Agenda 09/22/2020 Item #16A16 (Resoluition - consider vacating a protion of land)09/22/2020 EXECUTIVE SUMMARY Recommendation to adopt a Resolution to hold a public hearing to consider vacating a portion of Tract "A" of Tollgate Commercial Center Phase Three, Plat Book 22, Page 95 of the Public Records of Collier County, Florida. The subject Right -of -Way is located approximately 1600-feet east of Collier Boulevard between Tollhouse Drive and I-75 in Section 35, Township 49 South, Range 26 East, Collier County, Florida. (PL20200001420) OBJECTIVE: Pursuant to Sections 336.09 and 336.10, Florida Statutes, and Resolution No. 2013-166, the Board of County Commissioners (Board) must authorize a public hearing to consider the vacation of the County and the public interest in any public road right-of-way (ROW). CONSIDERATIONS: The Development Review Division has received a request from Dan Hartley of Peninsula Engineering as agent for the applicant. This request is to vacate a portion of Tract "A" of Tollgate Commercial Center Phase Three, Plat Book 22, Page 95 of the Public Records of Collier County, Florida. The project site was originally platted to support commercial outparcels and includes a portion of Tract A and all of Tracts 16-20 of Tollgate Commercial Center Phase Three (Plat Book 22, Page 95), and a part of Tract 11 of Tollgate Commercial Center Phase Two (Plat Book 18, Page 23). The project site has been purchased by Creekside Tollgate LLC for the development of fleet vehicle storage and is being re -platted into a single tract under the proposed Replat Application PL20200001173. A companion Site Development Plan application is currently under review (PL20200000246). Certain existing drainage and utility infrastructure will remain on -site, and appropriate replacement easements are provided within the proposed plat for maintenance of that infrastructure by the appropriate entities. These easements will replace previously platted easements within the portion of the ROW to be vacated, and letters of no objection have been secured from related entities, as applicable. Other existing easements are being shifted and/or widened, based on discussions with County staff. Accordingly, the ROW within the property is no longer required to serve as access to subdivided property, and appropriate replacement easements will be provided via Replat to replace those vacated with the ROW. The vacation of this ROW is required for development of the property for fleet vehicle storage, serving the public interest. The Applicant has secured letters of no objection from the requisite agencies and adjacent property owners. The hearing will be advertised in a local paper of general circulation pursuant to Section 936.10, Florida Statutes and Resolution No. 2013-166, and the adjoining property owners will be given notice as well. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: The application fee of $2,000 covers staff review and processing. The applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. Upon review of available permit history files via SFWM ePermitting, specific Packet Pg. 1117 16.A.16. h documentation reflecting the extension of the pipe through Tract 18 and terminating at the headwall within the preserve area north of Tract 18 has not been found. However, it is apparent that the pipe and headwall were originally installed as they exist today. Aerial imagery from 1995 indicates the headwall was in the current existing condition (see attached), and the headwall has also been reflected in surveys as early as 1998 (see attached). • It is presumed that the extension of the 78" RCP and headwall, and the associated absence of drainage Swale, were coordinated as field changes during construction, and lack of specific documentation is due to the age of the project (28+/- years). • Application 911216-3 was eventually inspected by SFWMD and converted to Operation Phase in 2014. Refer to attached SFWMD inspection report, and Conversion to Operation Phase letter. These document that the project, in its condition as of 2014, was approved by SFWMD. 2. We assume that the reason for the vacation request is that the area is going to be utilized for improvements. Would you please provide additional information on what will be constructed. • The proposed development is an outdoor storage area for vehicles. The development is being constructed to support the upcoming Amazon distribution facility (located at the southwest corner of Davis Blvd and Collier Blvd), and will provide required vehicle storage and parking for Amazon fleet vehicles. • Attached is a draft site plan for reference (SDP is under review). 3. Stormwater Management has a strict vacation policy which typically includes the applicant providing replacement easements. Also, easement vacations require a valid public purpose. Both of these items will require further information and discussion. • Final Plat Application PL20200001173 (for which this Letter of No Objection is required) proposes to re -plat a part of Tract A and all of Tracts 16-20 of Tollgate Commercial Center Phase Three, and a part of Tract 11 of Tollgate Commercial Center Phase Two, into a single tract. Accordingly, the portion of Tract A (ROW) within the project boundary is no longer required to provide access to subdivided properties, which is the basis of the ROW Vacation request. The comment stated, "Per Resolution 2013-166, provide a Letter of No Objection from the Capital Project Planning, Impact Fees and Program Management Division, Stormwater Management Section for the reduction of the 60' drainage easement." As such, this email Packet Pg. 1122 16.A.16. h details the reasoning behind the reduction of the 60' drainage easement and respectfully requests a Letter of No Objection. The construction plans for the Tollgate Commercial Center from April 1992 had the storm drainage running through a short 78" RCP pipe and into a swale which would then discharge to the north. The 60' drainage easement was needed in order to allow for the maintenance of the swale. Refer to page 7 of the attached historical plan set for more details. The need for the discharge swale was eliminated with this design.
