the public interest of all the citizens of Collier County to
move forward with succession to the powers, rights, duties,
functions and obligations of the Pelican Bay Improvement District;
and
WHEREAS, Chapter 74-462, Laws of Florida, expressly
contemplates and provides for such succession by the County
Commission of Collier County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. Having reviewed and considered, among other things, the
reports of Hole, Mantes, & Associates, Inc. and of the County's
staff, the county Commission hereby finds that the utility
improvement and development facilities, works, or systems
m authorized by Chapter 74-462, Laws of Florida, have been
constructed and established as functional, viable and productive.
2. Having reviewed and considered, among other things,
-testimony offered at prior public meetings, the reports of Hole,
Montag, & Associates, Inc. and of the County's staff, the County a

3. The Board of County Commissioners has caused a mutual
agreement to be executed between the County and any guarantor, if
any, of the bonded indebtedness incurred pursuant to the
provisions of chapter 74-462, haws of Florida. Further, collier
County Resolution No. 90-328 and all mutual agreements identified
or authorized therein are hereby re -adapted, ratified and
confirmed.
4. The County declares and agrees, in any and all events,
to maintain inviolate so long as they exist in law or equity the
legal and equitable rights, powers, and interests of each and
every bondholder and any and all bond financing procedures
authorized specifically by Chapter 74-462, so long as they exist
in law or equity and pursuant to the terms and provisions of those
certain bond sale agreements applicable thereto. The County
hereby declares its intention to agree and does so agree to abide
by all the covenants and conditions in the Pelican Bay Improvement
District bond resolutions, and finds, based upon a study of the
Pelican Bay Improvement District's system, that succession as
contemplated by Chapter 74-462, Laws of Florida, and this
Resolution will have no adverse effect on the Pelican Bay
Improvement District bondholders.
5. Section 4(1)-(3) of Chapter 74--462, Laws of Florida,
having been fully satisfied and addressed, the county declares, in
its sole discretion and pursuant to Chapter 74-462(4)(b), Laws of
Florida, and applicable legal authority, its election, effective
immediately, to succeed to the powers, rights, duties, functions
and obligations of the pelican Bay Improvement District, and
directs the Board of Supervisors of the Pelican Hay Improvement
District to abide with this declaration.
6. The County hereby declares and directs; that Pelican Bay
Improvement District Board of Supervisors are hereby dismissed,
without further compensation, since no actual 01, practical.

7. The County hereby declares that all contracts of the
Pelican Bay Improvement District for supplies, services, and other
things of value shall remain in force until such time as the Board
Of County Commissioners shall determine otherwise appropriate;
that all public Pelican Bay Improvement District employees shall

until such time as the Board of County Commissioners shall
otherwise determine appropriate.
9. The County hereby declares, appoints and authorizes its
County attorney, or his designee, as lead counsel having the final

Improvement District's legal counsel, whether general or special,
and all other legal affairs of the Pelican Bay Improvement
District until such time as the Board of County Commissioners

respond to or direct the Pelican Bay Improvement District's
counsel to initiate, defend or respond to any legal or

Reference is made to the application received on July 29, 2019, for a Department
of the Army permit to construct a pile -supported, cantilevered area over 1,504 square
feet (0.04 acre) of wetlands for the expansion of a pool deck. The project is located at
6585 Nicholas Blvd., in Section 4, Township 49 South, Range 28 East, Collier County,
Florida. The application has been assigned the file number SAJ-2019-01156.
The project as proposed will not require a Department of the Army permit in
accordance with Section 10 of the Rivers and Harbors Act of 1899 as it is not located
within the navigable waters of the United States. Furthermore, a permit will not be
required in accordance with Section 404 of the Clean Water Act as it will not involve the
discharge of dredged or fill material into waters of the United States. Provided the work
is done in accordance with the enclosed Project Plans, a Department of the Army
authorization will not be required.
This determination of No Permit Required (NPR) is based on use of a preliminary
jurisdictional determination (PJD). This NPR does not address nor include any
consideration for geographic jurisdiction on aquatic resources and shall not be
interpreted as such. Please note that this PJD depicts an approximation of the extent of
waters of the U.S. on the subject property. Furthermore, this PJD is not an appealable
action and does not expire.
Should you desire an official Corps determination that jurisdictional "waters of the
United States," or "navigable waters of the United States," or both, are either present or
absent on a particular site, the Corps will issue an approved JD when requested.
This preliminary JD has been conducted to identify the potential for Clean Water Act
and/or Rivers and Harbors Act jurisdiction for the particular site identified in this request.
This preliminary JD may not be valid for the wetland conservation provisions of the
Food Security Act of 1985, as amended. If you or your tenant are U.S. Department of
Agriculture (USDA) program participants, or anticipate participation in USDA programs,
you should request a certified wetland determination from the local office of the Natural
Resources Conservation Service prior to starting work.
